Peace and Justice for the Palestinian People: a conversation

 

Khourosh Ziabari: Humanitarian crisis in Gaza has entered its 11th year as the crippling siege by Israel is making the living conditions of Palestinians more complicated with time. The blockade in what is popularly referred to as the world’s “largest open-air prison” means growing unemployment, people having intermittent access to pure water, the economy is almost dysfunctional and poor infrastructure and lack of funding make the two-million population vulnerable to heavy rains and extreme weather. The former United Nations Special Rapporteur on the Situation of Human Rights in the Palestinian Territories believes Israel is not doing enough to make the living conditions of Gaza Palestinians better, and the United States is also failing to play a constructive role.

 

Richard Falk is a professor emeritus of international law at Princeton University, who has published and co-edited some 40 books on human rights, international humanitarian law and the Israeli-Palestinian conflict.

In an interview with the Organization for Defending Victims of Violence, Prof Falk shared his views on the recent controversy surrounding President Trump’s proposal to move the U.S. Embassy to Jerusalem and the ongoing humanitarian emergency in the Palestinian territories.

 

Q: In a piece recently published on Foreign Policy Journal, you talked of Palestine as being a hugely discriminated against nation, which in the recent decades has undergone major hardships due to the inability or reluctance of the United Nations to take steps to balance the needs of the Palestinian people against the political leverage of Israel and its allies. The improvement of the living conditions of the Palestinians depends on a logical and justifiable way out being found to end the conflict. Is the international community really unable to come up with a sustainable and all-encompassing solution?

 

A: The failure of the international community with respect to the Palestinian people and their legitimate grievances is due to several special circumstances; most importantly, the underlying determination of the Zionist movement to control most of Palestine as delimited by the British mandate. In this respect, assertions by Israeli leaders of their desire for a political compromise should never been accepted at face value, and are patently insincere, public relations gestures seeking to influence international public opinion, and convey the false impression that Israel is seeking a political compromise with Palestine.

 

Secondly, this Zionist ambition is now strongly supported by the United States despite not being clearly articulated by the government of Israel. This obscurity, essentially a deception, allows the international community to act as if a peace process is capable of producing a solution for the conflict even though Israel’s actions on the ground point ever more clearly toward an imposed unilateral outcome, which essentially is a unilateral insistence that the conflict has been resolved in favor of Israel.

 

Thirdly, the ‘special relationship’ between Israel and the U.S. translates into a geopolitical protection arrangement encompassing security issues and even extending to insulating Israel from censure at the UN, especially by the Security Council, and making sanctions impossible to impose. In such a setting, the Israelis are able to pursue their goals, while ignoring Palestinian grievances, which results in tragedy and suffering for the Palestinian people. Given the balance of forces, there is no end in sight that might end the conflict in a fair way.

 

Q: President Donald Trump’s recognition of Jerusalem as the capital of Israel and his plan to move the U.S. embassy to this city met a big resistance at the United Nations, both on the General Assembly and Security Council levels. Why do you think the international community and even the major U.S. allies didn’t say yes to this proposal?

 

A: Trump’s initiative on Jerusalem ruptured whatever fragile basis existed for seeking a diplomatic solution for relations between Israel and Palestine. There had been a clear understanding, respected by prior American leaders, that the disposition of Jerusalem was a matter that was to be settled only through negotiations between the parties. This understanding was broken by the Trump initiative for no apparent reasons beyond pleasing Netanyahu and some wealthy Zionist donors in the U.S. Beyond this, for Trump to side with Israel on such a sensitive issue, which deeply matters symbolically and substantively, not only for Palestinians, but for Muslims everywhere, and even for Christians, damaged beyond repair the credibility of the United States to act an acceptable intermediary in any future peace process.

 

American credibility was at a low level anyway, but this latest step relating to Jerusalem, removed, at least for the foreseeable future, any doubt about the American partisan approach, and more dramatically, made it evident that diplomacy based on the two-state solution had reached a point of no return.

 

In one respect, the Trump move on Jerusalem lifted the scales from the eyes of the world. It should have been clear for some years that the size of the settlement phenomenon and the influence of the settlers, now numbering about 800,000, had made it impractical to contemplate the establishment of a genuinely independent and viable Palestinian state. As well, the U.S. had long ceased to be an honest broker in the diplomatic settings that were described by reference to ‘the peace process,’ and probably never was partisan from the outset of the international search for an outcome that was a genuine political compromise. If there is to be an effective diplomacy with respect to the relations between the two peoples, it must, in any event, be preceded by dismantling the apartheid structures that were developed by Israel over the decades to subjugate the Palestinian people as a whole and the United States must be replaced by a credible third party intermediary. Israel feels no pressure to accept such changes, and so there is no current alternative to exerting pressure on this untenable status quo through support for militant nonviolent forms of Palestinian resistance and the global solidarity movement, with a special recognition of the contributions of the BDS campaign. It may be relevant to note that the BDS Campaign has been nominated to receive the Nobel Peace Prize in 2018.

 

Q: In the recent years, many resolutions and statements have been issued in condemnation of the expansion of Israel’s settlements in the Palestinian territories occupied following the Six-Day War in 1967 by the UN General Assembly and its affiliated human rights bodies. Even the UNSC Resolution 2334 (2016) declares Israel’s settlement activity a “flagrant violation” of international law. Is the publication of statements and condemning a state, while the state itself doesn’t recognize the demands and considers them invalid, a viable solution? If the international community is convinced that Israel should stop the illegal settlements, then how is it possible to make it happen?

 

A: The continued expansion of the settlements despite their flagrant violation of Article 49(6) of the Fourth Geneva Convention is both an expression of Israel’s contempt for international law and for world public opinion. It also reveals the impotence of the UN to do anything effective to impose its will that is any more consequential than the issuance of complaints. When geopolitical realities shield the behavior of a state from international pressures, the UN is helpless to implement its resolutions, and international law is put to one side. The UN is an organization of states, and limited in its capacity to shape behavior, especially by the veto power of the five permanent members of the Security Council. As such, the UN was never expected to have the constitutional capacity to overcome the strongly held views and commitments of the five states given permanent membership and the right of veto in the Security Council in the UN Charter. The Security Council is the only organ of the UN System with clear authority to reach and implement decisions, as distinct from advisory opinions and recommendations. The Israel/Palestine conflict is an extreme version of the Faustian Bargain struck between the geopolitical power structure and global justice, which was written into the UN Charter and the constitutional framework of the UN, as well as exhibited in UN practice over the years.

 

Q: News reports and figures show that the living standards and the economic conditions in the Gaza Strip are getting worse as time goes by. The unemployment rate has climbed to 46%. Research organizations and local media say 65% of the population is grappling with poverty and the food insecurity rate is roughly 50%. How do you think the perturbing humanitarian crisis in Gaza can be alleviated?

 

A: It is difficult to comprehend accurately the Israeli approach to Gaza as its motivations are very different from its stated justifications. Israeli policy often appears cruel and vindictive, with security rationales sounding more like pretexts than explanations. Excessive force has been repeatedly used by Israel in Gaza, and little effort to achieve some kind of tolerable stability has been made.

 

Israel has rejected a series of proposals for long-term ceasefires put forward by Hamas during the past decade. Israel has periodically attacked Gaza, inflicting heavy damage on a helpless and impoverished civilian society in 2008-09, 2012, and 2014 while the international community condemned these excessive uses of force. Now that the economic squeeze is pushing Gaza once again toward the brink of a humanitarian disaster the ordeal of the nearly two million Palestinians entrapped and utterly vulnerable. The situation in Gaza is once again a matter of grave concern, with humanitarian alarms being sounded by those with knowledge of the precarious health and subsistence crisis facing the population.

 

It is unclear what Israel actually wants to have happen in Gaza. Unlike the West Bank and Jerusalem, Gaza is not part of the Zionist territorial game plan, and is not considered part of biblical Israel. To the extent that Israel is pursuing a one-state solution imposed on the Palestinians, Gaza would be likely excluded as adding its population to that of Israel would risk exploding ‘the demographic bomb’ that has for so long worried Israelis because of endangering the artificially generated Jewish majority population, and supposed ‘democratic’ control of this ethnocratic polity.

 

The Zionist project has long resorted to extreme measures to achieve and then sustain the democratic pretension of its governing process, initially dispossessing as many as 700,000 Palestinians from the territory that became Israel in 1948. This coerced dispossession during combat was combined with a post-conflict refusal to allow those who left their homes and villages during wartime any right of return. Such ethnic cleansing was reinforce by completely destroying hundreds of Palestinian villages with bulldozers. This pattern of controlling the population ratio between Jews and non-Jews has been a persistent issue ever since the Balfour Declaration was issued in 1917 when the Jewish population of Palestine was about 5%. In the early period, the Zionist effort was focused on overcoming the Jewish demographic minority status by stimulating and subsidizing Jewish immigration. Yet even after the surge in immigration prompted by the rise of Nazism and European anti-Semitism, the Jewish population of Palestine was only about 30% at the start of the 1947-48 War.

 

Israel would probably like to have Gaza disappear. If that is not going to happen, then the second best solution is to entrust Jordan or Egypt with administrative control, security responsibility, and sovereign authority. So far neither Arab government wants to assume control over Gaza. With these considerations in mind, Israel seems determined to maintain instense pressure on Gaza, allowing the population to hover around the subsistence threshold, and to signal Israeli aggressiveness to the rest of the region, asserting a military presence from time to time that seems both punitive and designed to remind Gazans that resistance on their part would be met with overwhelming lethal force causing devastation and heavy casualties, including imposing a condition of enduring despair on the civilian population.

 

 

 

Why the United Nations Matters (even for the Palestinians)

There are many reasons for persons with very different worldviews to feel disillusioned by, if not angry at, the United Nations. These negative feelings arise usually because the UN stands idly by the sidelines while terrible national and human tragedies unfold as the world media visually narrates horrific events in real time. At other times the hostile feelings toward the UN arise because the Organization is seen as a plaything of geopolitics, as bowing to crude leverage wielded by major funding governments, and in the process violating the letter and spirit of the UN Charter. Such behavior undermines the UN’s constitutional foundations and casts doubt on the central claim that the Organization is dedicated to the cause of war prevention.

 

No people have more reason to be disappointed with the UN, international law, and the precepts of international morality than do the people of Palestine. From the moment the UN was established up until the present moment, the Palestinians have been victimized either by the use of the UN to pursue geopolitical goals or by the inability of the UN to implement its own decisions and assessments that are responsive to Palestinian grievances or supportive of Palestinian aspirations.

 

Obviously, there is present a world order puzzle that needs solving. Many believe, especially here in the United States, that it is Israel that is the victim of UN bashing and bias, being singled out at the UN for continuous censure and criticism, and it is the Palestinians that have over the years received aid and comfort in the halls of the UN for their contentions, however inflammatory. For our dualistic Western minds, incapable of reconciling opposites, something must be wrong. It seems impossible for both the Palestinians and Israelis to be both victimized at the UN.

 

Yet this is precisely the case. The Palestinians are victimized because the UN doesn’t mean what is says, at least not on the plane of action. The UN gives the Palestinians the pabulum of words, while refraining from the reality of deeds, which over time gives rise to resentment and cynicism summarized by the sentiment: ‘what good are words, if nothing happens, and the situation on the ground even deteriorates.

 

At the same time, partly in reaction to this sense of impotence when it comes to imposing its views effectively on behavior, the UN slaps, sometimes strongly, the defiant Israelis. And the Israelis, never above playing the anti-Semitic card, keep telling the world that they are singled out for bashing even though their wrongs are far less bad than that of others. Of course, never far in the background is the weight of geopolitics, with the United States wielding a punitive stick on Israel’s behalf.

 

History needs to be taken into account in sifting through the complexities of argument and counter-argument carried on now for decades about the performance of the UN in relation to Palestinians and Israelis. With respect to the geopolitical explanation of Palestinian disillusionment, the UN already in 1946 accepted the responsibility to supersede the United Kingdom, which had been administering Palestine on behalf of the international community since the fall of the Ottoman Empire after World War I., in working out a solution on behalf of the two peoples. Yet instead of consulting the resident population of Palestine on its wishes with respect to the implementation of the right of self-determination, the UN on its own initiative proposed an Orientalizing solution that gave Israel 55% of Palestine despite less than 33% of the population being Jewish. This demographic disparity existed despite several decades of Jewish immigration spurred by energetic Zionist efforts around the world as well as by the British, eager for strategic reasons of their own to carry out the Balfour pledge of 1917. Jewish immigration was also greatly encouraged by the rise of Nazism, which intensified the search for a sanctuary that could protect Jews, especially those fleeing Hitler’s Germany.

 

Then to compound this imposition of a settler colonialist outcome, repugnant from the outset to the majority Arab population, the UN proceeded in 1948 to accept Israel as a member of the UN without first making obligatory provision to ensure an equitable future for the Palestinian people. This flawed UN response to the end of the British mandate has been compounded by years of Israeli expansionism, especially since 1967. Such an internationally tilted outcome reflected intense liberal guilt toward Jews in the aftermath of the Holocaust combined with the skill and tactics of the Zionist movement in influencing the Jewish diaspora as well as government policy in Europe and North America. It was an early demonstration of geopolitics triumphing over international law and global justice within the UN. It should not be forgotten that the UN was established in ways that gave leading states a geopolitical comfort zone, more familiarly known as ‘the veto,’ a blunt instrument for opting out of responsibilities, and useful to protect friends and batter enemies.

 

Turning to the impotence of the UN when it comes to its resolutions and decisions that encounter geopolitical resistance, the pattern has been evident all along. After the outcome of the 1967 War, the international community by way of the UN acquiesced with hardly a whimper to the extension of Israeli territorial claims from 55% to 78% of mandate Palestine. Ever since, this enlargement of Israeli territorial expectations has formed the basis for the two-state consensus, and was even accepted by the Palestinians as the realistic territorial baseline for a compromise solution.

 

Beyond this central issue of territorial allocation, the UN General Assembly affirmed the right of return of Palestinians forced to leave their homes in the 1947-48 War in General Assembly Resolution 194, and a second wave dispossessed in the 1967 War. The resolution has been pointedly rejected by Israel without any adverse consequences.

 

In similar fashion, the expansion and annexation of Jerusalem has been strongly condemned, most canonically, by the UN Security Council in Resolution 478 (1980), a unanimous vote except for the U.S. abstention. Finally, despite this, and the periodic Security Council denunciations of Israeli settlements on occupied Palestine territory, Israel has continued year upon year to build and increase the settler population. Against this background, it is to be expected that the Palestinians feel that having their rights affirmed at the UN is a worthless exercise, if not a feeble way to obscure UN impotence, given that the Palestinian ordeal has worsened year after year, decade after decade.

 

And yet despite all this the Jerusalem resolution of last December (passed by a vote of 128-9 with 35 abstentions and 21 absences) repudiating the Trump initiative is significant, partly because symbols are of great, if indirect, importance in international life. Symbolic victories at the UN do on occasion have subtle, yet real, behavioral impacts. The UN for all its weaknesses has long been the primary source for authoritative determinations of the legitimacy and illegitimacy of internationally recognized claims and grievances. This resolution is illustrative, supported by every important country in the world including the closest allies of the United States, with the symbolic and unequivocal rejection of the Trump diplomatic gesture of recognition being clear and consequential.

 

The Jerusalem resolution seems likely to produce a series of consequences: it greatly weakens, if not terminates, the central role that the United States has played as the only recognized third party mediator between Israelis and Palestinians, thereby creating an opportunity for the EU and individual European states to fill the diplomatic vacuum that seems to have formed; besides this, demonstrations around the world opposing the U.S. recognition initiative are translating support throughout the world for the Palestinian global solidarity movement that is likely to be expressed in several ways, especially by way of a more robust Boycott, Divestment, and Sanctions (BDS) Campaign. And at least for the moment, the Palestinian Authority, and its leadership, has moved away from adopting a quasi-collaborative stance in its relations with Israel, insisting that Trump’s move caused a damaging rupture. In effect, if diplomacy is to go forward in the future, it will have to proceed under new auspices, possibly Europe, maybe even China or the UN. Such radical expectations, while expressing a welcome refusal to be coopted by the Tel Aviv/Washington charade carried on for so long within the Oslo framework, is totally unrealistic in the near term. Israel would much rather be a pariah state than to submit its fate to Chinese or UN diplomacy, or for that matter, any intermediary that would seem fair to the Palestinians rather than partisan as in the past in favor of Israel. For so long Israel has

been coddled by American leaders that it became a hardened expectation with little wiggle room as Barack Obama found out early in his presidency when he dared to take baby steps in search of a middle ground.

 

It is worth recalling the anti-apartheid campaign against the South African racist regime that achieved prominence in the decades after 1945. The UN played a crucial role by its authoritative condemnation of apartheid as a crime against humanity and by its indirect encouragement of nonviolent resistance to South Africa racism throughout the world. This anti-apartheid experience is an instructive precedent, raising hope for the eventual success of the Palestinian national struggle, although the South African leadership had been far less creative and effective than the Israelis in insulating their governing process from external pressures.

 

What is analyzed with reference to Palestine and the Jerusalem resolution can be understood as a template for a general appreciation of both what the UN can and cannot do. The UN has this central role to play in either confirming or dismissing symbolic claims associated with the grievances and rights of subjugated peoples in the world. It is for this reason that governments fight so hard to have their policies accepted at the UN, or at least not criticized, censured, or punished, none more so than the government of Israel. Israel’s vicious attacks on the UN should be understood as disclosing the Israeli appreciation that, despite everything, the UN is a crucial site of struggle in the contemporary world order. Its findings of legitimacy and illegitimacy, especially if they resonate with feelings of justice around the world, impact strongly on civil society and often exert a strong influence on international public opinion and media coverage.

 

At the same time even if there is intense support for a symbolic outcome, it will rarely be self-enforcing, and it will be almost impossible to enforce at all absent a rare supportive geopolitical consensus. For instance, with respect to imposing sanctions on North Korea given its provocative nuclear program and accompanying diplomacy, it has been possible for all 15 members of the Security Council to agree sometimes on a common course of action, although as worried by Trump’s blustering belligerence that increases the danger of a universally unwanted and feared war. The geopolitical divergencies that were present at the UN were temporarily overcome by compromises. In this instance, the shared goal of avoiding a war on the Korean Peninsula encouraged governments to find some common ground.

 

The role of the UN in the Middle East has been particularly lamentable, First, the legacies of colonialism have left artificial political communities throughout the region. The Middle East also suffered from the geopolitical ambitions of the U.S., including its Cold War containment policy, strategic priorities accorded Gulf oil reserves and the security of Israel, and since the Iranian Revolution of 1979, its resolve to limit the spread of Islamic influence and political extremism. In effect, when the geopolitical stakes are high and associated with the policy priorities of dominant states, then the UN becomes marginalized, playing only trivial roles as in the long international civil wars that have caused such massive suffering in Syria and Yemen.

 

The conclusion to be reached is to view the UN realistically, affirming its central role with regard to symbols of legitimacy and its relative impotence if geopolitical forces are mobilized against any UN calls for action. Sometimes, arguably, the UN can be too effective, as when geopolitical forces turn a blind eye to issues of sovereignty and justice in a weaker country. This happened when in 2011 the Security Council was hoodwinked into endorsing a NATO regime-changing intervention in Libya undertaken in the name of freedom and democracy, but resulting in chaos, violent strife, and ethnic tensions.

 

The prospects for a stronger UN presence in international life involve tethering geopolitics by taking steps that now seem politically impractical: abolishing the veto power of the five permanent members of the Security Council, making resolutions of the General Assembly binding if supported by ¾ of UN members, basing UN funding on an independent tax base tied to international civil aviation or transnational financial transactions, and removing the selection of the Secretary General from the filter of P-5 approval. These steps have been long advocated by those seeking a more effective UN, but have been blocked by states that do not want to diminish their international status or their geopolitical leverage.

 

Until the international system experiences a shock or intense stress, it is hard to imagine such steps being taken. In fact, given Trump’s regressive approach to global policy and thinly disguised hostility to the UN, it is more likely that the UN will be even more constrained in the near future as to what it can do to make the world more peaceful, prosperous, sustainable, and just. The diplomatic rebuff of the U.S. after its irresponsible Jerusalem unilateralism, including the failure of its bullying tactics, has undoubtedly made the Trump presidency realize that the UN will not be a venue in which to push its regressive version of ultra-nationalist militarism.

 

Despite understandable degrees of disillusionment, people of good will dedicated to UN ideals should not give up on the Organization or its potentiality, but work harder to make the UN come closer to fulfilling its original promise, needed now more than ever. Justice for the Palestinian people, however long deferred, remains the defining moral prism by which to assess the shifting balance between achieving global justice and bowing to the whims of geopolitics at the UN and elsewhere.

Let the Two-State Solution Die a Natural Death

[Prefatory Note: This post is a modified version of an article published in Middle East Eye on Jan. 1, 2018. It contends that the proper priority for genuine advocates of peace between Israelis and Palestinians should be centered around apartheid rather than be devoted to reviving an Oslo style ‘peace process’ (always a sham) or proclaiming the goal of an independent and sovereign Palestine as attainable without first dismantling the apartheid structures that subjugate the Palestinian people as a whole so as to maintain the Zionist insistence on Israel as the state of the Jewish people (rather than providing a homeland within a normal and legitiamt state based on ethnic and religious equality, human rights, and secular principles.]

 

Let the Two-State Solution Die a Natural Death

 

Despite all appearances to the contrary, those in the West who do not want to join the premature and ill-considered Israeli victory party, are clinging firmly to the Two-State Solution amid calls to renew direct diplomatic negotiations between the parties so as to reach, in the extravagant language of Donald Trump, ‘the ultimate deal.’

 

Israel has increasingly indicated by deeds and words, including those of Netanyahu, an unconditional opposition to the establishment of a genuinely independent and sovereign Palestine. The settlement expansion project is accelerating with pledges made by a range of Israel political figures that no settler would ever be ejected from a settlement even if the unlawful dwelling units inhabited by Jews were not located in a settlement bloc that have been conceded as annexable by Israel in the event that agreement is reached on other issues. What is more Netanyahu, although sometimes talking to the West as if he favors a resumption of peace negotiations seems far more authentic when he demands the recognition of Israel as the state of the Jewish people as a precondition for any resumption of talks with the Palestinians or joins in welcoming American pro-Israeli zealots who insist that the conflict is over, and that Israel deserves to be anointed as victor. To top it all off, the Trump decision of December 6, 2017 to recognize Jerusalem as the capital of Israel and to follow this up by soon relocating the U.S. Embassy, effectively withdraws from future negotiations one of the most sensitive issues—the status and sharing of Jerusalem—despite the language accompanying Trump’s statement on recognition that purports to leave to the future, permanent Jerusalem borders and disposition of the city on a permanent basis that is misleadingly declared to remain open for an agreement between the parties to be achieved at a later date of their choosing.

 

All in all, it seems time to recognize three related conclusions:

         –first, the leadership of Israel has rejected the Two-State Solution as the path to conflict resolution;

         –secondly, Israel has created conditions, almost impossible to reverse, that make totally unrealistic to expect the establishment of an independent Palestinian state;

         –thirdly, Trump even more than prior presidents has weighted American diplomacy heavily and visibly in favor of whatever Israel’s leaders seek as the endgame for this struggle of decades between these two peoples.

 

Despite these obstacles, which seem conclusive, many people of good will who are dedicated to peace and political compromises, cling to the Two State Solution as the most realistic approach to peace. The words of Amos Oz, celebrated Israeli novelist, expressed recently this widely shared sentiment among liberal supporters of a Zionist Israel: “..despite the setbacks, we must continue to work for a two-state solution. It remains the only pragmatic, practical solution to our conflict that has brought so much bloodshed and heartbreak to this land.” It is also significant that Oz made this statement in the course of a yearend funding appeal on behalf of J-Street in 2017, the strongest voice of moderate Zionism in the United States.

 

What Oz says, and is widely believed, is that there is no solution available to Palestine unless there is a sovereign independent Jewish state along 1967 borders as the essential core of any credible diplomatic package. All alternatives would, in other words, not be ‘pragmatic, practical’ according to Oz and many others. Why this is so is rarely articulated, but appears to rest on the proposition that the Zionist movement, from its inception, sought a homeland for the Jewish people that could only be secured and properly proclaimed if under the protection of a Jewish state that was permanently, as a matter of constitutional framework, under Jewish control.

 

For many years the internationally recognized Palestinian leadership has shared this view, and has given its formal blessings in its 1988 PNC/PLO declaration that looked toward the acceptance of Israel as a legitimate state, if the occupation were ended, Israeli forces withdrawn, and Palestinian sovereignty established within the 1967 borders. It is notable that this Palestinian conditional recognition of Israeli statehood accepted a territorial delimitation that was significantly larger than what the UN had proposed by way of partition in GA Resolution 181(that is, Israel would have 78% rather than 55% of the overall territory comprised by the British Mandate, leaving the Palestinian with the remaining 22% for their state). This type of outcome was also endorsed by the Arab Peace Initiative of 2002 and was confidently depicted as the solution during the Obama presidency, and even adapted to meet Israel’s security demands in ways designed to make such a solution appeal to Israel. Even Hamas endorsed the spirit of the two-state approach by proposing over the course of the last decade a long-term ceasefire, up to 50 years, if Israel were to end the occupation of the East Jerusalem, West Bank, and Gaza. If Israel were to agree, the resulting situation would materialize the Two-State Solution in the form of two de facto states: Israel and Palestine. It differs from the two-state approach only to the extent that it refuses to grant Israel de jure legitimacy or to renounce formally Palestinian claims to Palestine as a whole. Among the deficiencies of such territorially oriented approaches to peace is the marginalization of the grievances of up to seven million Palestinians living for generations as refugees or involuntary exiles.

 

There are at least four problems, conveniently swept under the nearest rug by two-state advocates, any one of which is sufficiently serious to raise severe doubts about the viability and desirability of the Two-State Solution: (1) Liberal Zionism expressed an outlook toward a diplomatic settlement that was not shared by the Likud-led rightest Israeli governments that have dominated Israeli politics throughout the 21st century; the Israeli goal involved territorial expansion, especially with respect to an enlarged and annexed Jerusalem, and by way of an extensive network of settlements and transport links in the West Bank, underpinned by the fundamental belief that Israel should not establish permanent borders until the whole of ‘the promised land’ as depicted in the Bible was deemed part of Israel. In effect, despite some coyness about engaging with a diplomatic process, Israel never credibly endorsed a commitment to a Palestinian state within 1967 borders that was based on the equality of the two peoples.

 

(2) Israel created extensive facts on the ground that have definitively contradicted its professes intention to seek a sustainable peace based on the Two-State Solution; these developments associated with the settlements, road network linking settlement blocs to Israel, references with Israel to the West Bank as ‘Judea and Samaria,’ that is, as belonging to biblical or historical Israel.

 

(3) The Two-State Solution as envisioned by its supporters effectively overlooked the plight of the Palestinian minority in Israel, which amounts to 20% of the population, or about 1.5 million persons. To expect such a large non-Jewish minority to accept the ethnic hegemony and discriminatory policies and practices of the Israeli state is unrealistic, as well as being contrary to international human rights standards. In this fundamental sense, an ethnic state that is exclusively associated with a particular people, is by its own proclamations and legal constructions, an ‘illegitimate state’ from the perspective of international law.

 

(4) Beyond this, to sustain Israel in relation to the dispossessed and oppressed Palestinian people has depended on establishing structures of ethnic domination over the Palestinian people as a whole that constitute the crime of apartheid. As in South Africa, there can be no peace with the Palestinians until these apartheid structures used to subjugate the Palestinian people are renounced and dismantled (including those imposed on Palestinian refugees and involuntary exiles); this will not happen until the Israeli leadership and public give up their insistence that Israel is exclusively the state of the Jewish people, with includes an unlimited and exclusive right of return for Jews and other privileges based on Jewish ethnic identity; in effect, the core of the struggle is about people rather than as in two-state thinking, about territory.

 

If we discard the Two-State Solution as unwanted by Israel, normatively unacceptable for the Palestinians, not diplomatically attainable, and inconsistent with modern international law, then what? It should be understood that even if a strong political will unexpectedly emerged that was genuinely dedicated to the balanced implementation of the Two-State Solution it would be highly unlikely to be achieveable. Against this critical background, we are obliged to do our best to answer this haunting question: ‘Is there a solution that is both desirable and attainable, even if not presently visible on the political horizon?’

 

Following the lines prefigured 20 years ago by Edward Said two overriding principles must be served if a sustainable and honorable peace is to be achieved: Israelis must be given a Jewish homeland within a reconfigured, and possibly neutrally renamed Palestine and the two people must allocate constitutional authority in ways that uphold the cardinal principles of collective equality and individual human dignity. Operationalizing such a vision would seem to necessitate the establishment of a secular unified state maybe with two flags and two names, which would have a certain resemblance to a bi-national state. There are many variations, provided there is strong existential respect for the equality of the two peoples in the constitutional and institutional structures of governance. Said also believed that there must be some kind of formal acknowledgement of Israel’s past crimes against the Palestinian people, possibly taking the form of a commission of peace and reconciliation with a mandate to review the entire history of the conflict.

 

If the liberal Zionist approach seems impractical and unacceptable, is not this conception prescribed as a preferred alternative ‘an irrelevant utopia’ that should be put aside because it would be a source of false hopes? If the Palestinians were to propose such a solution in the present political atmosphere, Israel would undoubtedly either ignore or react dismissively, and much of the rest of the international community would scoff, believing that the Palestinian are living in a dreamland of their own devising.

 

This seems like an accurate expectation, despite my insistence that what is being proposed here is a relevant utopia, the only realistic path to a sustainable and just peace. There is no doubt that the present constellation of forces is such that an initial dismissal is to be expected. Although if the Palestinian Authority were to put such a vision forward in the form of a carefully worked out proposal, it would constitute fresh ground for a debate more responsive to the actual circumstances faced by Israelis, as well as Palestinians. It would also be a step toward unity, overcoming the current political fragmentation that has weakened the Palestinians as a political force.

 

The primary political and ethical question is how to create political traction for a secular state shared equally by Israelis and Palestinians. It is my view that this can only happen in this context if the global solidarity movement presently supportive of the Palestinian national struggle mounts sufficient pressure on Israel so that the Israeli leadership recalculates its interests. The South African precedent, while differing in many aspects, is still instructive. Few imagined a peaceful transition from apartheid South Africa to a constitutional democracy based on racial equality to be remotely possible until after it happened.

 

I envisage a comparable potentiality with respect to Israel/Palestine, although undoubtedly there would also be present a series of factors that established the originality of this latter sequence of development. In politics, if political will and requisite capabilities are present and mobilized, the impossible can and does happen, as it did in South Africa and in struggles against the European colonial regimes in the latter half of the 20th century.

 

Further, without such a politics of impossibility there is no path to genuine peace and justice for both Palestinians and Israelis, massive suffering will persist, and the normalcy of an existential peace based on living together on the basis of mutual respect and under a mature, humane, and democratic version of the rule of law, underpinned by checks and balances, and upholding constitutionally anchored fundamental rights. Only then, could we as citizen pilgrims dedicated to the construction of human-centered world order give our blessings to a peace that is legitimate and existentially balanced as between ethical values and political realities.

Trump, the UN, and the Future of Jerusalem

 

[Prefatory Note: This post is the modified text of an interview on behalf of the Tasnim News Agency in Iran as conducted by Mohammed Hassani. It tries to assess the wider implications of the UN reaction to Trump’s December 6th decision to recognize Jerusalem as the capital of Israel, and to follow this by relocating the American Embassy from Tel Aviv to Jerusalem.]

 

Q1: As you know, nearly 130 countries recently voted in favor of a United Nations General Assembly resolution condemning the US decision to recognize Jerusalem (al-Quds) as the capital of the Israeli regime. What message does the vote signal to the world’ public opinion?

The main message of this overwhelming rejection of the Trump recognition of al-Quds as the capital of Israel by the UN General Assembly is to disclose that the Palestinian national movement continues to enjoy strong support from each and every important country in the world, thereby rejecting the current Israeli approach, supported by the United States, to impose unilaterally a solution of the long struggle over land and rights on the Palestinian people. Such a solution would foreclose both a sovereign Palestine, deny the Palestinian people the most fundamental of all rights, that of self-determination, and preclude any fair and just arrangement of shared sovereignty between the two people.

A secondary message was the consensus in the General Assembly that on this issue of Jerusalem matters of global justice take precedence over geopolitical maneuvers. There can also be read into the vote the growing erosion of global leadership that had been exercised by Washington since the end of World War II. This erosion reflects the rise of China, and its advocacy, along with that of Russia, and maybe also even leading countries in Europe, of a multipolar approach to the formation and implementation of global policy with respect to security issues, environmental policies, and economic governance. The fact that America’s closest allies, including France, United Kingdom, and Japan voted for the resolution condemning the effort of the U.S. Government to legitimize the establishment of Jerusalem (al-Quds) as Israel’s capital is also of considerable significance. What remains to be seen is how the future of Jerusalem will unfold in light of these dramatic developments. There are currently visible two tendencies—first, the handful of negative votes by tiny island countries and a few minor and dependent Central American countries to follow the lead of the U.S. and move their embassy to Jerusalem; secondly, the counter-initiative of the Organisation of Islamic Cooperation (OIC) to declare Jerusalem as the capital of Palestine, given concrete expression by the Turkish decision to establish its embassy for Palestine in East Jerusalem.

What remains to be seen is whether the Trump presidency softens its stand on these issues or doubles or even triples down by defiantly moving its embassy to Jerusalem, withholding economic assistance from countries that voted for the resolution, and reducing its financial contributions to the UN in a vindictive display of hostility at the various actors viewed as responsible for humiliating the U.S. Government, thereby pleasing those pro-Israeli forces that insist that the UN is primarily a venue for Israel-bashing.

Q2: Prior to the UN vote on Jerusalem, US President Donald Trump had threatened to cut off financial aid to countries that voted in favor of the resolution. It seems that his warning has been ineffective. What do you think?

Yes, the ineffectiveness of such an unprecedented overt threat at the UN, abetted by back channel pressures, is definitely a sign that U.S. soft power leadership in the world is experiencing a sharp decline if measured against its reality in the years after World War II, and extending throughout the Cold War Era. More generally, the failure of Haley’s threats to influence the vote of a single country of stature in the world is also indicative of a parallel decline of geopolitical capabilities to control global policy at least on the key issue of the rights of the Palestinian people, particularly in the context of Jerusalem, which has a strong symbolic significance for many countries. What is unclear is whether this vote exhibits a broader trend among states to pursue foreign policies that exhibit their sovereign independence and distinct views of global policy, rather than as in the past, displaying a strong tendency to defer to the views of a globally dominant state(s). In this context, the radical character of Trump’s presidency may be having the effect of fracturing hegemonic structures of control in contemporary world order that were in any event faced with accumulating skepticism since the end of the Cold War, and the breakdown of the bipolar structure that had shaped much of global policy between 1945 and 1992. What Trump has done is to intensify pre-existing pressures for global restructuring, a dynamic also reinforced by the rejectionist approach taken by the United States on other key issues of global concern, including climate change, the Iran Nuclear Program (5 + 1) Agreement, global migration, ad international trade. The Trump slogan of ‘America, First’ has to be coupled with ‘World, Last,’ to grasp the extent to which the United States invites by its own initiatives a reaction against its outlier policies at odds with strong countervailing views of the international community of states as to desirable forms of global cooperation for the public good. At the very historical moment when the future of humanity depends on unprecedented action on behalf of human, habitat, and global wellbeing, the leading political actor not only withdraws from the effort, but does its best to obstruct constructive behavior. It is as if the United States Government has become a deadly virus attacking the fabric of the global body politic.

 

 

Q3: In a speech at the White House on December 6, Trump said his administration would also begin a years-long process of moving the American embassy in Tel Aviv to the holy city of Jerusalem. Do you see any chance that Trump would press ahead with his plan to relocate the embassy given the widespread international opposition? 

 

My guess at this point is that the U.S. Government will definitely implement its decision to relocate the embassy, but will probably do so in a gradual manner that does not provoke a major subsequent reaction, especially if implementation is entrusted to the State Department. Of course, any steps taken to relocate the American Embassy in Jerusalem will be correctly perceived as a defiant and provocative rejection of the conclusions set forth in the GA Resolution. In this sense, the quality and impact of reactions will depend on the political will of the Palestinian Authority, the OIC, the UN, and world public opinion. At stake, is whether the United States further produces an adverse international reaction to its behavior and whether governments seek to engage further on the issue to preserve the rights of the Palestinian people with respect to Jerusalem. The future interaction with respect to Jerusalem will be very revealing as to both the responsiveness of the United States to the rejection of its approach to the recognition of the Israeli capital at this time and as to the energy of those that supported the resolution to take further steps in the direction of achieving compliance. There is little doubt that a test of wills is likely to emerge in the months ahead that will reveal whether the Jerusalem resolution was a mere gesture or a tipping point.

 

The fact that the al-Quds resolution was itself based on The Uniting for Peace Resolution (GA Res. 377 A (V), 1950) gives its text a special status, both as the outcome of a rare Emergency Session of the General Assembly and as a truly responsible reaction on behalf of peace and security to an irresponsible use of the veto in the Security Council to block its decision of condemnation backed by a 14-1 vote, that is, all other members. This status gives the General Assembly response on Jerusalem an authoritativeness that should extend far beyond its normal recommendatory capabilities, but as earlier indicated there are few guidelines as to how such an initiative will be implemented if defied.

At stake is the larger issue of whether this path taken to circumvent a P-5 veto in the Security Council might produce a shift in UN authority to the more representative General Assembly.

 

In any event, it may well be that whatever course of action ensues will exert an important influence on how well the UN in the future can serve the human and global interest, as well as take account of distinct and aggregate national interests as opportunities present themselves. The Trump phenomenon gives a pointedness to fundamental issues of world order viability, especially a capacity to address challenges of global scope in the course of the first biopolitical moment, confronting humanity as such with a prospect of its own mortality.

The Jerusalem Votes at the UN

What struck me as the most significant dimension of the Jerusalem votes in the Security Council and General Assembly has been oddly overlooked by most commentary in the media. The public discourse has, of course, been correct to identify the isolation of the United States with respect to the rest of the world as well as regarding the majority position as a defiant rejection of Trump’s leadership and bullying tactics. Although as some have noted, without the bullying by Ambassador Haley (including, I will report yes votes to the president; those that vote for the resolution will not receive economic assistance in the future; we are watching; “America will remember this day;” “the vote will make a difference on how Americans look at the UN.”), there might been as many as 150 positive votes for the resolution instead of 128, with fewer abstentions (35) and fewer absences from the vote (21).

 

Nevertheless, 128-9 is a clear expression of an overwhelming moral and legal sentiment, and deserves to be respected by any government that values the role of the General Assembly as the arbiter of legitimacy with respect to sensitive global issues. Although far weaker and more subject to geopolitical manipulation than is desirable, these main political organs of the UN provide the best guide that currently exists as to what global policy should be if the global and human interest is to be protected, and not merely an array of national interests and their multilateral aggregation to achieve cooperative results.

 

What this discussion glosses over in this instance without stopping to observe its significance is the degree to which issues of substance prevailed over matters of geopolitical alignment. Not one of America’s closest allies (UK, France, Germany, and Japan) heeded the fervent arguments and pleas of Haley and Trump. Beyond this, every important country in the world backed the General Assembly Resolution on December 21, 2017 regardless of geography or political orientation (China, Russia, India, Brazil, Turkey, India, Pakistan, Saudi Arabia, Iran). This unanimity enhances the quality of the consensus supportive of the resolution repudiating Trump’s arrogant decision to recognize Jerusalem as Israel’s capital as ‘null and void.’ Such an impression is strengthened by listing the nine governments that voted against the resolution (Guatemala, Honduras, Marshall Islands, Israel, Miscronesia, Nauru, Palau, Togo, and the U.S.).

 

Should these striking results be interpreted as the demise, or at least twilight, of geopolitics? Any such speculation would be wildly premature. What seems to have swayed many governments in this case is the negative fallout expected to follow from Trump’s unilateralism that disregards decades of international practice and agreement about the status and treatment of Jerusalem, as well as the gratuitous neglect of Palestinian rights and aspirations by taking such an initiative without even pretending to take account of Palestinian grievances. In this regard, Trump’s poor international reputation as a result of pulling out of the Paris Climate Change Agreement, decertification of the Nuclear Agreement with Iran, and withdrawal from negotiations to fashion an agreed approach to the global migration crisis undoubtedly help tip the scales on the Jerusalem resolution, especially among European governments. Trump’s unpopular implementation of his diplomacy of ‘America, First’ is arguably morphing into the disturbing perception of ‘America, Last’ or the United States as ‘rogue superpower.’ Consciously or not, the UN vote was a distress signal directed at Washington by friends and adversaries alike, but as near as can be told, it will be disregarded or angrily rebuffed by the White House and its spokespersons unless they decide to pass over these happenings in silence.

 

As has been observed, the Jerusalem decision was not part of a carefully crafted international approach to the Israel/Palestine struggle. It seemed mainly to be a payoff to domestic support groups of Trump’s presidential campaign in the United States (large pro-Israeli donors and Christian Evangelists wedded to a (mis)reading of the Book of Revelations), as well as a further display of post-Obama affection for Bibi Netanyahu. Apparently, for Trump being adored in Tel Aviv seems worth being discredited with allies and leading states throughout the rest of the world. As for the threatened major aid recipients (Afghanistan, Egypt, Pakistan, Nigeria, Ethiopia, Tanzania, and South Africa; Kenya was absent during the vote); it was impressive that all of these states ignored the threat and voted for the resolution. If Washington follows through on withholding aid it will certainly not serve America’s strategic interests as previously understood, particularly in the Middle East, but also in Africa. Yet if it fails to carry its threat, its diplomatic posture will be seen as that of a novice poker player whose untimely bluff has been called.

 

There is also the question of ‘what next?’ Will the Jerusalem resolution be remembered as a moment in time to be superseded by contrary behavioral trends? In this regard, the U.S. now has its own chance to exhibit defiance and disrespect by quickly and ostentatiously moving its embassy to Jerusalem, which will of course give rise to further anger. The Turkish president, Recep Tayyip Erdoğan has already seized the occasion to reassert its prominence in the Muslim world, first by co-sponsoring (with Yemen) the resolution, and then by explicitly calling on the U.S. Government to rescind its decision to recognize Jerusalem as the capital of Israel. I would darkly imagine that the Trump presidency would opt for World War III before it backed down on Jerusalem.

 

As widely reported, the Jerusalem resolution is symbolic in nature, and yet it does have serious political consequences for all relevant political actors. Does it clear a political space for the European Union to play a central role in seeking to revive a diplomatic approach on a more balanced basis than what could have been expected from Washington? How does the U.S. Government negotiate the fine line between disregarding the resolution and harming its foreign policy objectives in the Middle East? How unyielding should the Palestinian Authority be about insisting on a parallel recognition of East Jerusalem as the capital of Palestine before it agrees to participate in negotiations with Israel? Will Turkey seek further steps at the UN and elsewhere to back up the resolution, including possibly fashioning realignments throughout the Middle East? Will the second tier of officials in the Trump Administration create pressure to create a foreign policy that more closely reflects U.S. national interests by taking better account of the many dimensions (digital, economic, security) of global integration?

Recognizing Jerusalem as Israel’s Capital

[Prefatory Note: The following post is a modified version of an article published on December 8th in Middle East Eye. It considers the normative and geopolitical sides of Trump’s unilateralism. Apologists claiming Trump finally acknowledged the operational reality that Jerusalem has been serving as the capital of Israel for the last 50 years, and the disruptive effects have been exaggerated as Saudi Arabia has not reacted in a strongly negative manner. Critics, including myself, regard the initiative as a gratuitous slap at the Palestinians and a further confirmation of Trump’s disregard of international law, international morality, and the authority of the United Nations. The status of Jerusalem serves as a focal point for the tension between the old geopolitics of hard power realism and the normative geopolitics of soft power new realism that is struggling through a birthing process in many settings. In my view the resolution of this tension will shape the trajectory of 21st century humanity. In other words, the stakes are high.]

 

Recognizing Jerusalem as Israel’s Capital

 

With the deftness of a bull in a china shop, Donald Trump has ignored the advice of several close advisors, disregarded the fervent pleas of several of Israel’s closest Arab neighbors, ignored warnings of America’s traditional allies in the Middle East and Europe, and ruptured a key element of an international consensus that had long prevailed at the UN, by going ahead to proclaim formally Washington’s view that Jerusalem is and will be the capital of Israel. Such a declaration serves also to rationalize the prior pledge to move the American Embassy from Tel Aviv, the city where every other country in the world insists on maintaining its government to government relationship with Israel, to the city of Jerusalem, sacred to all three of the monotheistic religions.

 

The most obvious question to pose is one of motivations: Why? Strange as it may seem to those living in the Middle East, the most persuasive explanation is that Trump saw this act of recognition as an opportunity to show his most fervent supporters at home that he was being true to his campaign promises. Trump has been frustrated during the first year of his presidency by his embarrassing inability to carry out the program that helped get him elected in 2016. It is true that by taking this further step toward relocating the American embassy Trump’s popularity in Israel spiked and as he has pointed out he is actually doing what his predecessors and Congress has long proposed.

 

In essence, Trump seems to have taken this internationally controversial step because he cares about pleasing the Christian Zionists and the Israeli Lobby in America more than he does about ruffling the feathers of UN diplomats, possibly inflaming the Arab masses, removing the last shred of doubt among Palestinians that the U.S. could ever be trusted to play the role of ‘honest broker,’ or even partisan intermediary, in the pursuit of a two-state solution, and perhaps most of all, connecting American foreign policy in the turbulent Middle East is some durable and coherent way with strategic national interests in regional stability.

 

From this perspective, Trump has once again demonstrated his extraordinary talent for choosing the worst possible alternative in delicate international situations where dire consequences could follow from the wrong policy turn, and the rewards of going it alone seem minimal and transient, at best.

This vivid instance of Jerusalem unilateralism parallels the geopolitical stupidity of withdrawing from the Paris Climate Change Agreement of 2015 a few months ago. There also the Trump approach to foreign policy seemed perversely designed to burnish its already secure reputation as the first rogue superpower of the nuclear age. This global spoiler role is also dangerously evident in the apocalyptic threat diplomacy adopted by Trump in the Korean Peninsula as a response to Kim Jong-un’s nuclear weapons program, which include provocative bluster, weapons developments, and grave risks of mutual miscalculation.  

 

Liberal opinion in the U.S. and abroad lamented the Trump initiative on Jerusalem for the wrong reasons. Especially prominent was the assertion in various forms that Trump had damaged, if not destroyed, the ‘peace process,’ and its special role as convening party. Such a concern presupposes that a peace process sufficiently existed to be susceptible to being destroyed. While promising ‘the deal of the century,’ Trump turned over his supposed peace offensive, to pro-Zionist extremists and settler fundamentalists (David M. Friedman, Jared Kushner, and Jason Greenblatt) whose obvious goal was not peace, but putting the finishing touches on what they regarded as an Israeli victory that only needed a face-saving exit arrangement for the Palestinian Authority to complete the job. Working in tandem with the Netanyahu leadership, the Trump effort has been so far focused on killing ‘the two-state solution,’ at least in its claim to satisfy reasonable Palestinian expectations of self-determination in the form of a viable and truly independent sovereign state with its capital in East Jerusalem. In its place, one supposes that the Trump ‘dream team’ will come up with a non-viable polity in what remains under Palestinian control in the West Bank, either tied to Gaza or separated in some enduring way, affronting reality by calling the plan a fulfillment of two-state expectations, and dismissing Palestinian objections as ‘rejectionism,’ a stubborn insistence on having it all, and in the end, a take it or leave it version of Hobson’s Choice.

 

As matters now stand, the status quo is also very unfavorable from the point of view of the Palestinian national struggle and the implementation of the international community’s version of a reasonable compromise. This status quo of occupation and dispossession facilitates the continuing conversion of the 1967 ‘occupation’ of Palestinian territory into a permanent reality that unlawfully blends the annexation of the West Bank and East Jerusalem with the maintenance of control over the Palestinian people by means of apartheid structures of subjugation. If this assessment is correct, then moving the American Embassy to Jerusalem can be seen as supportive of Netanyahu’s apparent conception of the end-game of this hundred year struggle between the national aspirations of these two embattled peoples. In this regard, the bluntness of the Trump approach exposes to the world an ugly reality that should have been obvious all along to anyone looking at Israeli behavior with a critical eye, or grasping the policy fallout from the ‘America First’ mantra.

What gives this regressive turn its plausibility, posing yet another challenge to the Palestinian movement, is the blind eye that the new look in Riyadh has turned toward even the Judaization of Jerusalem, which would seem to confirm the Saudi priority of geopolitical collaboration with the United States and Israel, even at the expense of fundamental Islamic concerns and the maintenance of solidarity in the Muslim world. In this sense, it is well to take some note of the declaration of the Organization of Islamic Cooperation (OIC), endorsed by all 57 of its member states (including Saudi Arabia), that Jerusalem is the capital of Palestine, denying Israel any right to a formal governing process in the city.

 

While this substantive analysis helps us grasp the geopolitical context that makes recognition of Jerusalem as Israel’s capital a kick in the groin of Palestinian delusions about a viable peace diplomacy while at the same time leading most Israelis to dance in the streets. It also underscores the hypocrisy of the international community’s call for reviving the peace process when it should long have been evident that Israeli settlement expansion as well as Tel Aviv’s approach to Jerusalem had passed the point of no return, and thus the occasion for abandoning an unworkable diplomacy, and facing with honesty the daunting question—‘What next?.’ Israel’s recent behavior makes it clear for all except hasbarists that the Israeli government has no current willingness whatsoever to end the conflict if this means creating an independent Palestinian state delimited by 1967 borders, thereby encompassing West Bank, Gaza, and East Jerusalem. For Israel the alternatives are perpetuating the apartheid status quo or allowing for the emergence of ‘Bantustan Palestine’ as the diplomatic price that the Netanyahu leadership is willing to pay for a certification of ‘peaceful solution.’

 

From the issuance of the Balfour Declaration in 1917 to this historic moment acknowledging Israel’s claims to Jerusalem, Zionism and since 1948, the state of Israel, have disseminated a double-coded message to the world. In its public utterances, Israel’s public posture is one of a readiness for compromise and peaceful coexistence with the Palestinians, while its practices and actual objectives, can only be understood as the step by step consistent pursuit of the visionary ideal of Greater Israel or Our Promised Land. The present Israeli ambassador to the U.S., Ron Dermer, in the course of thanking Trump for standing so strongly with Israel, told an American TV audience that Jerusalem has been truly the capital of the Jewish people for 3,000 years. No where has Israel’s double-coding been more evident than in relation to Jerusalem. It uses the grandiose claims of Jewish religion tradition when it can and the somewhat more constraining diplomacy of statecraft when it offers opportunities, and does its best to avoid altogether the precepts of international humanitarian law or the UN consensus.

 

On the public discourse side stands Israel’s public acceptance of the partition arrangements embodied in General Assembly Resolution 181, which included the internationalization of Jerusalem under UN administration. More critically viewed from a behavioral discourse perspective, Israel’s actual conduct flagrantly consistently defied international law by formally enlarging and annexing Jerusalem as ‘the eternal capital’ of the Jewish people and manipulating the demographics and cultural heritage of the city in ways that made it seem more credible to regard the whole of Jerusalem as a Jewish city.

 

It is difficult for even notorious Israeli apologists, such as Elliot Abrams or former American ambassadors to Israel to defend the actual Trump decision. Such apologists prefer to adopt a default position. Yes, the timing of the White House initiative was tactically questionable, but its international condemnation greatly exaggerates its importance and inappropriateness. They view criticisms and concerns as overblown, amounting to a display of ‘heavy breathing.’ In effect these apologists agree with Trump’s core contention that the acceptance of Israel’s claim to have its capital in Jerusalem, is an overdue recognition of reality, nothing more, nothing less, and that the rest of the world will have to learn to live with this recognition. Time will tell whether this downplaying of fears of renewed violence of resistance and anti-Americanism are anything other than a feeble attempt by apologists to reaffirm Israel’s legitimacy in the face of what should turn out to be a geopolitical fiasco.

 

What should dismay the region and the world the most about Trump’s Jerusalem policy is its peculiar mixture of ignoring law, morality, and the international consensus while so blatantly harming America’s more constructively conceived national interests and tradition of global leadership. This mixture becomes toxic with respect to Jerusalem because by humiliating the Palestinian national movement and ignoring the symbolic status of Jerusalem for Muslims and the Arab peoples, it makes violent extremism more likely while lending support to existing postures of anti-Americanism. How incoherent and self-defeating to proclaim the defeat of ISIS and political extremism as the top American priority and then making this Jerusalem move that is virtually certain to produce populist rage and an extremist backlash. No ISIS recruiter could have wished for more!

Jerusalem Is (Is Not) the Capital of Israel

 Jerusalem Is (Is Not) the Capital of Israel

 Those who speak on behalf of Israel like to defend Donald Trump’s provocative decision of December 6th to recognize Jerusalem as the capital of Israel with this contention: “Israel is the only state in the world that is not allowed to locate its capital in a national city of its choice.” It seems like an innocent enough proclamation, and even accurate pushback against global double standards, until one considers the political, moral, and legal dimensions of the actual situation.

 

With the benefit of just a moment’s reflection, a more thoughtful formulation of the issue would be: “Israel is the only state in the world whose government dares to locate its capital in a city located beyond its sovereign borders and subject to superior competing claims.” Granted, Israel has declined to date to define its borders for purposes of international law, presumably to leave room for its own further territorial expansion until the whole of the promised land as understood to comprise biblical Israel is effectively made subject to Israeli sovereign control. At stake, in particular, is the West Bank, which is known within Israel by its biblical names of Judea and Samaria, signifying Israel’s outlier belief that the ethnic and religious heritage of the Jewish people takes precedence over modern international law.

 

Further reflection casts additional doubt on this Trump/Netanyahu approach to the status of Jerusalem. It is helpful to go back at least 70 years to the controversial UN partition proposals set forth in General Assembly Resolution 181. Israel over the years has often congratulated itself on its acceptance of 181, which it contrasts with the Palestinian rejection. Palestinians suffered massive dispossession and expulsion in the war that ensued in 1947, known as the Nakba among Palestinians. Israel has argued over the years that its acceptance of 181 overrides the grievances attributable to the Nakba, including the denial to Palestinians of any right to return to their homes or place of habitation however deep and authentic their connections with the land and regardless of how persuasive their claims of Palestinian identity happen to be. What Israelis want the world to forget in the present setting is the UN treatment of Jerusalem that was integral to the 181 approach. Instead, Israel has sold the false story to the world that 181 was exclusively about the division of territory, and thus the bits about Jerusalem contained in the resolution can be ignored without comment, and deserve to be long forgotten.

 

What the UN actually proposed in GA Res. 181, and what Israel ‘accepted’ in 1947 was that the city of Jerusalem, in deference to its connections with Palestinians and Jewish national identity, should not be under the sovereign control of either people, but internationalized and subject to UN administration. Beyond the difficulty of reconciling Jewish and Palestinian claims to the city, the symbolic and religious significance of Jerusalem to the three monotheistic religions provided a parallel strong rationale for internationalization that has, if anything, further vindicated with the passage of time.

 

It can be argued by proponents of Trump’s recognition that even the Palestinians and the Arab World (by virtue of the 2002 Arab Peace Initiative) have silently replaced the internationalization of Jerusalem with the so-called ‘two-state solution’ in which the common assumption of both sides is that Jerusalem would be shared in ways that allowed both Israel and Palestine to establish their respective capital within the city limits. Most two-state plans called for the Palestinian capital to be located in East Jerusalem, which Israel has occupied for the past 50 years, that is, ever since the 1967 War. The clarity of this conviction is what explains the view that the thorny question of the relationship of both Israel and Palestine to the disposition of Jerusalem should be addressed at the last stage of peace negotiations. But suppose that the prospect of genuine peace negotiations is postponed indefinitely, then what? The geopolitical effort to fill this vacuum is undertaken at the expense of UN authority, as well as international law and international morality.

 

Here again we encounter an awkward split between what Israel claims (as reinforced by U.S. foreign policy) and what international law allows. Israel after the war ended in 1967 immediately asserted that the whole of Jerusalem was ‘the eternal capital’ of the Jewish people. Tel Aviv went even further. It expanded by Israeli legal decree the area encompassed by the city of Jerusalem, almost doubling its size and incorporating a series of Palestinian communities in the process. Israel acted unilaterally and unlawfully, against unified opposition within the UN, in defiance of world public opinion, and even in the face of rebuke by such a widely respected moral authority figure as Pope Francis.

 

East Jerusalem, at least, is ‘Occupied Territory’ according to international humanitarian law, and as such is subject to the Geneva Conventions. The Fourth Geneva Convention governs ‘belligerent occupation,’ and rests on the basic legal norm that an Occupying Power should take no steps, other than those justified by imperative security considerations, to diminish the rights and prospects of a civilian population living under occupation. In this regard, it is hardly surprising that Israel’s actions designed to obliterate East Jerusalem as a distinct ‘occupied’ territory have met with universal legal and political condemnation within the UN. For Trump to depart from this international consensus is not only striking heavy blows against the U.S. role as intermediary in any future peace process, but also mindlessly scrapping the two-state approach as the agreed basis of peace without offering an alternative, leaving the impression that whatever reality Israel imposes the United States will accept, giving scant attention to international concerns or Palestinian rights.

 

Returning to the burning question as to why Israel should be denied the right to locate its capital wherever it wishes, as other states do, it is clarifying to reformulate the Israeli claim: “Does any state have the right to establish its capital in a city that is ‘occupied’ rather than under the exclusive sovereign authority of the territorial government?” This is especially relevant in this instance, given the general agreement within the international community that the Palestinian right of self-determination includes the right to have its national capital both within its territory and in Jerusalem.

 

Trump’s initiative tries to ease the pain by the confusing accompanying assertion that the final disposition of Jerusalem’s borders is something for the parties to decide as part of final status negotiations, that is, at the end of the diplomatic endgame. Aside from Israel’s belief that it need not make further concessions for the sake of peace, a geopolitical assertion of support for Israel’s approach to Jerusalem, especially without the backing of the Arab League, the UN, and the European Union is worse than an empty gesture. It uses an iron fist on behalf of the stronger party, where a minimal respect for law, morality, and justice would counsel giving support for the well-grounded claims of the weaker side, or at least staying neutral.

 

The harm done by the Trump initiative on recognizing Jerusalem as the capital of Israel, and declared intention to start the process of moving the embassy is impossible to assess fully at this time. Whether there will be an upsurge in resistance violence, political extremism, anti-American terrorism, and wider warfare is now essentially unknowable, although the stage has been recklessly arranged so that these developments seem more likely to occur than earlier, and if they do, will be treated as outcomes of Trump’s faulty diplomacy.

 

What is already evident on the basis of the decision itself is the severe damage done to the global and regional leadership reputation of the United States. As well, the authority of the United Nations has been shown to be no match for geopolitical resolve, and international law and world public opinion have been pushed aside. For the Trump presidency the special relationship with Israel has been enlarged beyond previous outer limits and the part of the Trump base that wanted these policies has been appeased for the moment. Prospects for a diplomacy based on the equality of rights of Palestinians and Israelis have been reduced to zero, and thus no just end of the Palestinian ordeal can be foreseen. Overall, it is not a pleasant balance sheet of gains and losses if evaluated from the perspective of American grand strategy in the Middle East, and if the wider regional setting of Iran’s spreading influence is taken into account, the situation looks even worse.

Balfour: Then and Now

Today, November 2, is exactly 100 years after the issuance of the Balfour Declaration, the pledge given to the World Zionist Movement in a letter signed by the British Foreign Secretary to support the establishment of a ‘national home’ in the then Ottoman millet of Palestine. Certainly ‘a day of infamy’ for the Palestinian people and their friends around the world, while unfortunately treated as ‘a day of pride’ by the British Government, and all in the West those morally bankrupt enough to regret the passing of the colonial era, and to pretend without embarrassment that the Balfour legacy is something to celebrate, rather than to mourn, in the year 2017.

 

The British pledge was an unabashed expression of colonialist arrogance in 1917, ironically made at the dawn of the worldwide movement of national upheavals that would lead in the course of the century to the collapse of European colonialism. At the end of World War I colonialism was being increasingly questioned morally, but not yet challenged legally or politically. Such challenges only began to emerge as the struggles of national liberation gained political traction globally after 1945.

 

It is worth noticing that there was a certain amount of diplomatic pushback even in the post-1918 diplomacy, especially by way of Woodrow Wilson’s advocacy of ethnic ‘self-determination’ for the Ottoman held territories of the Middle East. More strongly in the same direction was Lenin’s radical critique of colonialism as a system of oppression that needed to be opposed and crushed wherever in the world it existed. This pushback did lead Britain and France to moderate their colonial ambitions as embodied in the Sykes-Picot Agreement of 1916, but these two unrepentant colonial powers still managed to gain essentially uncontested de facto control of political communities throughout the Middle East by way of the mandate system, which might be better understood as ‘tutelary colonialism.’

 

I am led to wonder whether if Wilson had had his way at Versailles in 1919 would the Balfour impact have been lessened with respect to the unfolding reality of Palestine? Presumably, Arab self-determination throughout the region would have drastically reduced the British and French role. Perhaps this European displacement would have been to an extent as to prompt a shift of Zionist energies away from Palestine, leading to a willingness to find a secure homeland somewhere that would be more receptive to the establishment of a Jewish state in their midst. This might have spelled a different tragedy for a different people than what has befallen the Palestinian people. Of course, ‘what might have been,’ is only of interest as a way of historically decoding the injustices that currently afflict oppressed and deprived peoples. We are helpless to change the past, although we can imagine unfolding in more benevolent ways. As much as the Palestinians, the Kurds throughout the region were fragmented and subjugated, and continue to this hour to struggle for some measure of ethnic autonomy, collective dignity, and self-determination. The Kurds were promised by World War I victors a state of their own situated mainly in present day Turkey and embodied in the Treaty of Sévres (1920). A few years later what was given was taken away, reflecting geopolitical moves that adapted to intervening political developments at the enduring expense of the Kurdish people. The main intervening event between the two treaties was the shocking Ataturk victory over European powers in Turkey, which helps understand why the Treaty of Lausanne (1923) abandoned the arrangements proposed at Sevres.

 

Reverting to reality, Britain became the mandatory administrator of Palestine in 1923, opening the country to the incremental realization of the Zionist agenda, which concentrated during the 1920s and 1930s on buying land from Palestinians that could be given to Jewish settlers, doing it all it could to induce Jews to emigrate to Palestine, and resorting to a terrorist campaign that was intended to make the British position in Palestine untenable. To make the whole Zionist undertaking credible ideologically, economically, and politically it was imperative to overcome the huge demographic imbalance that existed in Palestine during the early phases of the Zionist movement. It is instructive to recall that the Jewish presence in Palestine at the time of Balfour was no more than 5-7%. Such a small minority could not possibly succeed in establishing and dominating the government of a state that was to be ethnically oriented and yet democratic. Not a single Zionist expected the resident population to accept willingly such an outcome. Israel as a viable sanctuary for Jews escaping persecution necessarily depended on finding the right formula for combining armed struggle and political deception.

 

In this sense Balfour launched a project that was utopian from the Zionist point of view and dystopian from the Palestinian perspective. On the utopian side, establishing a Jewish state that could show a democratic face to the world seemed well beyond the horizon of feasibility. To attain the Zionist goal of a democratic Jewish state in Palestine ran directly counter to the anti-colonial historical tide in the 20th Century that swept away all in path elsewhere in the non-Western world. And then to overcome such a one-sided

demographic imbalance seemed a mission impossible no matter how much the Jewish diaspora was goaded into emigrating to Israel.

 

On the dystopian side as experienced by the Palestinians, the nakba dispossession and expulsion of about 750,000 Palestinians, reinforced by discriminatory immigration policy, rigid security policies, and by Zionist expansionism that continues to this day has inflicted a tragic destiny upon the Palestinian people. This kind of ethnic restructuring also was coupled with the legitimation of a settler colonial state, including by the United Nations, at a historical moment when colonialism was entering its sunset phase and the UN was supposed to reflect the moral will of the organized global community. This outcome was permanently disillusioned for the Palestinians, and involves a cruel and paradoxical twist to the long Palestinian ordeal.

 

As an American terrified by Trump and Trumpism I cannot refrain from noting the analogies with the efforts of this leadership to airbrush the Confederate past of the United States, featuring slavery, with broad strokes of moral relativism. Trump’s outrageous assertion that there were good people on the white supremacist side of the Charlottesville demonstrations and General John Kelly’s more recent obtuse contention that the American Civil War resulted from the failure of the two sides (North and South) to strike a compromise, as if a compromise with slavery was a preferred option. A rejection of this kind of high profile posturing is not only a matter of political correctness, it is much more a matter of elemental moral sensitivity and political vigilance then and now.

 

Without letting Britain off the Balfour hook, the main international culprits since 1945 are surely the United States and the UN, jointly and separately failing to produce a sustainable and just peace for both peoples. At this time such a peace will not be achieved by continued recourse to the two-state solution that with each passing Israeli settlement expansion becomes, at best, an empty slogan, and more realistically, a way of changing the conversation to avoid considering the step that alone could bring peace to both peoples: ending the apartheid structures that have fragmented, subjugated, and victimized the Palestinian people ever since the state of Israel was proclaimed in 1948. Until Israel is persuaded to dismantle its apartheid regime (as the racist South African regime was a decade earlier), peace diplomacy is bound to be a farce that does more harm than good. If this more realistic appreciation of the preconditions for peace between Palestinians and Israelis were to begin emerging on this day of remembrance, the Balfour century could at least claim to end on a more hopeful note than it began.

The One and Only Path to Palestine/Israel Sustainable Peace

 An Overview of Present Realities

 

We meet at a difficult time from the perspective of the Palestinian people: several developments nationally, regionally, and internationally now deprive Palestinians of that glimmer of hope that comes from seeing light at the end of the tunnel; more fully appraised, the situation is not as bleak for Palestinians as the picture of their struggle being painted from a realistic perspective. A series of factors pointing in both directions can be identified, first to highlight the negative developments from a Palestinian perspective, and then to set forth several developments that are positive with regard to the Palestinian national movement aiming for decades to achieve a just and sustainable peace.

(1) the foreign policy priorities of regional and international political actors have increasingly shifted attention away from the Palestinian ordeal; developments internal to Israel have deliberately accentuated this inattention to Palestinian goals and rights; of special relevance in these regards are the ongoing wars and turmoil in Syria, Yemen, Libya, and Iraq, as well as deteriorating relations and rising tensions of the Iran/US relationship; the moves toward normalization of relations with Israel by the Gulf countries, especially Saudi Arabia; and the unsteady diplomatic approach of the Trump presidency that seems accurately interpreted as supportive of whatever the Israeli government chooses to do, including even accelerated settlement expansion and a rejection of the Palestinian right of self-determination;

(2) Israel and Zionist support groups have launched a variety of initiatives designed to convince the Palestinians that they have been defeated, that their struggle is essentially futile at this stage, and they should move on for their own sake, overtly renouncing their struggle and posture of resistance; the pro-Zionist Middle East Forum, founded by Daniel Pipes has even sponsored a so-called ‘victory caucus’ that basically proclaims an Israeli victory as a way of demoralizing Palestinian activism and global solidarity efforts by treating Palestinian goals as a lost cause;

(3) accelerated Israeli settlement expansion without any adverse pushback from Europe or North America, a development that can be regarded as hammering the final nails into the coffin of ‘the two state solution;’

(4) the widespread recognition that more than 20 years of diplomatic effort within the Oslo framework failed miserably, with the Palestinians paying a heavy price in territory and credibility for engaging so avidly in a diplomatic process so heavily weighted against them; Oslo’s failure permitted Israel to encroach on Occupied Palestinian Territory in a variety of unlawful ways including especially extending the settlement archipelago, illegally building the separation wall on Palestinian occupied territory, and manipulating the ethnic balance in Jerusalem to make the city as a whole more Jewish;

(5) confronting a crisis of viability in Gaza, of both a material and psychopolitical character; not only continuing a decade long blockade that itself amounts to a crime against humanity, but stifling the dreams of young talented Gazans who against all odds have earned foreign fellowships and then are either denied exit permits or entry visas to carry on their studies abroad; this kind of acute frustration, long experienced by Gazans in many forms, is contributing to a new turn among Palestinian youth, who increasingly want to leave Gaza and pursue a more normal life for themselves and their families rather than remain under conditions of virtual captivity to resist and carry on the struggle for empowerment and liberation.

 

Despite all these considerations, there are aspects of the situation, often overlooked in mainstream media, which seem favorable to the Palestinian struggle:

(1) the morale boost that resulted from prevailing in the recent Al Aqsa confrontation concerning control of security arrangements at this site sacred for all Muslims, not just for Palestinians who are Muslim;

(2) a more serious renewal of efforts to bring unity to the relationship between Palestinian political tendencies, especially Fatah and Hamas;

(3) the growing global support for the BDS Campaign, achieving some high visibility successes prompting corporate disengagements from commercial projects related to unlawful Israeli settlements—G4S, Viola; and persuading some high visibility cultural figures not to perform in Israel—Pink Floyd

(4) Palestine is definitely winning the Legitimacy War waged to build stronger and more activist support from international public opinion; such support has been understood as far back as Gandhi as capable of neutralizing the superior military capabilities of a foreign political actor; throughout the decolonization era, the political outcome of struggles for control of state power were eventually won by the party on the right side of history, not as in the 19th Century by the party enjoying military superiority, which in the second half of the 20th century continued to make colonized people suffer greatly, but no longer able to impose their political will; Zionist/Israeli reaction to this set of developments relating to legitimacy has been to shift the conversation about Israel/Palestine relations from the defense of Israeli practices and policies and away from the substance of Palestinian grievances and rights to mount an attack on the motives of those criticizing Israel’s policies and practices, alleging that Israel’s critics are motivated by anti-Semitism, a smear tactic that also is encroaching on academic freedom, but exposing the weakness of Israel’s position on the merits. Internally, the Israeli public discourse is much more focused on the opportunity of fulfilling the maximalist Zionist goal of incorporating the whole of ‘the promised land’ of biblical Israel into the modern state of Israel;

(5) It is my judgment that the biggest development favorable to the Palestinians has been a shift in the public discourse and the articulation of Palestinian demands of peace and solidarity activists from the slogan ‘End the Occupation’ to a clarion call to ‘End Apartheid.’ This shift has been recently legally validated by a UN-sponsored academic study of whether the claim that Israel is an apartheid state stands up to scholarly scrutiny.

 

 

 

The ESCWA Report

 

The UN Report of the Economic and Social Commission for West Asia (ESCWA) entitled “Israeli Practices and the Question of Apartheid” issued a few months ago, and co-authored by myself and Virginia Tilley, a renowned world expert on apartheid and a political scientist on the faculty of the University of Southern Illinois. ESCWA is a regional commission of the UN composed of 18 Arab states, with headquarters in Beirut. The Report was requested by the member states, and we were invited to prepare the report in accordance with academic standards by the Secretariat of ESCWA. The Report was never intended to become an official UN document, but rather the presentation of the views of two scholars with a background presumed relevant for the preparation of such a study:

–the issuance of the report had two immediate effects: first, it immediately became the most widely read and requested report in the history of ESCWA, and secondly, it produced a firestorm at the UN due to harsh criticisms by the U.S. and Israeli representatives who demanded that the Report be formally repudiated, attacking its authors, and insisting that the UN take prompt action or face the defunding consequences;

–the new UN Secretary General, Antonio Gutterez, dutifully responded by instructing ESCWA to remove the Report from its website; the director of ESCWA, Rima Khalaf, refused to follow such an order, believing in the contents and propriety of the Report; in the end she chose to resign rather than submit to UN censorship, explaining her position in an Open Letter to the SG;

–at this point it is not clear what the status of the Report is within the UN System; it has not been officially repudiated, and in fact the 18 foreign ministers representing the members of ESCWA endorsed the conclusions and recommendations of the Report, and urged their acceptance within the UN; I have no idea as to whether such a response will have any impact;

–as indicated the Report was an academic study, although of an admittedly controversial character; prior to its release, the Report was anonymously vetted by three world class scholars each of whom strongly recommended publication; as well, the report contained a disclaimer that stated that the recommendations and conclusions of the Report were those of the authors alone and did not represent the opinions of the UN or ESCWA; and in fact, the Report has to date received no substantive criticism from those who mounted the UN attack or otherwise; it was a pure show of geopolitical leverage that exposed the weakness of international law and the fragility of open discussion of sensitive issues at the UN;

–it is my judgment that the Report is significant for three distinct reasons:

         <(1) The Report considers whether the allegation of Israeli apartheid is backed by sufficient evidence and persuasive legal reasoning in relation not just to the West Bank, as has been frequently alleged in the past, but in relation to the Palestinian people as a whole; such an inquiry means that if apartheid is declared to exist it applies to Palestinians living in Jerusalem, as a minority in Israel, and in refugee camps in neighboring countries as well as to Palestinians living in occupied Palestine or as involuntary exiles throughout the world; the central legal finding is that Israel has established an integrated matrix of control over the Palestinian people as a people so as to maintain the Israeli state as ‘a Jewish state’ in the face of continuous Palestinian resistance for the entire period of Israel’s existence;

         <(2) The Report reaches its conclusions by relying on scholarly methods of analysis, and by examining and interpreting the evidence of Israeli policies and practices in relation to the relevant norms of international law as contained in the 1973 International Apartheid Convention. The essential finding we reached was that Israel intentionally and continuously was responsible for ‘inhuman acts’ as the means by which to subjugate the Palestinian people as a subordinated ‘race.’ This enabled Israel to govern in a discriminatory fashion as ‘a Jewish state;’ in our judgment the Palestinian people were deliberately fragmented so as to facilitate the maintenance of control over a resisting, initially majority non-Jewish population; this ambition to control Palestine was complicated by the additional Zionist objective of seeking to be and be seen as ‘a democratic state;’ such an objective, given the demographic imbalance, virtually necessitated at the inception of Israel as a state, the expulsion of several hundred thousand Palestinians and the destruction of hundreds of Palestinian villages to discourage any prospect of Palestinians returning after the war to reclaim their places of residence and way of life; such exclusion was seen as vital if Israel was to achieve and maintain a Jewish majority population within its borders; the Zionist puzzle, tragic for both peoples, was that only apartheid structures could provide a solution to this three-sided challenge—that is, establishing Israel as simultaneously Jewish, democratic, and hegemonic;

         <(3) this Report has been widely used since its publication, and especially to provide political support and intellectual guidance mandating a civil society shift in tactics and commentary from a focus on ‘ending occupation’ to ‘ending apartheid;’ in my view, this is a crucial and timely shift as international law and the UN had been long ignored by Israel, diplomacy and armed struggle had been tried futile and utterly failed, and Palestinian leadership, such as it is, has faced both a series of stone walls and the humiliation of the notorious separation wall declared contrary to international law by 14 of 15 judges of the International Court of Justice. In effect, there is no serious alternative for Palestinians (and even Israelis) committed to a peaceful future than to rid the Israeli/Palestinian relationship of its present apartheid character.

 

 

Clearing the One and Only Path to a Just and Sustainable Peace

–peace between these two peoples can only be achieved by a credible acknowledgement of their equality of rights with respect to national self-determination; the apartheid structures that currently subjugates Palestinians epitomizes a relationship of inequality; the core obstacle to peace is apartheid, and once this obstacle is removed a productive diplomacy will become possible so long as it proceeds at all stages on the basis equality, keeping in mind that Oslo diplomacy collapsed because it encoded inequality into every aspect of its framework (U.S. as intermediary, excluding international law) and by adopting a bargaining process that favored Israel due to disparities in power and influence;

<the overriding political challenge is how to clear this path to peace, given Israeli firm control and resistance to even the acknowledgement of apartheid as descriptive of the current relationship between the two peoples; Israeli apartheid cannot be ended without a reformulation of Zionist goals; Israel must be persuaded to become content with an existence within a secular state hosting a Jewish homeland; such an altered stance would require abandoning the insistence on being a Jewish state; such a downsizing of Zionist objectives would actually be consistent with the scope of the original British pledge as set forth in the ultra-colonialist Balfour Declaration (recent archival research evidently establishes that a Jewish homeland was actually the longer term intention of Lord Alfred Balfour, as if this matters a century later); Israeli apartheid will not be dismantled until there is significant further growth of the Palestinian global solidarity movement, including the backing of some governments, especially several key governments in the global South; there would need to be sufficient, sustained global pressure to induce Israeli leaders and citizens to recalculate their interests, leading enough to decide to base their future on cooperation and coexistence with the Palestinians rather than their domination and exploitation; at this point, such an outcome seems unlikely and even utopian, but history has a strange way of staging dramatic surprises, and in such cases where an abrupt reversal of policy takes places, it will be only be admitted as a possibility after it has already been decided upon;

<The South African ending of apartheid was precisely such a surprise; it was totally unexpected in the 1990s that the combination of African resistance and the global anti-apartheid campaign would produce a peaceful transition to a multi-racial constitutional democracy presided over by Nelson Mandela, who until his release was serving a long-term prison sentence as an alleged terrorist; what changed so abruptly in South Africa was not the moral stance of the white elite that had invented and cruelly imposed the apartheid structure as a supposedly permanent solution to race relations in the country, but rather a cold recalculation of interests, and especially a comparison of the balance of advantages and disadvantages of continuing to exist as a pariah state in the world and abandoning apartheid, thereby risking African governance and possible retaliation, yet by so risking, taking a course that would alone restore the international legitimacy of the South African state;

<Of course, there are many differences in the Israeli situation, including Israel’s disavowal of apartheid as relevant to its management of the relationship between the two peoples, as well as Israel’s considerable success in avoiding pariah status within the international community through the practice of sophisticated diplomacy and public relations, backed by an aggressive arms sales program, and above all, by being the beneficiary of the geopolitical muscle of the U.S., as well as enjoying the quieter support of Europe;

<By adopting the apartheid paradigm as descriptive of the Palestinian situation it becomes possible to align civil society activism with international law, and even more important, encouraging the Palestinian national movement to concentrate its efforts on the one and only path that could produce an acceptable peace agreement. Any other approach seems doomed to some kind of appalling continuation of the present oppressive daily circumstances that has been fate of the Palestinian people for far too long. We should all reflect on the excruciating reality that this is the 50th anniversary of the Occupation and the 70th year in which Palestinians and their descendants have lived as refugees. No people should be compelled to endure such a fate.

 

 

Conclusion

 

It requires no great wisdom to observe that the future is a black box. We know that achieving peace and justice for these two peoples will require a lengthy struggle that needs to place its trust in ‘a politics of impossibility,’ or as the poet W.H. Auden once put it: “We who are about to die demand a miracle.” And while awaiting such a political miracle, we should accept our human responsibility to aid and abet the Palestinian struggle for rights, self-determination, and a just peace. The attainment of such goals would also inevitably reshape the destiny of Israeli Jews toward a more humanistic and benevolent future.

Apartheid and the Future of Israel/Palestine

[Prefatory Note: There has been lots of discussion prompted by the release of a report jointly authored with Prof. Virginia Tilley, a study commissioned by the UN Economic and Social Commission for West Asia (ESCWA), and given by us the title, “Israeli Practices towards the Palestinian People and the Question of Apartheid.” The interview, associated with my current visit to Belgium and France to speak on various aspects of the analysis and implications of the report, brings up to date the controversy generated at the UN by its release a few months ago, and by the willingness of the UN Secretary General to bow to U.S. pressure and order the removal of the report from ESCWA website. The interview questions were posed by veteran Middle East correspondent, Pierre Barbancey, and published in l’Humanité, Sept. 6, 2017.]

 

 

 

1 YOU HAVE PUBLISHED A REPORT: WHO ASKS FOR THAT AND WHY?

 

The Report was commissioned by the UN Economic and Social Commission for West Asia in 2016 at the request of its Council, which has a membership of 18 Arab states. Professor Virginia Tilley and I were offered a contract to prepare a report on the applicability of the crime of apartheid to the manner in which Israeli policies and practices affected the Palestinian people as a whole, and not as in previous discussions of the applicability of apartheid, only to those Palestinians living since 1967 under Israeli occupation. The originality of the Report is to extend the notion of apartheid beyond the Occupied Palestinian Territories, and investigate its applicability to Palestinians living in refugee camps in neighboring countries, to those Palestinians enduring involuntary exile abroad, and to those existing as a discriminated minority in Israel.

 

2) What are the conclusions of the ESCWA Report?

 

The most important conclusion of the Report was that by careful consideration of the relevant evidence, Israel is guilty of the crime of apartheid as defined in the 1976 International Convention on the Suppression and Punishment of the Crime of Apartheid with regard to the Palestinian PEOPLE AS A WHOLE, that is, Palestinians living under occupation as refugee and in involuntary exile, and as a minority in Israel are all victimized by the overriding crime. The Report also found that Jews and Palestinians both qualify as a ‘race’ as the term is used in the Convention, and that Israel to sustain a Jewish state established by ‘inhuman acts’ a structure of oppressive and discriminatory domination by which the Palestinians were victimized as a people.

 

A second conclusion of importance is that the Rome Statute governing the International Criminal Court considers apartheid to be one type of ‘crime against humanity,’ which does not necessarily exhibit the same features as pertained to the apartheid regime in South Africa, the origin of the concept and crime, but not a template for its subsequent commission.

 

A third conclusion is that given the existence of apartheid, sustained to maintain a Jewish state in Palestine, all sovereign states, the UN, and civil society all have a legally grounded responsibility to take all reasonable steps of a nonviolent character to bring the commission of the crime to an end.

 

A fourth conclusion is that the Report is an academic study that draws conclusions and offers recommendation on the basis of a legal analysis, but it is not a duly constituted legal body empowered to make formal findings with respect to the allegations that Israel is guilty of apartheid.

 

 

 

3) WHAT WAS THE REACTIONS?

 

We experienced two contradictory sets of reactions.

 

From ESCWA the report was received with enthusiasm. We were told it was the most important report that ESCWA had ever published, with by far the largest number of requests for copies.

 

At the UN, the report and its authors were strongly attacked by the diplomatic representatives of the United States and Israel, with the demand the UN acted to repudiate the report. The Secretary General instructed the Director of ESCWA to remove the report from its website, and when she refusing, she tendered her principled resignation explained in an Open Letter to the Secretary General. It should be appreciated that this was an academic report of international law experts, and never claimed to be an official reflection of UN views. A disclaimer at the outset of the Report made this clear.

 

4) WHAT HAPPENED NOW WITH THE REPORT?

 

The status of the report within ESCWA is not clear. As far as I know the report itself has not been repudiated by ESCWA. In fact, it has been endorsed in a formal decision of the 18 foreign ministers of the ESCWA countries, including a recommendation to other organs of the UN System that the findings and recommendations of the Report be respected. Beyond this, the report has altered the discourse in civil society and to some extent, in diplomatic settings, making the terminology of ‘apartheid’ increasingly displace the emphasis on ‘occupation.’

 

 

5) ISRAEL SAYS THAT THE BDS MOVEMENT IS ANTI-SEMITIC. WHAT IS YOUR ANSWER?

 

This is an inappropriate and even absurd allegation. The BDS Campaign is directed against Israeli policies and practices that violate international law and cause great suffering to be inflicted on the Palestinian people. It has nothing whatsoever to do with hostility to Jews as persons or as a people. The allegation is clearly designed to discredit BDS and to discourage persons from lending it support or participating in its activities. It is an unfortunate and irresponsible use of the ‘anti-Semitic’ label designed to manipulate public opinion and government policy, and inhibit activism.

 

6) IN FRANCE YOU CAN BE PUT IN COURT IF YOU ACT FOR BDS, LIKE A CRIME. DO YOU HAVE ANY KNOWLEDGE OF SIMILAR SITUTIONS IN OTHER COUNTRIES?

 

I know there have been efforts in Europe and North America to criminalize support for BDS, but so far as I know, no formal laws have yet been brought into existence, and no indictments or prosecutions, outside of Israel and France, have taken place. I am not entire clear as to what has happened in Israel along these lines, although I know that Israel has been denying BDS supporters from abroad entry into the country.

 

7) WHAT IS YOUR EXPERIENCE AS SPECIAL REPORTEUR OF THE UNITED NATIONS IN THE PALESTINIAN TERRITORIES AND IN ISRAEL?

 

My experience as UN Special Rapporteur in Occupied Palestine on behalf of the Human Rights Council was both frustrating and fulfilling. It was frustrating because during my six years as SR the situation on the ground and diplomatically worsened for the Palestinian people despite the documented record of Israeli human rights abuses. It was fulfilling because it enabled a forthright presentation of Israeli violations of basic Palestinian rights, which had some influence on the discourse within the UN, building support for corporate responsibility in relation to commercial dealing with Israel’s unlawful settlements on the West Bank and East Jerusalem as well as shifted some of the discourse within the UN from ‘occupation’ to ‘settler colonialism’ and ‘apartheid.’

 

It was also something of a personal ordeal as I was constantly subject to defamatory attacks by UN Watch and other ultra Zionist NGOs and their supporters, also organizing efforts to have me dismissed from my UN position and barred from lecturing on university campuses around the world. Fortunately, these efforts failed by and large, but they did have the intended effect of shifting the conversation from substance to auspices, from the message to messenger.

7) 70 YEARS AFTER THE DIVISION OF PALESTINE BY THE UNITED NATIONS  HOW DO YOU SEE THAT DECISION?

 

The1947 partition resolution [GA Res. 181] was part of the exit strategy of the British colonial administration in the mandate period that controlled Palestine after the collapse of the Ottoman Empire at the conclusion of World War I. This approach was flawed in several basic respects: it neglected the will of the majority Arab and non-Jewish domestic population, and imposed a solution to the conflict without consulting the inhabitants; it also within its own terms failed to secure Palestinian rights or its sovereign political community, or even to uphold international humanitarian law. The UN never effectively implemented partition, and thus gave Israel the de facto discretion to impose its will on the entire territory of Palestine, including the expulsion of 750,000 Palestinians in the 1947 War, which overcame the demographic imbalance, and allowed itself to be branded to this day as ‘a democracy,’ even being hailed as ‘the only democracy in the Middle East.’ The US and Europe played a crucial geopolitical role in producing these developments, which rested on an Orientalist mentality lingering in the West.

8) IS THERE A SOLUTION FOR THE PALESTINIAN TO RECOVER THEIR RIGHTS AND TO LIVE IN THEIR OWN STATE?

 

It is difficult to envision the future at this stage, yet it is clear that the Palestinian national struggle is continuing both in the form of Palestinian resistance activities and by way of the international solidarity movement, of which the BDS Campaign is

by far the most important undertaking. In my judgment until there is exerted enough pressure on the Israeli government to change course drastically, signaled by a willingness to dismantle the laws and procedures associated with the current apartheid regime used to subjugate the Palestinian people, there is no genuine prospect for a political solution to the conflict. Such a change of course in South Africa occurred, against all expectations at home and abroad, and partly in response to pressures generated by this earlier version of an international BDS campaign. My hope is that as the Palestinian people continue to win the ongoing Legitimacy War, this pattern will eventually be repeated, leading after a prolonged struggle to a sustainable peace between these two peoples based on the cardinal principle of equality. This will not happen, tragically, until there is much suffering endured, especially by Palestinians living under occupation, in refugee camps and involuntary exile, and as a discriminated minority within Israel. This Palestinian ordeal has gone on far too long. Its origins can be traced back at least a century ago when in an undisguised colonial gesture of the British Foreign Office pledged its support for the establishment of a Jewish homeland in historic Palestine to the World Zionist Movement in the form of the Balfour Declaration (1917). The competing national narratives of what transpired over the subsequent century tell different stories, each with an authentic base of support in the relevant community, but only the Palestine narrative can gain present comfort from the guidelines of international law, above all, the inalienable right of self-determination
