Turkey’s Foreign Policy: Zero Problems with Neighbors Revisited

            Pundits in Europe and North America in recent months have delighted in citing with a literary smirk ‘zero problems with neighbors,’ which has been the centerpiece of Ahmet Davutoglu’s foreign policy agenda since he became Foreign Minister on May 1, 2009. Mr. Davutoglu had previously served as Chief Advisor to both the Prime Minister and Foreign Minister ever since the AKP came to power in 2002, and was known in those years as the ‘architect’ behind the scenes. Critics of the zero problems approach point to the heightened Turkish tensions with Syria and Iraq, the persisting inability of Ankara to overcome the hostile fallout from Mavi Marmara incident with Israel, and even the revived salience of the long unresolved dispute with the Armenian diaspora sparked by a new French law that makes the denial of genocide associated with the 1915 massacres a crime and has led to a dramatic worsening of Turkish-French relations.

 

            Troubles to be sure, but should these be interpreted as ‘failures,’ and more precisely as ‘Turkish failures’? Perhaps, Davutoglu was insufficiently cautious, or alternatively too optimistic, when he articulated the zero problems diplomacy, but was it not at the time an accurate way of signaling a new dawn for Turkey’s approach to neighbors, especially its Arab neighbors, and actually, to the world as a whole. And Davutoglu implemented his lofty vision with a dizzying series of initiatives that opened long locked doors. He also made it clear that the neighborhood was not to be understood in a narrow geographical sense, but rather in as broad a sense as disclosed by cultural and historical affinities and mutual strategic interests. Davutoglu was eager not only to banish lingering bad memories associated with centuries of Ottoman rule over much of the Arab world, as well as to renew connections with countries that shared Turkic and Muslim identities.

 

            It should be recalled that Turkish foreign policy began charting this new course years before Davutoglu became Foreign Minister, and thus was a shift in worldview that was shared with Recip Tayyip Erdogan and Abudllah Gul, the two dominant political leaders during the past decade.  Indeed, both men deserve some of the credit, and a share of the responsibility, for steering the Turkish ship of state into such mainly uncharted waters of diplomatic initiative.

 

            In an important sense, the turning point came in 2003 when the Turkish government, after sending some mixed signals to Washington, finally refused to allow the United States to use its territory to stage an invasion of Iraq. At the time the anti-AKP domestic opposition challenged this unprecedented act of geopolitical insubordination by Ankara as the biggest mistake in the whole of Turkish republican history. In retrospect, this opting out of the invasion of Iraq constituted a transformational moment for Turkey that demonstrated to its neighbors and the world, and even to itself, that Turkey could and would think and act for itself when it comes to foreign policy, that the hierarchical alliances of the Cold War period were over, and that Washington should no longer take Ankara’s collaboration for granted. And yet this move did not mean, as some critics in both Turkey and the United States wrongly claimed, a turn toward Islam and away from the West or its continuing involvement in Western security arrangements. Even during the Iraq War Turkey allowed the Incirlik Air Base to be used by American combat aircraft, including for bombing missions. As recently shown, Turkey still values its NATO ties even to the extent of allowing radar stations to be deployed on its territory that is linked to a missile defense system that seems mainly intended to protect Europe, Israel, and the Gulf from Iran in the immediate future and possibly Russia in the long-term.

 

            By now it is almost forgotten that it was Turkey that encouraged peace talks between Syria and Israel to resolve their conflict that seemed to be headed for success until their abrupt breakdown, a development attributed at the time to the Israeli attacks on Gaza at the end of 2008, but in retrospect better understood as the unwillingness of Israel to give up its 1967 conquest and subsequent occupation of the Golan Heights. Turkey also sought to be a peacemaker further afield in the Balkans and Caucasus, doing the seemingly impossible, bringing Bosnia and Serbia together in a manner that moved these two antagonistic governments on a path leading to normalization and at least a cold peace. Even more ambitiously, in collaboration with Brazil, Turkey used its new stature as an independent regional player in May 2010 to persuade Tehran to accept an arrangement for the storage of a large portion of Iran’s enriched uranium in Turkey, thereby demonstrating the plausibility of a peaceful alternative to the United States/Israel posture of sanctions and warmongering.

 

            To be sure, the earlier sensible effort to have friendly relations with Syria has now badly backfired, but not until the regime in Damascus started the massive shooting of its citizens and refused to meet the demands of its people for far reaching reforms.  Arguably, the same reversal of outlook in Ankara occurred in relation to Libya after Qaddafi threatened to massacre his opposition, leading eventually to extending some Turkish humanitarian support for the UN-backed NATO intervention in Libya in 2011 that shaped the outcome of an ongoing internal struggle for control of the Libyan political future. Also, there is no doubt that the refusal of the European Union to shift its one-sided stance on Cyprus that is punitive toward Turkey has had some serious consequences. It has soured relations with Greece, producing a temporary deterioration that has taken place despite the Turkish show of reasonableness and exhibiting a spirit of compromise in relation to Cyprus. And, together with the recent Islamophobic surge in Europe, this perceived unfairness to Turkey with respect to Cyprus has reinforced the weakening of an earlier Turkish commitment to qualify for membership in the EU. 

 

            Even with Israel, despite the strong sympathies of the Turkish public with the struggle of the Palestinians, the AKP leadership has done its best to restore normalcy to the relationship between the two countries. After all, the May 31, 2010 attack by Israel’s navy in international waters on the Mavi Marmara carrying humanitarian activists and assistance to Gaza and challenging the Israeli blockade was not only a flagrant breach of international law but resulted in the death of nine Turkish passengers. Turkey has demanded an official apology and compensation for the families of the victims, a reasonable set of expectations that was apparently on the verge of acceptance by Tel Aviv, but collapsed at the last hour when challenged by the internal political opposition to Netanyahu led by the super-hawk foreign minister, Avigdor Liebermann, now under government investigation for fraud.

 

            What this brief overview argues is that Turkey has consistently tried to avert recourse to intervention and war in the Middle East and to promote diplomatic approaches that rely to the extent possible on soft power. It has, to be sure, experienced several geopolitical rebuffs, as in relation to its efforts to end the confrontation with Iran, impressively refusing to stay in line behind the bellicose leadership of the United States and Israel. Davutoglu has correctly affirmed Turkey’s resolve to act on the principled basis of its values and convictions, as well as strategic calculations of its interests, in the post-Cold War politics of the region, and not blindly follow directives from Washington. Iran is a striking case where the Turkish approach, although seemingly incapable of stemming the drift toward war being mounted by the West, is both wiser and more likely to achieve the goal of reassuring the world that Tehran means what it says when it insists that it does not intend to acquire nuclear weapons. As in every other foreign policy setting, Davutoglu is exhibiting his belief that in the 21st century persuasion works better than coercion when it comes to achieving political goals without even considering the costs of death, devastation, and displacement.

 

            In sum, the zero problems with neighbors as a touchstone to Turkish foreign policy in the Middle East and the world needs to be understood as an aspiration and strong preference rather than as an invariable and inflexible guide to practice. There are too many contradictions embedded in the political realities of the contemporary world to be slavishly tied to a rigid foreign policy doctrine that is incapable of taking account of context and shifting perceptions and interests. For instance, in Syria and Libya the Turkish government was forced to choose between siding with a regime slaughtering its own people and backing a disorganized opposition in its heroic if clouded efforts to democratize and humanize the governing process.  Of course, there are suspicions that Turkey’s support for the anti-Assad insurgency also reflects a disguised preference for a Sunni opposition that is anchored, if at all, in the Muslim Brotherhood as compared to the secular authoritianism of the Damascus regime. As well, there are speculations that in the ongoing regional struggle for ascendancy Turkey would rather in the end side with Saudi Arabia and Egypt, reinforced by the United States, than Iran and a newly engaged Russia.

 

Zero problems needs to be understood as a preferred framework for addressing the relations between countries, not just governments, and in situations of strife choices must be made. Arguably Turkey went too far when it backed NATO in Libya and the UN Security Council with respect to Syria or not far enough when it failed to show support for the Green Revolution in Iran after the stolen elections of June 2009. These are difficult interpretative choices upon which reasonable persons of good faith can disagree. Whatever the policies pursued in specific situations,  they do not necessarily invalidate the principled positions articulated by Davutoglu since he became Foreign Minister. Davutoglu has repeatedly affirmed these principles as being as important for him as are realist calculations in shaping foreign policy in complex situations. Possibly, if the Green Revolution had shown more persistence and promise or the Iranian regime had engaged in more widespread killing of its people Turkey would have made a ‘Syrian choice.’

 

            Davutoglu on more than one occasion has expressed enthusiastic support for the upheavals grouped together under the banner of ‘the Arab Spring.’ He calls these upheavals great historical transformations that are irreversible, and expressions of a thirst by young people in their respective countries for lives of dignity and democratic freedoms. There is nothing that Turkey has done to thwart these high ideals.

 

            In this respect, I think it is possible to reach an assessment of Turkish foreign policy as of early 2012. It has charted a course of action based to the extent feasible on soft power diplomacy, taking numerous initiatives to resolve its conflicts with neighbors but also to offer its good offices to mediate and unfreeze conflicts between states to which it is not a party. Its credibility has become so great that Istanbul has replaced European capitals as the preferred venue for conflict resolution whether in relation to Afghanistan or even Iran, and despite its much publicized diplomatic differences with Washington. It is notable that despite Western annoyance with Ankara regarding Iran or resulting from the simmering dispute with Israel, the U.S. Government seems to favor Istanbul as the most propitious site for any prospective negotiations with Iran concerning its nuclear program.

 

            At the same time, as the policy reversals with respect to Syria and Libya illustrate, it is not always possible to avoid taking sides in response to internal struggles, although Turkey has delayed doing so to give governments in power the opportunity to establish internal peace. In a globalizing world boundaries are not absolute, and sovereignty must give way if severe violations of human rights are being committed by the regime. Even in such extreme circumstances armed intervention should always be a last resort, and one only undertaken in extreme instances on behalf of known opposition forces and in a manner that has a reasonable prospect of cumulative benefits at acceptable costs for the targeted society. Such conditions almost never exist, and so intervention under present world conditions is rarely if ever, in my judgment, justified, although bloodshed, oppression, and crimes against humanity may generate strong public and governmental support for interventionary diplomacy.

 

            We can only hope that Turkey stays the Dautoglu course, pursuing every opening that enables positive mutual relations among countries and using its diplomatic stature to encourage peaceful conflict resolution wherever possible. Rather than viewing ‘zero problems’ as a failure, it should be a time to reaffirm the creativity of Turkish foreign policy in the course of the last decade that has shown the world the benefits of soft power diplomacy, and a pattern that other governments might learn from while adapting to their own realities. This diplomacy, as supplemented by Turkey’s economic success and political stability, helps us appreciate the deserved popularity of and respect for the Turkish Prime Minister, Recep Tayyip Erdogan, throughout the region and the world.

Stop Warmongering in the Middle East

            The public discussion in the West addressing Iran’s nuclear program has mainly relied on threat diplomacy, articulated most clearly by Israeli officials, but enjoying the strong direct and indirect backing of Washington and leading Gulf states.  Israel has also engaged in covert warfare against Iran in recent years, somewhat supported by the United States, that has inflicted violent deaths on civilians in Iran. Many members of the UN Security Council support escalating sanctions against Iran, and have not blinked when Tel Aviv and Washington talk menacingly about leaving all options on the table, which is ‘diplospeak’ for their readiness to launch a military attack. At last, some signs of sanity are beginning to emerge to slow the march over the cliff. For instance, the Russian Foreign Minister, Sergei Lavrov, commented harshly on this militarist approach: “I have no doubt that it would pour fuel on a fire which is already smoldering, the hidden smoldering fire of Sunni-Shia confrontation, and beyond that [it would cause] a chain reaction. I don’t know where it would stop.” And a few days ago even the normally hawkish Israeli Minister of Defense, Ehud Barak, evidently fearful of international panic and a preemptive response by Tehran, declared that any decision to launch a military attack by Israel is ‘very far off,’ words that can be read in a variety of ways, mostly not genuinely reassuring.

 

            It is not only an American insistence, despite pretending from time to time an interest in a diplomatic solution, that only threats and force are relevant to resolve this long incubating political dispute with Iran, but more tellingly, it is the stubborn refusal by Washington to normalize relations with Iran, openly repudiate the Israeli war drums, and finally accept the verdict of history in Iran adverse to its strategic ambitions. The United States has shown no willingness despite the passage of more than 30 years to accept the outcome of Iran’s popular revolution of 1978-79 that nonviolently overthrew the oppressive regime of the Shah. We need also to remember that the Shah had been returned to power in 1953 thanks to the CIA in a coup against the constitutional and democratically elected government of Mohamed Mossadegh, whose main crime was to nationalize the Iranian oil industry. This prolonged unwillingness of Washington to have normal diplomatic contact with Iran has been a sure recipe for international tension and misunderstanding, especially taking into account this historical background of American intervention in Iran, as well as the thinly disguised interest in recovering access to Iran’s high quality oil fields confirmed by its willingness to go along with Israel’s militarist tactics and diplomacy.

 

            This conflict-oriented mentality is so strong in relation to Iran than when others try their best to smooth diplomatic waters, as Brazil and Turkey did in the May 2010, the United States angrily responds that such countries should mind their own business, which is an arrogant reprimand, considering that Turkey is Iran’s next door neighbor, and has the most to lose if a war results from the unresolved dispute involving Iran’s contested nuclear program. It should be recalled that in 2010 Iran formally agreed with leaders from Brazil and Turkey to store half or more of its then stockpile of low enriched uranium in Turkey, materials that would be needed for further enrichment if Iran was truly determined to possess a nuclear bomb as soon as possible. Instead of welcoming this constructive step back from the precipice Washington castigated the agreement as diversionary, contending that it interfered with the mobilization of support in the Security Council for ratcheting up sanctions intended to coerce Iran into giving up its right to a complete nuclear fuel cycle. Such criticism of Turkey and Brazil for its engagement with peace diplomacy contrasts with its tacit endorsement of Israeli recourse to terrorist tactics in its efforts to destabilize Iran, or possibly to provoke Iran to the point that it retaliates, giving Tel Aviv the pretext it seems to seek to begin open warfare.

 

Iran is being accused of moving toward a ‘breakout’ capability in relation to nuclear weapons, that is, possessing a combination of knowhow and enough properly enriched uranium to produce nuclear bombs within a matter of weeks, or at most months. Tehran has repeatedly denied any intention to become a nuclear weapons state, but has insisted all along that it has the same legal rights under the Nonproliferation Treaty as such other non-nuclear states as Germany and Japan, and this includes the right to have a complete nuclear fuel cycle, which entails enrichment capabilities and does imply a breakout capability. In the background, it should be realized that even the 1968 Treaty on the Nonproliferation of Nuclear Weapons contains a provision that allows a party to withdraw from the obligations under the treaty if it gives three months notice and ‘decides that extraordinary events..have jeopardized its supreme national interests.’(Article X) Such a provision, in effect, acknowledges the legal right of a country to determine its own security requirements in relation to nuclear weapons, a right that both the United States and Israel in different ways have implicitly exercised for decades with stunning irresponsibility that includes secrecy, a failure to pursue nuclear disarmament that is an obligation of the treaty, and a denial of all forms of international accountability. The real ‘threat’ posed by a hypothetical Iran bomb is to Israel’s regional monopoly over nuclear weapons. As three former Mossad chiefs have stated, even if Iran were to acquire a few nuclear bombs, Israel would still face no significant additional threat to its security or existence, as any attack would be manifestly suicidal, and Iran has shown no such disposition toward recklessness in its foreign policy.

 

            To be objective commentators we must ask ourselves whether Iran’s posture toward its nuclear program is unreasonable under these circumstances. Is not Iran a sovereign state with the same right as other states to uphold its security and political independence when facing threats from its enemies armed with nuclear weapons? When was the last time resorted to force against a hostile neighbor? The surprising answer is over 200 years ago! Can either of Iran’s antagonists claim a comparable record of living within its borders? Why does Iran not have the same right as other states to take full advantage of nuclear technology? And given Israeli hostility, terrorist assaults, and military capabilities that includes sophisticated nuclear warheads, delivery style, and a record of preemptive war making, would it not be reasonable for Iran to seek, and even obtain, a nuclear deterrent? True, the regime in Iran has been oppressive toward its domestic opposition and its president has expressed anti-Israeli views in inflammatory language (although exaggerated in the West), however unlike Israel, without ever threatening or resorting to military action. It should also be appreciated that Iran has consistently denied an intention to develop nuclear weaponry, and claims only an interest in using enriched uranium for medical research and nuclear energy. Even if there are grounds to be somewhat skeptical about such reassurances, given the grounds for suspicion that have been ambiguously and controversially validated by reports from International Atomic Energy Agency, this still does not justify sanctions, much less threats backed up by deployments, war games, projected attack scenarios, and a campaign of terrorist violence.

 

            So far no prominent advocates of confrontation with Iran have been willing to acknowledge the obvious relevance of Israel’s nuclear weapons arsenal. Is not the actuality of nuclear weaponry, not only an Iranian breakout potential but a substantial arsenal of Israeli weaponry secretly acquired (200-300 warheads), continuously upgraded, and coupled with the latest long distance delivery capabilities, the most troublesome threat to regional stability and peace? At minimum, are not Israel’s nuclear weapons stockpile highly relevant both to bring stability and for an appraisal of Iran’s behavior? The United States and Israel behave in the Middle East as if the golden rule of international politics is totally inapplicable, that you can do unto others, what you are unwilling to have them do unto you!

 

            We need, as well, to remember the lessons of recent history bearing on the counter-proliferation tactics relied upon in recent years by the United States. Iraq was attacked in 2003 partly because it did not have any nuclear weapons, while North Korea has been spared such a comparably horrific fate because it possesses a retaliatory capability that would likely be used if attacked, and has the capability to inflict severe harm on neighboring countries. If this experience relating to nuclear weapons is reasonably interpreted it could incline governments that have hostile relations to the West to opt for a nuclear weapons option as necessary step to discourage attacks and interventions. Surely putting such reasoning into practice would not be good for the region, possibly igniting a devastating war, and almost certainly leading to the spread of nuclear weapons to other Middle Eastern countries. Instead of moving to coerce, punish, and frighten Iran in ways that are almost certain to increase the incentives of Iran and others to possess nuclear weaponry, it would seem prudent and in the mutual interest of all to foster a diplomacy of de-escalation, a path that Iran has always signaled its willingness to pursue. And diplomatic alternatives to confrontation and war exist, but require the sort of political imagination that seems totally absent in the capitals of hard power geopolitics.  

 

            It should be obvious to all but the most dogmatic warmongers that the path to peace and greater stability in the region depends on taking two steps long overdue, and if not taken, at least widely debated in public: first, establishing a nuclear free Middle East by a negotiated and monitored agreement that includes all states in the region, including Israel and Iran; secondly, an initiative promoted by the United Nations and backed by a consensus of its leading members to outline a just solution for the Israel/Palestine conflict that is consistent with Palestinian rights under international law, including the Palestinian right of self-determination, which if not accepted by Israel (and endorsed by the Palestinian people) within twelve months would result in the imposition of severe sanctions. Not only would such initiatives promote peace and prosperity for the Middle East, but this turn to diplomacy and law would serve the cause of justice both by putting an end to the warmongering of recent years and to the intolerable denial of rights to the Palestinian people that goes back to at least 1947, and was later intensified by the oppressive occupation of East Jerusalem, West Bank, and Gaza that resulted from the outcome of the 1967 War.

 

            These manifestly beneficial alternatives to sanctions and war is neither selected, nor even considered in the most influential corridors of opinion-making. It is simple to explain why: world order continues to be largely shaped by the rule of power rather than the rule of law, or by recourse to the realm of rights, and no where more so than in the Middle East where the majority of the world’s oil reserves are located, and where an expansionist Israel refuses to make real peace with its neighbors while subjugating the Palestinian people to an unendurable ordeal. Unfortunately, a geopolitical logic prevails in world politics, which means that inequality, hierarchy, and hard power control the thought and action of powerful governments whenever toward strategic interests are at stake. Perhaps, a glance at recent history offers the most convincing demonstration of the validity of this assessment: Western military interventions in Iraq and Libya, as well as the intimidating threats of attacks on Iran, three states in the region with oil and regimes unfriendly to the West. Egypt and Tunisia, the first-born children of the Arab Spring, were undoubtedly politically advantaged by not being major oil producing states, although Egypt is not as lucky as Tunisia because Israel and the United States worry that a more democratic Egyptian government might abandon the 1978 Peace Treaty and show greater solidarity with the Palestinian struggle, and are doing what they can to prevent Cairo from moving in such directions.

 

            Fortunately, there is a growing, although still marginal, recognition that despite all the macho diplomacy of recent years, a military option is not really viable. It would not achieve its objective of destroying Iran’s nuclear capabilities, and it would in all likelihood confirm the opinions among Iranian hawkish factions that only the possession of nuclear weapons will keep their country from facing the catastrophe brought on by a military attack. Beyond this, attacking Iran would almost certainly unleash retaliatory responses, possibly blocking the Straits of Hormuz, which carry 20% of the world’s traded oil, and possibly leading to direct missile strikes directed at Israel and some of the Gulf countries. Given this prospect, there is beginning to be some indication that the West is at last beginning to consider alternatives to hot war in responding to Iran.

 

            But so far this realization is leading not to the peaceful initiatives mentioned earlier, but to a reliance on ‘war’ by other means. The long confrontation with Iran has developed its own momentum that makes any fundamental adjustment seem politically unacceptable to the United States and Israel, a sign of weakness and geopolitical defeat. And so as the prospect of a military attacked is temporarily deferred for reasons of prudence, as Barak confirmed, but in its place is put this intensified and escalating campaign of violent disruption, economic coercion, and outright terrorism. Such an ongoing effort to challenge Iran has produced a series of ugly and dangerous incidents that might at some point in the near future provoke a hostile Iranian reaction, generating a sequence of action and reaction that could plunge the region into a disastrous war and bring on a worldwide economic collapse.

 

            The main features of this disturbing pattern of covert warfare are becoming clear, and are even being endorsed in liberal circles because such a course of action is seen as less harmful to Western interests than an overt military attack, proceeding on the assumptions that are no better alternatives than confrontation in some form.  Israel, with apparent American collaboration, assassinates Iranian nuclear scientists, infects Iranian nuclear centrifuges used to enrich uranium with a disabling Stuxnet virus, and recruits Iranians to join Jundallah, an anti-regime terrorist organization in Iran, to commit acts of violence against civilian targets, such as the 2009 attack on the mosque in Zahedan that killed 25 worshippers and wounded many others. The New York Times in an editorial  (January 13, 2012) describes these tactics dispassionately without ever taking note of their objectionable moral or legal character: “An accelerating covert campaign of assassinations, bombings, cyber attacks and defections—carried out mainly by Israel, according to The Times—is slowing..[Iran’s nuclear] program, but whether that is enough is unclear.” The editorial observes that “a military strike would be a disaster,” yet this respected, supposedly moderate, editorial voice only questions whether such a pattern of covert warfare will get the necessary job done of preventing Iran from possessing a nuclear option sometime in the future.

 

            It should be obvious that if it was Iran that was engaging in similar tactics to disrupt Israeli military planning or to sabotage Israel’s nuclear establishment liberal opinion makers in the West would be screaming their denunciations of Iran’s barbaric lawlessness. Such violations of Israel sovereignty and international law would be certainly regarded by the West as unacceptable forms of provocation that would fully justify a major Israeli military response, and make the outbreak of war seem inevitable and unavoidable.

 

            And when Iran did recently react to the prospect of new international sanctions making its sale of oil far more difficult by threatening to block passage through the Straights of Hormuz, the United States reacted by sending additional naval vessels to the area and warning Tehran that any interference with international shipping would be ‘a red line’ leading to U.S. military action. It should be incredible to appreciate that assassinating nuclear scientists in Iran is okay with the arbiters of international behavior while interfering with the global oil market crosses a war-provoking red line. These self-serving distinctions illustrate the dirty work of geopolitics in the early 21st century.

 

            There are some lonely voices calling for a nuclear free Middle East and a just settlement of the Israeli/Palestine conflict, but even with credentials like long service in the CIA or U.S. State Department, these calls are almost totally absent in the mainstream discourse that controls debate in the United States and Israel. When some peaceful alternatives are entertained at all it is always within the framework of preventing Iran doing what it seems entitled to do from the perspectives of law and prudence. I am afraid that only when and if a yet non-existent Global Occupy Movement turns its attention to geopolitics will the peoples of the Middle East have some reason to hope for a peaceful and promising future for their region.

            Recently the National Assembly, France’s lower legislative chamber, voted to criminalize the denial of the Armenian genocide in 1915, imposing a potential prison sentence of up to one year as well as a maximum fine of 45, 000 Euros. The timing of this controversial initiative seemed to represent a rather blatant Sarkhozy bid for the votes of the 500,000 French citizens of Armenian descent in the upcoming presidential election. It follows similar pre-election initiatives in 2001 when the French Parliament officially declared that the massacres of Armenians in 1915 were an instance of genocide and in 2006 when the Assembly first voted to criminalize Armenian genocide denial, an initiative that never became law because the French Senate failed to give its assent. And this hopefully may happen again with respect to this recent Assembly move.

 

            Predictably, the French action was perceived by Turkey as a hostile provocation. The Turkish government, which has so far refused to describe the 1915 events as ‘genocide,’ immediately reacted, warning France of adverse economic consequences if this initiative went forward, and has reacted by withdrawing its ambassador and freezing inter-governmental economic relations. The Turkish Prime Minister, Recip Teyyip Erdogan, denounced the action of the French Assembly that had been initiated by a prominent member of Sarkhozy’s party. Erdogan, known for his forthrightness, advised the French Government that instead of criminalizing the Turkish unwillingness to acknowledge the 1915 events as genocide, France should busy itself with determining whether its harsh tactics used during the 1950s in Algeria, and supposedly responsible for up to a million Algerian deaths during the long French campaign to hold onto to its north African colony constituted genocide.

 

            There are many issues raised by this turn for the worse in French-Turkish relations, and its embittering dialogue about historic events. Perhaps, the most important, is whether it is ever justifiable to criminalize the expression of an opinion about a set of past occurrences that goes against a societal consensus. It is true that genocide or Holocaust denial can be hurtful to those who are survivors or descendants of survivors, and identify with the victims of such severe wrongdoing, and its attendant suffering, but whether the sensitivities of these communities should ever be protected by the criminal law seems doubtful, conflicting with freedom of expression and censuring inquiries into historical events that are unpopular and controversial, but occasionally illuminating enough to challenge conventional wisdom. It would seem that informed agreement and social pressure should be sufficient to deter all but the most extremist instances of denial if a genuine and sufficient consensus exists as to the locus of responsibility and the character of the events. In this instance, such criminalization is especially unfortunate as even if the facts of the 1915 events are reasonably well established, the relevance of genocide is certainly ambiguous and somewhat problematic, especially from a legal perspective.

 

            Against this background, where Turkey has not yet been willing to describe the events of 1915 as ‘genocide’ the criminalization of the denial is more likely to raise tensions that encourage a long overdue accommodation. Of course, there are related irritants to the Turkish-Armenian relationship, especially the unresolved conflict over the future of the Nagorno-Karabakh enclave in Azerbaijan. Among thoughtful Turks there continues to be some questioning of the character of the World War I events in question, not about their tragic character or even a willingness to condemn Ottoman wrongdoing, but there remains a Turkish governmental and societal reluctance to pin the label of genocide on these occurrences. It is well known that the Armenian diaspora has long been seeking to induce key governments around the world to make formal declarations to the effect that what happened in 1915 was genocide, and some 25 governments have done so, as have many lesser political entities such as sub-divisions of the state or cities. Such efforts to legalize historical truth, as distinct from mourning historical events, is itself

a political gimmick to circumvent diplomacy and accommodation. But to criminalize genocidal denial represents a still further escalation of Armenian efforts to resolve the controversy over this potent g-word through branding of denial as a crime. We would insist that rather than resolving the conflict, such steps make a politics of reconciliation that much more difficult for both parties.

 

            The discourse on genocide has always been confusing, multi-layered, and often toxic. The word ‘genocide’ is weighted down by its implications, explaining both why there is such a strong impulse to invoke it and an equally intense effort to deny its applicability.  We need to distinguish genocide as a crime in international law from the political assessment of historic events as genocide due to a clear pattern of deliberate killing of an ethnic or religious group. And such a political assessment needs to be further distinguished from a moral condemnation of a pattern designed to destroy systematically a beleaguered minority that might properly be described as ‘genocidal,’ or what has been more recently described as ‘ethnic cleansing’ in the setting of Bosnia, which is distinct from the judicially certified ‘genocide’ that shook the foundations of Rwanda in 1994.

 

            From a legal perspective it is not plausible to call these events in 1915 as genocide. After all, the word did not exist until coined by Rafael Lemkin in 1943, and the crime was not so delimited until the Genocide Convention came into force in 1951. Beyond this, and more telling than this technical observation, is the fact that the indictments at Nuremberg did not charge the surviving Nazi leaders with genocide, but convicted these Germans of ‘crimes against humanity’ for their connection with genocidal conduct, and even here only if the alleged criminal acts were associated with World War II, found by the tribunal to be an unlawful war, and thus a ‘crime against peace.’ If the Holocaust perpetrated against Jews and others did not seem to the Nuremberg tribunal to be a distinct crime, then it seems untenable to regard the Armenian tragedy as embodying the crime of genocide. When the UN expert body, the International Law Commission, put into words what was done at Nuremberg it explicitly affirmed the Roman dictum prohibiting retroactivity: no crime without law (nulla crimen sine lege).  Such a dictum touches on a fundamental component of justice to the effect that behavior, however detestable from moral and political points of view, is not a ‘crime’ until so designated in advance of the acts in question by a competent judicial body. This principle has never been contested, and it pertains to the genocide debate whenever attached to pre-1951 events, whether the Armenian experience or to the destruction of a variety of indigenous peoples in various parts of the world or to the barbarous institution of slavery.

 

            At the same time, if what took place in 1915 were to have occurred anytime after the Genocide Convention became effective, it would seem beyond any reasonable doubt to qualify as genocide. The International Court of Justice in the course of examining the Bosnian allegations of genocide, put the bar high by requiring written or documentary evidence of a clear intent by Serbian governmental leaders to commit the crime of genocide that was not available (except the particular incident involving the horrific massacre of several thousand Bosnian males at Srbrenica in 1995 was declared to be genocide). While such evidence was difficult to provide to the satisfaction of the World Court in relation to this notorious Bosnian experience of the 1990s partly as a result of a questionable arrangement with the ad hoc International Criminal Tribunal for former Yugoslavia not to release documentary evidence tying the Belgrade regime to the anti-Muslim cleansing operations in Bosnia, the situation with respect to Armenia is different. Unlike Bosnia, documentary evidence from the ruling Ottoman authorities does exist in sufficient quantity and quality to make a persuasive argument to the effect that ‘genocide’ took place in 1915, but because the events occurred 36 years before genocide formally became a crime such a showing is legally irrelevant.

 

            If this reasoning is accepted, it has important implications, including establishing some political space for bringing closure to the issue: Turkey could formally declare that if what happened to the Armenians in 1915 took place in the 1960s it would have been genocide, while those on the Armenian side could accept the idea that the 1915 massacres were not then genocide, but that their extent, character, and evidence would constitute genocide if taking place now, or anytime after 1951. The French move, if indeed it becomes law, is irresponsible in the extreme as it disallows the explorations of constructive ways that the violence and suffering of the past might be mitigated. As post-apartheid South Africa has illustrated, it might sometimes be politically and morally preferable for a victimized people to opt for ‘truth and reconciliation’ than to insist on the criminalization of past wrongs however heinous.

 

            It seems to me that such an approach would have mutual benefits. It would bring a conflict that has endured for decades nearer to closure. It would allow Armenians to regard their victimization as genocide from a political and moral perspective, while enabling Turkey to make such a concession without fearing such legal implications as Armenian demands for reparations and the recovery of lost property. Turkish good faith and remorse could be further expressed by appropriating funds for the establishment of a major museum of Armenian History and Culture in Ankara, by recognizing April 24th as a day of Armenian remembrance, and by encouraging honest historical inquiry into these horrific occurrences.

 

            Of course, such a politics of reconciliation can only have any hope of succeeding if there is a large display of good will and a sincere search by Turkish and Armenian leaders for positive relations between the two peoples. It is to be expected that extremists on both sides would strenuously object to such an accommodation. Admittedly, there would not be complete satisfaction even among that largely silent majority of Armenians and Turks who might welcome a pacifying development. What would be created is valuable– a new opening that would allow a more benevolent future to unfold for both peoples that could include a joint cathartic reexamination of the past. Such a development might add to the solemnity and dignity of the expected worldwide observances in 2015 of the 100th anniversary of these events and avoid these occasions from being little more than sad remembrances and shrill recriminations.  

 

Turkey’s Brilliant Statecraft: The Achievement of Ahmet Davutoglu

            By a happy quirk of personal destiny I happened to be in Istanbul recently when the Turkish Foreign Minister Ahmet Davutoglu gave a talk at the opening dinner session of the Istanbul Forum. His theme was the Arab Spring as a defining  historic moment of the post-Cold War era of world politics. In the past I have made no secret of my admiration for the thought and creativity of Mr. Davutoglu’s diplomacy. Since appointed as Turkish foreign minister on May 1, 2009 he has already made in this short period an indelible impact on regional and world affairs. I believe that his exceptional contributions to the statesmanship of our time flow directly from his academic studies carried out prior to his entry into government service, as well as the experience he gained during several years of prominent apprenticeship as Chief Advisor to both the Foreign Minister and Prime Minister. Rarely in my knowledge has a major country allowed its foreign policy to be shaped by a non-politician whose public stature and morally attuned sensibility are based on his intellectual accomplishments. Mr. Davutoglu’s authority rests on an impressive mastery and blending of history, politics, law, ethics, and culture as providing the necessary components for a coherent strategic outlook.

One struggles for contemporary comparisons, finding a few similarly qualified and constructive figures that served their country well by directing its foreign policy. Perhaps the most obvious comparison is with the great Chinese Communist Foreign Minister between 1949-1958, Chou En-lai, who was renowned for his learning and pragmatically sound insights into the foreign policy challenges facing his country at a difficult time of transition. Yet the comparison falters because Chou’s thought and action were derivative from a totalizing ideology, lacked freedom of maneuver in policy given Mao’s stern overall control of the Chinese state, and devoted most of his career to navigating with great skill a turbulent revolutionary struggle within China.

Another comparison that might be the intellectually formidable Dean Acheson who served as the American Secretary of State in the period immediately following World War II, and presided over the formation of efforts to respond both to its role as leader of the West and to the Soviet challenge. His was an articulate and generally sensible pragmatic leadership that deserves generally high praise, but it was anchored in a starkly realist worldview that rejected any mention of normative perspectives based on law, ethics, and justice when contemplating the future of world order. It is precisely this receptivity to the normative foundations of human identity that gives Davutoglu’s worldview its uplifting historical relevance. I would observe that without such an appreciation of law, ethics, and justice Davutoglu would be just one more intelligent realist who spent his time devising how best to manipulate the power configurations confronting his government. At the same time Davutoglu is not a dreamy legalist or moralist in the tradition of Woodrow Wilson; he has a firm grasp of the strategic dimensions of world politics, and his untranslated volume on ‘strategic depth’ is undoubtedly his greatest intellectual contribution up to this point.

 

Comparing Kissinger

In all probability the only recent political figure that possesses an influence and academic credentials comparable to Davutoglu is Henry Kissinger, but having proposed the comparison I need immediately to subvert it mainly for reasons just indicated. Before doing so, it needs to be acknowledged that Kissinger has at this point far exceeded Davutoglu both by his length of tenure at the pinnacles of state power, and by his historical impact, have served a government that possessed the role and status of being the global leader. In contrast, Davutoglu is a relative newcomer, and Turkey is a rising middle power on the global stage, although increasingly a dominant regional presence.

Yet still positive and negative comparisons with Kissinger seems useful. To begin with, Kissinger was a facilitator, not an architect or even an innovator. He was an adept amoral foreign policy entrepreneur who successfully sought and gained entry to the domains of the powerful, and while not a politician, always was prepared to make himself available to do the dirty work of politics. Both Kissinger and Davutoglu share an uncommon ability to think about and explain clearly the most complex international challenges, and both seem endowed with inexhaustible reserves of superhuman energy to implement almost singlehandedly a multi-faceted foreign policy, and neither exhibits great sophistication or appreciation of the economic dimensions of foreign policy, but here the recitation of similarities ends.

Kissinger is stained by his many prevarications and unprincipled approach: extending the war in Vietnam to Cambodia in a manner that allowed, almost coerced, the extremist Khmer Rouge to abandon the countryside, and take over the cities and then harshly impose its will on the entire country by perpetrating one of the worst genocides in history; in the course of diplomatic negotiations to end the Vietnam War, threatening the North Vietnamese with nuclear weapons if they did not give in to American demands in the course of what were supposed to be peace talks; encouraging the military coup in Chile, ironically carried out on 9/11 (although in 1973,) and then backing the notorious dictator, Pinochet, even endorsing Operation Condor, a pre-drone assassination program that inflicted torture and terror on the people of Chile, especially its most idealistic and dedicated youth. Despite his intellectual stature, formidable diplomatic skills, and public recognition, Kissinger is far too compromised ethically and legally to be regarded in a positive light. In this regard, the criticism of Kissinger goes beyond his arch embrace of political realism, and extends to his complicity in the commission of crimes against humanity and war crimes.

Davutoglu has served his government without making any such Faustian Bargains that would suggest that his foreign policy activities are part of an unacknowledged agenda of ambition, international opportunism, and political subservience rather than a reflection of prudence, wisdom, and above all, moral integrity. This quality of principled behavior is what sets Davutoglu permanently apart from the Kissingers of this world, and as unusual as it is for someone of such qualities to rise to such governmental heights, it is probably rarer still, for the presiding politicians in government to seek, welcome, and reward such principled guidance. In this respect, the citizens of Turkey, and really all of us of in the region and the world, should be grateful for the confidence and trust bestowed on Davutoglu by Prime Minister Erdogan and President Gul. It is they who have lifted him from relative academic obscurity to diplomatic eminence, and obviously shared, appreciated, and rewarded his growing number of contributions to Turkish security and influence, as well as to regional peace and justice. This principled consensus was dramatically displayed by the recent visit of the Turkish leadership to Somalia followed by major financial assistance to this most ravaged of African countries. Turkish acceptance of responsibility to lead UN policy toward the 49 Least Developed Countries, beginning with the UN mega-conference held in Istanbul this May is a further demonstration that Turkey’s identity as a principled global actor is more than a reflection of its foreign policy.  

The Republican Inheritance

Perhaps, in this case, the fusion of private religious devotion and public service are connected in ways unique to Turkey that create political space needed for this show of benevolence in government. And here, I think, but it is no more than a conjecture on my part, that some credit needs to be given to the republican legacy of Kemal Ataturk. I say this hesitantly, as an outsider peering inside Turkey through the narrow window slit of my limited knowledge and experience, but it does seem that Turkish secularism, despite its unfortunate excesses, has allowed (for men at least) an effective fusion of religion, morality, and politics at the highest level of the Turkish governing process. Such a fusion has not happened elsewhere in the region. For instance in Iran the Shah tried to mimic the West without establishing a sustainable republicanism. The Shah’s brand of authoritarian rule undermined the moral and religious traditions that derive from the great Persian heritage in the course of embracing a form of modernity that privileged only a small internationalized Iranian elite while consigning the mass of Iranians to seemingly permanent squalor. In the process the Shah left nothing behind by way of constitutionalism on which to build a better Iranian future. Of course, significant blame for Iran’s trials and tribulations is deservedly given to the British/CIA interventions, especially covert moves in 1953 that helped overthrow Iran’s most encouraging democratic movement led by Mohammed Mossadegh, a passionate nationalist. This intervention led to restoring the Iranian monarchy, which established an oppressive police state with the help of its foreign friends. Mossadegh’s sin had been to challenge Western interests by claiming the right to pursue an independent foreign policy, especially through asserting Iranian sovereignty over natural resources by way of the nationalization of the Anglo-Iranian Oil Company. To understand the pattern of Western interventions in the Middle East, follow the oil! Consider in this regard, the current war talk directed at Iran, but also the recent destructive wars fought in Libya and Iraq.

The Iranian Revolution of 1978-79 spun out of this moral and spiritual vacuum that resulted from the Shah’s rule, but without having the benefit of a secular tradition that was both populist and principled. Unfortunately, the new Iran went on to reproduce in theocratic form many of the deformities of power that had precipitated the downfall of the Pahlevi monarchy despite its extensive apparatus of oppressive political rule and its unconditional support in Washington. Kissinger for good reason praised the Shah of Iran in his memoir “as that rarest of things, an unconditional ally.” The concrete embodiments of this submissive Iranian role meant selling oil to apartheid South Africa, as well as opening up its national oil fields to mainly American energy companies and allowing a huge U.S. military presence in the country that included surveillance operations carried out in the Soviet Union from bases in Iran. These comments on Iran are intended to point up how different has been the evolution of modern Turkey, and why someone of Davutoglu’s outlook could not possibly have risen to a position of influence in post-1979 Iran, and if somehow given such an opportunity, would likely have quickly lost the backing of the political leaders of the country, and been forced to return to the sidelines of power.

Before the Arab Spring

The relevance of this detour is to underscore the likely inadequacy of a foreign policy that is either cast adrift from the traditions of a society or that insists on embodying those traditions in a rigid form that is not flexible and normative (respectful of law and morality) enough to address effectively the complexities of the modern world. What Davutoglu possesses as a result of his extraordinary combination of religious devotion and cosmopolitan education is a sophisticated capacity to navigate the waters of global society without getting drawn into power games at home and abroad that are by their nature cut off from principle. In this respect, Davutoglu will never receive or wish for Kissinger’s compliment of being an unconditional ally. A principled ally must always retain the option to act independently, even oppositionally, as the occasion requires. In fact, Davutoglu has been chastised by Big Brother and his think tank minions for taking Turkey out of ‘its lane’ or chided for designing a foreign policy that was premised on the durability of the established order in the Middle East that existed in the region prior to Tahrir Square.  In this respect, Davutoglu was evidently taken as much by surprise as the rest of us by the awakenings throughout the Arab world of this year, not only by their abruptness but also by their originality.

Davutoglu has also been criticized for allowing the relationship with Israel to move from friendship to hostility. If this deterioration is looked upon objectively it becomes clear that Israel was not willing to accommodate the new Turkey that was not just another poodle in the White House kennel. What Turkey did under Davutoglu’s influence, including while he was advising rather than devising Turkish foreign policy included trying to have Hamas after its electoral victory in 2006 treated as a political actor rather than as an ostracized ‘terrorist’ organization, criticized the attacks of Gaza at the end of 2008, and allowed a Turkish NGO to have a prominent role in the Freedom Flotilla that was so crudely attacked by Israeli naval forces in May 31, 2010. This latter attack that resulted in the death of nine Turkish citizens represented a shockingly provocative set of moves by Israel that included executing several of the Turkish humanitarian activists. In response, Turkey sought an apology and some compensation for the families of these victims, but Israel has been unwilling to do either. If Israel were to be capable of pursuing its interests, no more than in the manner of prudent realists, it would seize the olive branch that Turkey has been dangling before its eyes.

To be on occasion controversial in geopolitical circles is almost inevitable whenever a non-Western government seeks to forge its own path, to make its formal political independence into a foundation for the exercise of existential sovereignty. If a Turkish foreign minister were never being criticized in either the West or East he would not be doing his job for Turkey or the world, and should be regarded as inconsequential.

Without entering into a detailed examination of Turkish foreign policy in the Davutoglu years, it is essential to draw a line distinguishing a ‘before’ and ‘after’ in relation to the Arab Spring. Before it was obviously economically beneficial and politically stabilizing to pursue engagement with all countries in the Middle East. Such engagement was premised also on the importance attached to mutual respect for sovereignty, and ultimately, for self-determination, and presupposed what almost all informed observers believed, that the regimes in power were there to stay for the foreseeable future. In this period of ‘zero problems of neighbors’ Turkey raised its foreign policy profile in a positive manner that probably also reflected the heightened difficulties and frustration for Turkey that seemed to negate their strenuous efforts to gain entry to the European Union. The result of these policies seemed to promise over time a mutually beneficial regionalism that also sought to minimize disruptive conflicts. In this regard Turkey made itself available to negotiate peace between Israel and Syria, encouraged peaceful resolution of the Israel/Palestine conflict, attempted to calm the buildup of war threats directed at Iran, and experimented with peace building initiatives to the Balkans and in the Caucasus. Each attempt seemed worthwhile even in retrospect, was done with tact, and produced an inevitable mixture of successes and failures, although overall the economic gains in trade and investment and the diplomatic gains in conflict resolution remain valuable.

After the Arab Spring

Then in January 2011 came the Jasmine Revolution in Tunisia and the effective challenge to the Mubarak autocracy in Egypt. These were remarkable uprisings with still indeterminate revolutionary possibilities, but also containing grave counterrevolutionary risks. What happened in Tunisia and Egypt began happening elsewhere to varying degrees with very different responses: the fires of populist discontent burned brightly in Yemen, Bahrain, and then Syria, Libya, and less so in Morocco and Jordan. Turkish reactions were measured, and Ankara initially used its diplomatic leverage to encourage compromises shaped to avoid bloodshed, especially in Libya and Syria, but as it became clear that the regimes would not accommodate democratic demands, Turkey shifted sides, openly aligning its interests and hopes with the popular struggles. More specifically, this even led to Turkish support for the UN mandated NATO intervention in Libya and increasingly confrontational relations with Syria. As Davutoglu explained when a government shoots and kills its own unarmed citizens so as to retain power, then Turkey will side with such an opposition. In effect, at such a point Turkey’s respect for self-determination shifts its locus from the government to the people.

In my judgment these Turkish realignments were entirely appropriate so long as they did not crossed the line of military intervention. In this regard, I would endorse the Turkish response to Syria while criticizing its support for NATO’s regime-changing military intervention in Libya. These ‘hard choices’ involve difficult decisions of policy in settings of extreme uncertainty as to the effects of deciding to intervene or not to intervene. Put differently, non-intervention can be a form of intervention in some settings, and there is no escaping from a responsibility to act. I would not agree with Davutoglu’s approach in every instance of Turkish foreign policy in the confusing and differentiated national unfoldings after the Arab Spring, but I would strongly affirm the consistency of his principled approach based on this dramatic recalibration of foreign policy tactics and goals in response to the regional turmoil that upset the earlier diplomatic calculus highlighting the benefits of stability and interaction.

 

The legal flaws of the Palmer Commission flotilla report

The latest United Nations report on last year’s lethal flotilla incident – in which nine people were killed and many injured by Israeli commandos on board a humanitarian ship bound for Gaza – was released at the beginning of September, and generated much controversy. On the one hand, the report makes clear that Israel’s use of force on board the Mavi Marmara and in the treatment of those detained on the ship was excessive and unreasonable. It acknowledges that forensic evidence indicates at least seven were shot in the head or chest, five of them at close range, and recognizes that Israel still refused to provide any accounting of how the nine people were killed. It calls on Tel Aviv to compensate the families of those killed, eight Turks and one American, and also those who were seriously injured during and after the incident, passengers roughed up while in Israeli custody and whose cameras, cell phones and other belongings were confiscated.

 

The unusually small inquiry panel itself lacked credibility. It was chaired by former New Zealand prime minister and international environment law expert Geoffrey Palmer. Astonishingly, the only other independent member was its vice-chair, the former president of Colombia. Alvaro Uribe’s notorious history as a human rights abuser who called human rights advocates such as Amnesty International “rats,” as well as his legacy of seeking out the closest possible ties to and defense of Israel while in office, make him wildly inappropriate for such an assignment. The panel was rounded out with two members appointed by Israel and Turkey, each of whom appended a partisan dissent to the report.

 

It is therefore particularly significant that the report, despite several notable shortcomings, still confirmed several longstanding criticisms of Israel’s policies, especially the habitual reliance on excessive and unreasonable force when dealing with Palestinian issues.
Overall, however, the report of the Palmer Commission is severely flawed from an international law perspective. The most significant finding of the report is its most dangerous and legally dubious: the conclusion that Israel’s blockade of Gaza, in effect since mid-2007, was somehow, despite being severely harmful to the 1.5 million Palestinians living in Gaza, a legitimate act of self-defense. The report gives considerable attention to the illegal rockets fired into Israel by Palestinian militants mainly associated with Hamas, and notes, appropriately, that “stopping these violent acts was a necessary step for Israel to take in order to protect its people.” But while that justifies protective action, it does not make the case for a valid claim of self-defense under international law.

The report ignores altogether the crucial fact that a unilateral ceasefire had been observed by Hamas ever since the end of the Gaza War in early 2009. An earlier joint Israeli-Palestinian ceasefire had been declared in July 2008, and had led to a virtual halt in rocket attacks until it was broken by Israel in November of that year, in a lethal assault on Gaza that led to a crumbling of the ceasefire and thereafter to Israel’s Operation Cast Lead on December 27, 2008. The Palmer report cannot be legally persuasive on the central issue of self-defense without addressing the relevance of these ceasefires that gave Israel a viable security alternative to blockade and force. The fact that the word “ceasefire” does not even appear in the 105-page document underscores why this report is so unconvincing except to Israel’s partisans.

Instead of trying diplomacy, which had shown itself effective, Israel relied on a naval blockade, which prevented every boat from reaching the Gaza Strip, establishing a military siege, cruelly confining all Gazans, children, women and men (more than 50 percent of Gaza’s population is below the age of 15) living under occupation in what amounts to an open-air prison. Such a blockade is a massive and sustained example of collective punishment, unequivocally prohibited by Article 33 of the Fourth Geneva Convention.

The main goal of the flotilla was to bring desperately needed humanitarian goods, primarily medical equipment, to Gaza’s hospitals and clinics. But a second important goal was to challenge the illegal blockade, end the siege, and protect the rights of the people of Gaza. According to the Universal Declaration of Human Rights, every human being has the right to freedom of movement both within and between all countries yet for more than four years Israel’s siege of Gaza has denied Gazans their right to leave this crowded, impoverished territory, and denied entry to foreign visitors and even to family members. With all land borders closed and the UN and neighboring states unwilling to do more than call repeatedly but futilely on Israel to fulfill its obligation toward an occupied people, the flotilla movement was a peaceful and powerful way to expose the criminality of the siege and blockade of Gaza.

 

We should not lose sight of the essential nature of the incident. Israel launched a naval attack in the middle of the night on a humanitarian flotilla in international waters, whose six ships had been publicly inspected by harbor and police officials in a number of European countries to ensure there were no weapons on board before heading into international waters and had been tracked from the time they left port. It was neither reasonable nor necessary to mount such an attack for the sake of Israeli security.

 

Allowing a naval blockade – which the Palmer Commission acknowledges to be an act of war – to be imposed by Israel against the helpless civilian population of Gaza and then accepted as ‘legal’ by the UN, it is a sad day for both the global rule of law and the well-being of some of the most vulnerable and abused people on the planet.

 

SOMALIA TRAGEDY, ISLAMIST EXTREMISTS AND CLIMATE CHANGE SKEPTICS

         The unfolding tragedy in East Africa is a dramatic indicator of what humanity as a whole can expect in the near future ‘if business as usual’ continues to be the phrase that most accurately expresses global climate change policy. The unwillingness of the developed countries to provide adequate humanitarian aid to the most vulnerable peoples in the world also helps explain this worsening regional tragedy has reached such dire extremes.

East Africa is currently suffering from its most severe drought in 60 years. According to UN estimates 12.4 million people are in immediate need of humanitarian assistance. 25% of Somalia’s 7.5 million people are currently displaced. Famine has spread to all parts of the Horn of Africa. As we write, 4.8 million Ethiopians, 3.7 million Somalis, and 3.7 million Kenyans are being catastrophically victimized.

Somalia has been hit worst of all countries in the region. An aggravating cause of the Somali crisis arises from the fact that much of the countryside is controlled by the Islamist Shabab movement that forbids most international aid agencies from entering territory controlled by its forces. More than 100,000 people have arrived in Mogadishu in the last two months in desperate search for food and subsistence, some by walking as much as 100 kilometers.

It is generally accepted that the larger continental expanse of sub-Saharan Africa is now the region of the world most negatively affected by global climate change, particularly by global warming. Such a generalization needs to be qualified as not all African countries are suffering from climate change to the same extent, the degree of impact from country to country reflecting varying conditions on the ground. Farms in moist or dry savannah are more sensitive to higher temperature and reduced rainfall than are farms in humid and forest areas. These latter areas may actually experience higher agricultural yields despite adverse climate change trends.

Drought is not a stranger to the peoples of East Africa. According to Klaus Toepfer, the former Executive Director of the United Nations Environment Program: “It is a natural climatic phenomenon. What has dramatically changed in recent decades is the ability of nature to supply essential services like water and moisture during hard times. This is because so much of nature’s water and rain supplying services have been damaged, destroyed or cleared. These facts are especially poignant when you factor in the impact of climate change which is triggering more extreme weather events like droughts.”  These remarks support our belief based on the evidence that climate change is a significant element of African humanitarian crises. Toepfer’s words also show us why human induced environmental damage further aggravates preexisting adverse environmental and economic conditions.

It is not possible to determine conclusively that the famine in Somalia is attributable to climate change alone or even predominantly, or is a result of the wider environmental context, as well as a belated consequence of colonial and post-colonial exploitations of Somali resources. A post-colonial example of this Western role in aggravating Somali misery involved the destruction of Somali coastal fisheries due to the activities of high technology distant fishing fleets that virtually rendered traditional Somali fishing obsolete.

Also contributing to Somalia’s downward spiral was illicit toxic dumping by global corporate interests. With no patrols along its shoreline after the collapse of government in 1991, Somalia coastal waters became a dumping area for the developed world’s toxic wastes resulting in severe damage to the fish stocks upon which the Somali fishing industry and population had so heavily depended. Westerner economic actors were desperate to discover places to escape from strict and expensive environmental regulations in their own countries that regulated the discharge of their industrial wastes. As a result, the lives and livelihoods of Somali fishermen along Somalia 3333-km coast were being seriously jeopardized.

 

It is tragic to realize that piracy has replaced fishing as the dominant coastal means of livelihood for these traditional Somali communities. This piracy has been criminalized, but without   account being taken of Western responsibility for depriving Somalia of a leading source of its food and in the process destroying employment opportunities in a previously vibrant commercial activity.

Taking advantage of this difficulty of connecting the dots of causation, the climate deniers are making the most of a highly selective use of meteorological statistics to insist that there is no occasion for special worry or measures in response to Somalia’s crisis. These problems should be interpreted as nothing more threatening than a routine phase of the African weather cycle that the region has been living with for centuries.

Climate change skeptics are not alone in their contentions, but have some unexpected allies. Somalia’s extremist Islamist group, allegedly linked to Al Qaida, Al Shabab, contends that the “drought is caused by Allah and people should pray for rain.” This evasion of problem-solving by reliance on a pre-modern religious mentality has become politically fashionable even in Western countries. Not long ago the governor of Oklahoma urged residents to pray for rain to end a state-wide drought and the Republican Party presidential hopeful, Rick Perry, preceded the recent announcement of his candidacy by holding a public prayer meeting. Another American presidential candidate, Michelle Bachmann, sounds remarkably similar to Al-Shabab militants when she warns that advocates of action to reduce greenhouse gasses are displacing the work of God.

In addition to its presumed distrust of foreign intrusions, Al-Shabab has a material reason for its belief that the Somali drought and famine were not a result of human behavior. A UN investigator, Matt Bryden, recently concluded that “Al-Shabab has evolved from a small, clandestine network into an formidable organization that generates tens of millions of dollars a year by organizing charcoal export to Gulf countries, especially Saudi Arabia, Oman and the United Arab Emirates.” Bryden suggests that the deforestation that has taken place in areas under the control of al-Shabab have probably contributed to the famine by their indiscriminate plunder of forest areas. It is well established that unregulated deforestation is responsible for reduced rainfall.

To be sure, Al-Shabab has its reasons for denying that the famine in Somalia is due to environmental damage, including the detrimental impacts of global warming. Perhaps, if its membership were more sophisticated about the nature of climate change, Al-Shabab would shift their argument, and blame the West, which can be presented as overwhelmingly responsible for the harmful impacts currently being felt in Africa due to almost two hundred years of industrialization with its accompaniment of unregulated greenhouse gas emissions. There is little serious dissent from the view that it is the engines of modernity that have led the climate change challenge to reach its present crisis proportions.

It seems likely that the leaders of Al-Shabab do not have the scientific background needed to appreciate the seriousness and nature of climate change as it bears on the future of Somalia. Their leaders do seem to operate themselves according to the major premise of capitalism, to wit, that selfish economic interests come before the wellbeing of people, even those starving to death. From such a perspective, the leadership of Al-Shabab rejects what must seem to them to be an unwarranted interference in the internal affairs of their country by the international community, plausibly fearing that their own political existence might be jeopardized under the pretext of carrying out ‘humanitarian’ operations under Western auspices. Recalling the disastrous effort of the Clinton presidency to impose a centralized governmental structure on Somalia in 1993, this suspicion about Western intentions seems reasonable, although tragically costly for the people on the ground daily suffering from inadequate supplies of affordable food.

In such a situation it is not surprising that many Somalis are blaming Al-Shabab for the severity and prolongation of the food shortage, which has weakened the movement’s political credibility with the populace. Islamists in Somalia themselves now seem deeply divided. Earlier Al-Shabab enjoyed considerable popular support during a period when chaotic conditions prevailed due to the absence of a competent  government. Prior to the onset of the current emergency in 2006, the majority of the Somali people longed most for an end to the lawlessness and rampant corruption that has paralyzed the country since the collapse of the Siad Barre regime in 1991, and saw Al-Shabab as offering this prospect.

For all these reasons, combined with the abject poverty of the country, Somalia has become the international poster child for failed states, environmental disaster, and human misery. This has also made Somalia seem to be one of the most dangerous countries in the world, both because of these extreme internal conditions and due to its appropriation as a base for international terrorism. Despite these perceptions, the Turkish Foreign Minister observed in relation to the Turkish Government’s state visit to the country in August of 2011 that “there is no reason that Somalia could not recover from its problems.”

Despite the crisis, the Turkish Prime Minister, Recep Tayyip Erdogan, took the highly unusual step of visiting Somalia in the company of several ministers in his cabinet, their families, and a group of Turkish business leaders. This was truly a dramatic initiative that contrasts with the approach taken toward Somalia in recent years by other governments. It a fact that despite its woes Somalia is one of the few countries in the world that no Western leader has dared to enter over the course of the last 20 years, presumably fearful of the chaos and unrest, as well as concerned by security threats posed by religious extremists, warlords, criminal gangs, and worried about the health risks associated with the uncontrolled presence of several lethal infectious diseases.

Against such a background, it is only natural to wonder ‘why’ Turkey has decided to take such an initiative at this time. Several important symbolic and functional reasons have been given by Turkish officials to explain the timing and purpose of this high profile diplomatic event situated outside of Turkey’s geographic orbit of normal diplomatic activity. “The purpose of the visit was first symbolic,” Erdogan declared. He went on to say “[t]here was a perception that nobody can go to Mogadishu; we try to destroy the perception. We came, many others can come.”

There is a second kind of explanation not far in the background. A few months ago Turkey hosted in Istanbul the Fourth United Nations Least Developed Countries (UN-LDC) Summit. Somalia may well be the most afflicted of the 48 LDCs, and so Turkey singling the country out in this way to call attention to its broader concern with world poverty. After all, the LDC summit was held under Turkish auspices because Ankara had expressed a willingness to take on the responsibility for shaping UN policy towards these ‘poorest of the poor’ during the next 10 years. In view of this initiative it would have been difficult for the Turkish government to close its eyes to the desperate situation in Somalia. Such a show of indifference would also have seemed incompatible with its professed desire to do everything possible to help address the challenges faced by the LDCs.

Thirdly, as a devout Muslim, Prime Minister Erdogan was undoubtedly moved by the ordeal confronting the Muslim community in Somalia during the holy month of Ramadan. As all Muslims are deeply aware, this is a time when religious devotion encourages generosity to others less fortunate. The Somalia case presents a compelling opportunity for Erdogan and associates to fulfill their religious duties during Ramadan.

It is also relevant to observe that shortly before the Somalia visit, Turkey hosted a major meeting of the Organization of Islamic Cooperation (OIC) at which $500 million was set as a goal pledged by the assembled government to assist drought and famine stricken Somalis. The Turkish government is additionally sponsoring a national campaign for Somali emergency relief that is seeking to raise an additional $250 million in funds from private Turkish donors.

In the course of an impassioned speech to Muslim leaders during the OIC meeting, Erdogan provocatively called negative attention to the luxurious life styles of the leaders of oil rich countries. Some commentators interpreted these remarks as an attack on capitalism, but it is more reasonably understood as a warning and diatribe against the excesses of some capitalists! And the importance of acting responsibly toward those who are less fortunate.

We need remind ourselves that Turkey has done very well in the Erdogan period of leadership by adhering to economic policies based on free market principles. Erdogan and the AKP are far from the orientation of such avowedly anti-capitalist leaders as Hector Chavez or the Castro brothers. Yet his ideological affinities with capitalism does not mean that Erdogan is not responsive to the social principles of Islam, or that he is being inconsistent when he calls for what used to be promoted by Western leaders under the banner of ‘compassionate capitalism.’  In some speeches to Turkish audiences Erdogan does not hesitate to use language that incorporates Islamic thought, which probably comes very naturally to him when he speaks, as he often does, spontaneously, and without a prepared text. This Muslim influence or style of advocacy was not common in Turkey during the Kemalist years when strictly secular politicians were running the country, and it remains somewhat unfamiliar to those Turks whose identity is derived from European models.

Erdogan also does not hesitate to criticize the West. While in Somalia, he said: “The tragedy in Somalia is testing modern values. What we want to emphasize is that the contemporary world should successfully pass this test to prove that Western values are not hollow rhetoric.” Such a direct challenge seems warranted when the leading Western countries have turned increasingly away from the humanitarian emergency conditions affecting not only Somalia, but all the LDCs. Also neglected by the affluent societies are the large enclaves of extreme poverty in a variety of countries that have relatively high average per capita incomes, but skewed income distribution patterns favoring the ultra-rich and containing deep pockets of extreme poverty.

We can affirm the Turkish initiative associated with the recent visit to Somalia as an imaginative and brave step to mobilize public concern throughout the world. The real test of its worth comes during the years ahead when Turkey and AKP will be under self-imposed pressures to take the lead in tangibly exhibiting empathy for the most deprived segments of humanity along with displaying an increased sensitivity to the seriousness of the climate change dimensions of these economic conditions.  Of course, this Turkish role should not be interpreted as offering a free ride to other countries, including those in Europe, North America, and Asia. The governments of these countries have the resources and responsibilities to act as world citizens in an era of ever increasing globalization both in relation to pursuing economic policies that could dramatically reduce world poverty and taking on climate change for which their past and present activities are primarily responsible.

Turkey, the Region, and the West after the Elections

             There has been a dramatic shift in critical international responses to the current Turkish political leadership that has been recently highlighted by reactions to the resounding AKP electoral victory of June 12th. The earlier mantra of concern was expressed as variations on the theme that Turkey was at risk of becoming ‘a second Iran,’ that is, an anti-democratic theocratic state in which sharia law would dominate. Such a discrediting approach has itself been discredited to the extent that it is all but abandoned in serious discussions of the Turkish governing process.

 

            The new mantra of criticism is focused on the alleged authoritarian goals of the Prime Minister Recip Tayyip Erdogan. He is widely accused of seeking to shift the whole constitutional order of Turkey from a parliamentary to a presidential system, and coupled with a little disguised scheme to become Turkey’s first president under the new constitution, and then look forward to being reelected the leader of the country for a second five year term. Some of these anxieties have receded since the AKP did not win the needed 2/3s majority in the parliament that would have enabled a new constitution to be adopted without needing to gain the consent of the citizenry through a referendum. In his victory speech on the night of the elections Erdogan went out of his way to reassure Turkish society, including those who voted against the AKP, that he will heed the message of the voters by seeking the widest possible participation in the constitution-making process with the aim of producing a consensus document that will satisfy a wide spectrum of Turks. It might be expected that such a process would likely preclude any shift to a presidential system, and would certainly make politically impossible the adoption of the strong French version, which does give a president extraordinary powers.

 

            From outside of Turkey the new line of criticism seems to reflect American and Israeli priorities and perspectives, and is not too closely related to Turkish realities. The tone and substance of this line was epitomized by a lead NY Times editorial published the day after the Turkish elections. After acknowledging some AKP achievements, including giving it credit for the flourishing Turkish economy and a successful reining in of the deep state, the editorial moved on to criticize “Mr. Edgogan’s increasingly confrontational foreign policies, which may play well at the polls, but they have proved costly for the country’s interests.” Such a comment by the supposedly authoritative and balanced NY Times is quite extraordinary for its display of ignorance and slyly disguised bias. After all, the hallmark of Turkish foreign policy during the Erdogan years, as developed under the inspired diplomatic leadership of the Foreign Minister, Ahmet Davutoglu, has been ‘zero problems with neighbors’ as manifest in a series of conflict-resolving and reconciling diplomatic initiatives, and a broad conception of neighbor to include the Balkans, Central Asia, and the Caucuses, as well as the entire Arab world. It is possible to argue that this direction of non-confrontational foreign policy went too far in some instances, most notably Syria, and possibly Libya, and as a result have generated some serious challenges for Turkey.

 

            The only exception to this pattern of zero problems has been Israel, but here the NY Times once again displays an uniformed and opinionated outlook when it writes “Once-constructive relations with Israel have yielded to tit-for-tat  provocations and, if they continue, could threaten Turkey’s substantial trade with Israel.” It would be hard to compose a more misleading description of the deterioration of Turkish/Israeli relations. It should be remembered that prior to the Israeli attack on Gaza at the end of 2008, Turkey was doing its best to promote peace between Israel and Syria by acting as an intermediary, a role at the time appreciated by both parties. It is also quite outrageous to speak of “tit-for-tat provocations” when it was Israeli commandos that boarded in international waters a Turkish ship, Mavi Marmara, carrying humanitarian goods for the long blockaded people of Gaza, and killed in cold blood nine Turkish citizens. Even here in responding to Israeli unlawfulness in this Flotilla Incident of May 31, 2010, Turkey has subsequently tried its best to calm the waters, asking Tel Aviv only for an apology and compensation paid to the families of the victims, as preconditions for the restoration of normal relations with Israel. It has been Israel that has up to now defiantly refused to make even these minimal gestures in the interest of reconciliation.  And recently Davutoglu has gone further, perhaps too far, in his dedication to peaceful relations by openly discouraging Turkish participation in plans for a second Freedom Flotilla at the end of June, asking activists to wait to see if the blockade is broken due to changes in the Egyptian approach at the Rafah Crossing. The latest indications are that the Mavi Marmara will join the second freedom flotilla.

 

            The NY Times goes even further in its Orientalist approach to Turkey, writing that “Ankara must discourage private Turkish groups from initiating a second blockade-running Gaza flotilla..” Why must it? Is it not the blockade, approaching its fourth anniversary, that is widely condemned as cruel and unlawful, a flagrant violation of the legal prohibition on collective punishment set forth in Article 33 of the Fourth Geneva Convention? Should not putting such a demand to Turkey at least be balanced by a call on Israel to end the blockade? Given the failure of the UN or neighboring governments to protect the people of Gaza, should not members of civil society feel a duty to do so, and in democratic societies should not be hampered by their governments?

 

            The other foreign policy complaint in the Times’s editorial on Turkey deals with Iran. Here, of course echoing complaints from Washington as well as Tel Aviv, Turkey is blamed for playing “cozy games with Iran” that have “only encouraged Iran’s nuclear ambitions.” Perhaps wrongheaded, but hardly an example of Erdogan’s allegedly confrontational style! What NY Times obviously favors, not surprisingly, is confrontation, urging the Turkish government to “press Turkish companies and banks to enforce international sanctions against Iran.” What is at stake here is the foreign policy independence of Turkey. Its efforts to find a peaceful resolution of the dispute surrounding Iran’s nuclear program are clearly designed to lessen the tensions surrounding the present coercive diplomacy of the U.S. led coalition, and backed by the UN, that is based on sanctions and military threats. It is in Turkey’s clear national interest to avoid a military encounter that could eventuate in a damaging regional war that would be disastrous for Turkey, as well as dashing the hopes raised by the Arab Spring, while also using its diplomatic leverage to discourage Iran from developing nuclear weapons, thereby producing an exceedingly dangerous situation for itself and others.

 

            Another Western criticism of the Erdogan’s approach is to blame Turkey for a diminishing prospect of accession to membership in the European Union. The Financial Times in their far more reasonable post-election editorial nevertheless appears to blame Turkey for “strained relations with the EU.” On what basis is not disclosed. What was not even discussed, but should be mentioned as the main explanation of the strained relations, is the rise of Islamophobia throughout Europe and reflected in public attitudes of governmental skepticism in Paris and Berlin, as well as elsewhere on the continent, about whether Turkey is a suitable candidate for membership, given its large Muslim population. It needs to be appreciated that Islamophobia in Europe while resurgent is not new. Recently, it had been associated with Turkophobia, in reaction to the Turkish guest workers that stayed on, and became a strong presence, often unwanted, in Germany. In the two earlier centuries prior to the 20th there existed European fear and loathing of an invading Ottoman Empire, and even earlier, of course, The Crusades with their marauding militarism.

 

            What emerges overall is this American led reluctance to accept Turkey as an independent regional force in the Middle East that has achieved enormous influence in recent years by relying on its own brand of soft power diplomacy. A dramatic indicator of this influence is the great popularity of Erdogan throughout the region, including among the youth who brought about the uprisings against authoritarian rule throughout the Arab world. It is an encouraging sign of the times that these new Arab champions of democracy are coming to Ankara and Istanbul, not Washington, Tel Aviv, or Paris, for guidance and inspiration.  Whether through the NATO intervention in Libya or the crude efforts to intimidate Iran, the West under faltering American leadership remains addicted to hard power statecraft, which no longer achieves its goals, although it continues to cause great suffering on the ground. It is time that the West stops lecturing Turkey, and starts to learn better what succeeds and what fails in 21st century foreign policy. A good place to start learning and listening might be Ankara!

Interpreting the AKP Victory in Turkey

            The following post was written jointly with Hilal Elver, who is a Turkish scholar and public intellectual. It offers commentary on the recent AKP victory, which is viewed as a significant and hopeful development in Turkish, and regional, politics. The map above shows the electoral results by reference to party affiliation and place. Orange on the map indicates areas won by the AKP, red by the CHP, White designates areas where independent candidates representing Kurdish minorities were victorious.

            It is the first time since the founding of the republic by Kemal Ataturk that such widespread international interest was aroused by Turkey’s June 12th elections. Naturally it is a time for celebration by the AKP in view of its landslide victory, a vindication of its overall economic and political approach over the past nine years. It is also an endorsement of its creative foreign policy that had given Turkey such a prominent place on regional and global diplomatic maps for the first time in its republican history.

 

            This afterglow of electoral victory should not obscure the challenges that lie ahead for the AKP. The most important of these involve finally providing the large Kurdish minority with secure cultural and political rights that to be trusted, would need to be vested in a new constitution. There is wide agreement in Turkey that the existing 1982 constitution, reflecting the approach taken by oppressive leaders of a military coup, needs to be replaced, but there are serious divisions among Turks with respect to the substantive content of such a new constitution. The secular opposition, as represented by the CHP, remains particularly worried about an alleged danger of the Putinization of the Turkish government if a switch is made from a parliamentary to a presidential system. More concretely, the AKP opposition believes that Recep Tayyip Erdogan’s harbors authoritarian dreams that could be fulfilled if Turkey were to follow the French presidential model.

 

Yet there should be less worry for two main reasons. Firstly, the AKP while winning 325 seats in parliament fell well short of securing the 367 seats needed for the parliamentary supermajorities that would have allowed it to decide on its own the contents of a new constitution or even of the 330 seats necessary for it to be able to write a constitution that would become the law of the land after it received approval in a national referendum. Without this degree of parliamentary control, the AKP will not be able to produce a constitution without the cooperation of the other parties represented in the parliament, especially the CHP, and that bodes well, particularly if the opposition acts responsibly by offering constructive cooperation.

 

And secondly, Erdogan in his victory speech went out of his way to reassure the country that constitutional reform would be a consensual process protective of diverse life styles and framed so as to achieve acceptance and justice for the entire society. At the moment of victory Erdogan seemed unexpectedly sensitive to criticism of his supposedly arrogant political style, and took the high road of moderation and humility. He seemed intent on convincing the Turkish public as a whole that he respected the secular principles that had dominated political life since the time of Ataturk, and that the country would become more pluralistic than ever in an atmosphere of mutual respect.

 

            It is not just Turks who should welcome this AKP victory. The electoral outcome provides the Middle East with an extremely positive example of dynamic democracy at a time of unresolved internal struggles throughout the region. The steady and helpful diplomatic hand of Turkey offers an attractive alternative to anxieties and memories associated with American and European interventions and alignments in the region. Turkey is a vibrant society with a flourishing economy that has managed to follow a democratic path to political stability and an independent course in foreign policy, and that offers an inspiring example for others to follow according to their various national circumstances.

 

            There are many uncertainties that cloud prospects for the future. Turkey faces the consequences of an unresolved bloody conflict in neighboring Syria, including the challenge of managing a massive inflow of refugees fleeing the killing fields. There are also the risks of an escalated confrontation with Iran arising from the Israel/United States hard power response to Iran’s nuclear program. This could ignite a war that engulfs the entire region with a variety of disastrous effects. In addition, the tense relations between Ankara and Tel Aviv are likely to be further stressed in coming weeks as preparation for a Second Freedom Flotilla go forward.

 

            Yet the sun shines brighter on the morning after these Turkish elections. Voters have affirmed an approach to Turkey’s internal and international policies premised on an inclusive approach to peace, justice, and rights. To build on this mandate, and to do so in a manner that is convincing to the majority of Turkish citizens, will create progress in the country and hope for the region. There will be mistakes and setbacks, but the orientation and vision of the AKP leadership is one of the most encouraging political developments of this still young 21st century. 

 

            The Prime Minister’s victory address from the balcony of AKP headquarters, what he calls a “mentorship speech” was the culmination of the long and steady rise of the AKP over the past decade– from 34% of the vote in 2002 to 47% in 2007, and now almost 50% in 2011. With some irony, this latest result did not give the AKP more seats in the Parliament due to recent changes in the electoral system of representation that had been decreed by the Higher Election Board, a part of the state bureaucracy known to be hostile to the AKP. While this restructuring that had hardly been noticed when it took place, hurt the AKP (326 rather than 341), while it helped to the CHP (rising from 112 to 135), and the BDP (Peace and Democracy Party) that helped elect Kurdish independent candidates. As well, the rightest party, National Movement Party (MHP), cleared the 10% threshold, winning 13% of the vote, which produces 53 seats in the new parliament.

 

            The Prime Minister interpreted these results sympathetically, telling the public that he heard the voice of people as demanding consensus rather than a bestowal of unitary power on one party. In his words: “Our nation assigned us to draft a new constitution. They gave us a message to build the new constitution through consensus and negotiation..We will seek the broadest consensus.” The word ‘compromise’ was mentioned three times in the speech.

 

 Erdogan also tried to calm the political waters roiled by inflamed campaign rhetoric when he declared that “[i]ncendiary speeches given during the campaign should be forgotten.” This is an encouraging start for the next phase in the process of constructing a democracy that responds to the realities of the dive rse peoples living in Turkey. At one point he promised that the constitution “will address everybody’s demands for freedom, democracy, peace and justice, and each identity and each value.” It is the last phrase that is most relevant as an indication of a resolve to move beyond the unitary ideas of Kemalist Turkey that still animate the ultra-nationalist MHP that during the election campaign reaffirmed its unshakeable belief in “one identity (Turk), one state (Turkey), and one language (Turkish).” Such a rigid position seems impossible to reconcile with the Erdogan consensus approach that was explicitly directed at the quest for distinct cultural and political rights by a series of Turkish minorities, most significantly, the Kurds. Also mentioned by Erdogan were Arabs, Circassians, Georgians, Roma, Alevis, and Laz. The Prime Minister insisted that hereafter “all citizens will be first class,” which seemed to be making an historic commitment to equality between Turks and non-Turks in all phases of national life.

 

There are additional hopeful signs for Turkey’s future. 78 women were elected to the parliament, significantly more than ever before. Perhaps, finally, the headscarf issue will be resolved in the direction of freedom of religion and the rights of women. Turkish religiously observant Muslim women have suffered the punitive effects of the headscarf ban in public sector activities, including institutions of higher learning, for far too long. The discriminatory nature of the current policy is dramatized by the unassailed freedom of the AKP men who lead the government despite being as religiously observant as their wives.

 

Moreover, this parliament will be robustly diverse because of the many new faces, including the former left student leader who spent many years in jail( Ertugrul Kurkcu), several CHP members who are in prison, being accused of anti-state activity in the Ergenekon case, and Leyla Zana, the internationally known Kurdish parliamentarian who was originally elected in 1991 and arrived in Parliament wearing a Kurdish flag bandana and refusing to take an oath of loyalty to the Turkish state. After many years, some of them in jail, Zana is again in parliament. A few days ago on TV she joked: “Perhaps this time I will come with a headscarf,” implying that the individual rights of everyone should be protected, and those who wear headscarves should not be excluded.

 

As the most popular and admired leader in the region, Erdogan did not forget to send a message to peoples of the Middle East, mentioning several cities and countries by name, including places in occupied Palestine, suggesting rather dramatically that these places will be considered under the same banner of concern as Turkish cities. In a rhetorical flourish Erdogan insisted that the outcome of the elections in Turkey was a victory “for Bosnia as much as Istanbul, Beirut as much as Izmir, Damascus as much as Ankara.” While somewhat hyperbolic, such a display of internationalism was new in Turkish politics, and signifies the rise of Turkey as a diplomatic force beyond its borders.

 

            Erdogan somewhat unexpectedly also recalled a dark episode in Turkey’s past, specifically what happened in 1960 when a military coup not only ousted a democratically elected government headed by the Democratic Party, but executed three of its political leaders, including the Prime Minister, Adnan Menderes, because it dared to challenge the supremacy of the military by reducing its budget.  As with the AKP, the Menderes leadership had governed Turkey for three consecutive terms, winning elections by overwhelming majorities. Erdogan was conveying his sense that the struggle to achieve Turkish democracy was long and painful.  He was also indirectly reminding his audience that the ‘deep state’ was no longer in a position to frustrate the will of the people. All in all, the message was upbeat as befits an electoral victory of this magnitude.

 

            A final observation takes note that June 12 was also the day on which Iranian elections were held two years ago. What is so startling is the contrast between the joyful expectations of the majority of the Turkish people after the electoral results were announced as compared to the anger and despair of the Iranian majority who believed for good reason that the regime in Tehran had fraudulently deprived them of an electoral victory. This difference between a governing process that periodically legitimates itself through free and fair multi-party elections and a governing process that lacks the consent of the public and must rule by fear and force may be the most basic fault line in domestic politics, and serves as the litmus test of the Arab Spring in the near future.
