The Middle East is Heating Up — Again: An Interview with Richard Falk (with C.J. Polychroniou)

 

[Prefatory Note: This is a somewhat modified text of an interview of two weeks ago conducted by the Greek journalist and author, C.J Polychroniou. Since then several developments have occurred, none more significant than the Return Home Land Day demonstrations of March 30, 2018. The original interview appeared in several online publications. The format is altered to make somewhat more reader friendly.]

 

CJP: Richard, let’s start with Donald Trump’s decision to officially recognize Jerusalem as Israel’s capital and to move the US embassy there by May of this year. First, is this legal from the standpoint of international law, and, second, what are likely to be the long-term effects of the US recognition of Jerusalem as Israel’s capital on the region as a whole?

 

RF: There is no question, Chronis, that Trump’s Jerusalem policy relating to recognition and the move of the American embassy is regionally and religiously provocative and disruptive, underscoring the abandonment by Washington of even the pretense of being a trustworthy intermediary that can be relied upon by both sides to work for a sustainable peace between the two peoples. Some critics of the initiative are saying that the U.S. is free to situate its embassy in Jerusalem, but the whole of Jerusalem isn’t Israel. The status of this holy city remains to be determined and East Jerusalem, where the Old City is located, which for the present is considered to be an ‘occupied territory’ in international humanitarian law.

 

Recognition of Jerusalem as the capital of Israel is a clear violation of international humanitarian law, which rests on the central proposition that an occupied territory should not be altered in any way that changes its status and character without the consent of the occupied society. It also is a unilateral rejection of a near unanimous international consensus, endorsed by the United Nations, that the future of Jerusalem should be settled by negotiations between the parties as a part of a broader peacemaking process. Israel had much earlier violated both international law and breached this international consensus by unilaterally annexing an enlarged Jerusalem, and declared that the whole city, within expanded boundaries, would be the ‘undivided, eternal capital’ of Israel. It is notable that the General Assembly on December 21, 2017 approved by an overwhelming majority of 128-8 (35 abstentions) a strong condemnation of the U.S. move on Jerusalem, with even America’s closest allies joining in this vote of censure.

 

It is difficult to predict the long-term consequences of this diplomatic rupture. It depends, above all, on whether the U.S. Government acts convincily to restore its claim to act as a conflict-resolving intermediary. The Trump administration continues to insist that it is working on a peace plan that will require painful compromises by both Palestine and Israel. Of course, given the unconditional alignment of Washington with Netanyahu’s views of Israel and the Palestinian future, as well as the orientation of those entrusted with drafting the plan, it is highly unlikely that even Mahmoud Abbas and the Palestinian Authority, generally accommodationist will be inclined to enter a diplomatic process that is virtually certain to be weighted so heavily in favor of Israel. Yet as many have come to appreciate, nothing is harder to predict than the future of Middle Eastern politics.

At the same time, Jerusalem has an abiding significance for both Islam and Christianity that makes it almost certain for the indefinite future that there will be formidable regional and civilizational resistance to subsuming Jerusalem under Israeli sovereign control.

CJP: Israel appears bent on restricting Iran’s rising influence as a regional power in the Middle East. How far do you think the US can go in assisting Israel to contain Tehran’s strategy for empowering Shia’s?

 

Richard Falk: Israel and Saudi Arabia are both for different reasons determined to confront Iran, and quite possibly, initiate a military encounter with potentially widespread ramifications for the entire region, if not the world. A quick glance at the Syrian conflict suggests how complex and dangerous is this effort to destabilize the Iranian governing process, with the dual objectives of destabilizing the governing process mixed with the more ambitious goal of causing civil strife of sufficient magnitude as to produce a civil war, and ideally from the perspectives of Iran’s adversaries, regime change.

 

The Israeli adherence to this recklessness seems partly motivated by its overall security policy of seeking to weaken any country in the region that is hostile to its presence and has the potential military capability to threaten Israeli security and regional role in a serious manner. Israel has been so far successful in neutralizing each of its credible adversaries in the region (Saudi Arabia, Iraq, Egypt, Syria) with the exception of Iran. In this sense, Iran stands out as the last large unfinished item on Israel’s post-1967 geopolitical agenda. Israel’s real intentions are difficult to pin down, shifting with context and perceived opportunity. Netanyahu and other Israeli leaders frequently manipulate the alleged Iranian threat to cause fear among Israelis. Their goal seems to be the mobilization of domestic support for adhering to an aggressive foreign policy. This manipulation panics many Israeli security specialists who express are more alert to the risks of an actual military confrontation with Iran than are political leaders.

 

Saudi motivations are quite different, associated with a fierce regional rivalry that is articulated in terms of a sectarian clash between Shia and Sunni Islam, aggravated by a concern that Iran’s influence increased as a result of the Iraq and Syrian Wars, which both seem to have outcomes favorable to Tehran. The sectarian rationale of the conflict seems intended to disguise the more fundamental explanation, which is that there is a power struggle between these two sovereign states to determine which one will achieve regional ascendancy. The sectarian explanation was also somewhat undermined by the intensity with which the Saudis and other Gulf monarchies used their financial and diplomatic resources to crush the Muslim Brotherhood in Egypt despite its strong Sunni identity. From the time of the Iranian Revolution in 1979 Tehran looked upon the monarchy governing Saudi Arabia as corrupt and decadent in the same manner as it regarded the Shah’s dynastic rule in Iran as politically illegitimate.

 

Your focus on how far the U.S. can go in restricting Iran’s influence is difficult to assess at this point. Trump’s virtual repudiation of the agreement on Iran’s Nuclear Program seems to express a commitment to join with Israel and Saudi Arabia to engage in coercive diplomacy, consisting of intensifying sanctions, covert operations to encourage internal opposition, and a variety of military threats. Where this will lead, if indeed it goes forward in defiance of the other parties to the agreement and almost all UN members, is anybody’s guess, but it is a highly irresponsible diplomatic gambit that risks a deadly ‘war of choice.’

 

Trump’s regional diplomacy, such as it is, has been most notable for giving even greater emphasis to the ‘special relationships’ with Israel and Saudi Arabia than earlier American leaders. Even previously, under Obama, George W. Bush, and prior presidents, the subordination of American strategic interests and national values to this posture of unquestioning support, which is the operational significance of designating these links as special relationships.

 

 

 

CJP: Syria’s civil war not only continues unabated but the country has become a battlefield for the spread of the influence of various powers in the region, including Turkey and Russia. Do you see a way out of this mess?

 

Richard Falk: The Syrian War is among the most complex conflict patterns in the history of warfare. Not only is there an internal struggle for control of the Syrian state that has been waged by not one, but by several insurgent movements that are not even compatible with one another. There is also a regional proxy war pitting Saudi Arabia, UAE, and Qatar against Iran, with Turkey playing a confusing role that sometimes seems guided by anti-Damascus goals but at other times is preoccupied with curtailing the Kurdish challenge. The various national struggles of the Kurds for autonomous rights, possibly independent political communities, threatens the territorial integrity of several Middle Eastern states, as well as Syria. In addition to all of this there are major multi-faceted and fluid Russian and American involvements on opposite sides, although not even this opposition is clear cut and consistent. For a time there was an almost collaborative effort to defeat ISIS and obtain a Syrian ceasefire, although the basic involvement has been to put Russia on the side of the Damascus government and the U.S. as aligned with the insurgencies.

 

Because the anti-ISIS dimension of the conflict is at odds with the anti-Damascus dimension, depending on the priority accorded to one rather than the other, alignments are contradictory and shifted over time. Sometimes precedence has been given to achieving regime-change in Damascus by removing Assad from power, and in such contexts, it was acknowledged silently that ISIS was the most effective military challenge on the ground being mounted against the Syrian government. At other times, the counterterrorist campaign against ISIS was given uppermost prominence, and there was even high-level indications that Washington was willing to live with the Assad regime, a position given added credence recently due to the success of the Syrian government in quelling its opposition, making continued opposition futile politically and irresponsible ethically. Whenever pragmatism gained the upper hand, Russia and Iran were accepted as partners in these efforts to defeat and destroy ISIS.

 

All wars eventually come to an end, and I am sure Syria will not be an exception. Yet it difficult at present to project a solution that brings about more than a ceasefire, and even this kind of ending of what has become an orgy of senseless killing is highly elusive, as each of the many parties to the conflict jockeys violently for minor positional advantages to improve its bargaining leverage when the conflict enters some kind of negotiating phase. Although all wars end eventually, internal wars of this kind, especially with such complex regional and international aspects, can simmer for decades with no clear winner or loser as has been the case in the Philippines and Colombia. It seems as if at present the Syrian government believes it is on the verge of victory, and is pressing for an outcome in East Ghouta and Idlib such that it will not be expected to make significant concessions.

 

The best hope, which has been the case for several years, is that the various parties will recognize that the situation is indeed a mess that is causing mass suffering and widespread devastation without producing political gains. Yet translating that recognition into a formula that produces an end to the violence has so far proved futile and frustrating as each party sees the conflict from its partisan perspective of gain and loss.

 

 CJP: With the two-state solution having ceased long ago being a viable alternative, what are the most likely prospects for the future of Israeli-Palestinian relations?

 

Richard Falk: The safest response is to anticipate a persistence of the present status quo, which involves continuing Israeli expansionism by way of the settlements and the persistence of the Palestinian ordeal, with some resistance in the occupied West Bank, Gaza, and East Jerusalem and a growing global solidarity movement exerting pressure on Israel in the form of the BDS campaign. There may be some attention given to a variety of proposals to end the conflict by revived diplomacy. The Trump blustery promise of ‘a deal of the century’ has received skeptical attention, but its likely one-sidedness makes it almost certain to be a non-starter, especially as the Israeli government feels insufficient pressure to produce a peaceful solution based on a genuine political compromise and the Palestinian Authority remains unwilling to accept a demilitarized statelet as a token Palestine state, or even to participate in negotiations that are so obviously stacked against it. For public relations reasons, the international consensus clings to the two-state solution even though, as your question suggests, its viability has long been superseded by Israeli expansionist policies intended to fulfill the Zionist goal of making the boundaries of Israel coterminous with the whole of the Jewish biblical conception of the ‘promised land.’

 

There are other outcomes that are possible. Daniel Pipes has been promoting what he dubbed ‘the victory caucus,’ which posits Israel as the victor in the struggle to establish a Jewish state and Palestine the loser. Pipes argues that diplomacy has failed to resolve the conflict after years of effort, and hence that the only alternative is for one side to win and the other to lose if peace is to be established. He encourages Israel to escalate pressure on the Palestinians to make them see the light, accept the reality of a Jewish state, and move on. Such an initiative is distasteful to those who support the Palestinian struggle, and it seems oblivious to the claims of international law and international morality as these are generally understood in the 21st century when colonialism and ethnic nationalism are illegitimate forms of political control and the right of self-determination has become universally accepted as an inalienable right of an oppressed people in the circumstances of the Palestinians.

 

In my view, neither the two-state nor a consensual one-state outcome of the struggle is currently within the realm of political feasibility. We are necessarily speculating about future political scenarios within the domain of ‘political impossibility.’ Yet the impossible sometimes happens. Colonialism was successfully challenged, the Soviet Union collapsed, South Africa renounced apartheid, the Arab Spring erupted. In none of these cases did such occurrences seem possible except in retrospect. After the events, as expected, experts appeared who explained why these impossible developments were, if closely considered, inevitable.

 

In this spirit, I think it useful to acknowledge the limits of rational assessment, and either remain silent, or offer for consideration, a solution that is ‘impossible,’ yet ‘desirable’ from the perspective of humane values, which in this case involves a secure, equitable, and sustainable peace for both peoples that is, above all, sensitive to their equality and to their distinct, yet legitimate, claims to self-determination. I find it unimaginable to realize such a peace within the current structure of the Middle East, which consists of a group of artificial and autocratic states held together by varying mixtures of coercion, corruption, and external military assistance. Israel/Palestine peace cannot unfold in a benevolent manner without a structural return to the Ottoman framework of regional unity and ethnic community, and possibly Islamic caliphate, adapted to post-colonial realities. Such a stateless Middle East would reverse the harm inflicted on the region by the imposition of European territorial states through the infamous Sykes-Picot diplomacy.

 

 CJP: South Africa’s former apartheid system has been employed analytically by many to describe the current status of the state of Israel with regard to it’s treatment towards Palestinians. Indeed, it is from such a comparison that the Boycott, Divestment and Sactions (BDS) movement was borne, but to what extent are the two cases compatible? South Africa was pretty much isolated by the early 1980s, but the same cannot be said about Israel today. In fact, Israel has even managed to expand recently it’s network of allies with Greece and the Sunni states. So, what are your thoughts on the comparison between the former South African apartheid regime and Israel and the effectiveness of the strategy of BDS?

 

RF: Your question raises two distinct issues: Is Israel responsibly regarded as an ‘apartheid state’? If so, is Israeli apartheid similar to South African apartheid?

 

Prior to responding to these questions, it seems helpful to clarify the status of the international crime of apartheid as it has evolved in international law, taking particular note of the fact that although the name and core idea is based on the specific condemnation of South African racism, the international crime is detached from this precedent. The essence of the international crime is any form of discriminatory domination by one race over another that relies on ‘inhuman acts’ to sustain its purposes. In this important sense, Israeli forms of domination over the Palestinian people may be quite different than the domination of whites over blacks in South Africa and yet constitute the international crime of apartheid. Treating apartheid as an international crime is based both on the 1973 International Convention on the Suppression and Punishment of the Crime of Apartheid and on the 2002 Rome Statute governing the operations of the International Criminal Court that categorizes ‘apartheid’ in Article 7 as one of eleven types of Crime Against Humanity.

 

In a study commissioned by the UN Economic and Social Commission, Virginia Tilley and I concluded that the policies and practices of Israel toward the Palestinian people as a whole satisfy the requirements of the international crime of apartheid. Our conclusion is based on the view that Israel, to maintain an expanding Jewish state has subjected the Palestinian people to structures of subjugation and victimization that are sustained by excessive violence and other inhuman means. It was our judgment that Jews and Palestinians are distinct ‘races’ as the term is understood in international law. The scope of Israeli apartheid is based on coherent strategies designed to subjugate the Palestinian people whether they are living under occupation, the most obvious case, or as a discriminated minority within Israel or as residents in refugee camps in neighboring countries or living is a global diaspora as involuntary exiles. Each of these domains is connected with the Israeli efforts to ensure not only the prevalence of a Jewish state, but also a secure Jewish majority population that could only be achieved by a process of dispossession, dispersion, and fragmentation, as well as by the denial of any right of return.

 

South African apartheid was very different in its operation as compared to Israeli apartheid. For one thing, white South Africa was a minority demographic in the country and critically dependent on black labor. For another, the South African concept of law, citizenship, and democracy was delineated along racial lines, while Israel claims to be an inclusive democracy, although is more accurately understood to be an ethnocracy. Despite these fundamental differences, the core reality of ‘inhuman acts’ and ‘discriminatory structures of domination’ are present, although distinctly enacted, in both national settings.

 

Finally, it should be understood that such allegations of Israeli apartheid are made on the basis of academic study, and while they may be persuasive morally and politically, it is also true that until a valid tribunal passes judgment on such allegations, the legal status of the allegations remains unresolved, and is of course feverishly contested by Israel and its supporters.

 

CJP: Overall, what are the prospects for restored stability and a positive future for the countries in the Middle East?

 

RF: Without the intervention of unanticipated developments, the prospects are poor. On one level, the extreme turmoil in countries such as Syria, Yemen, Iraq, and neighboring Libya are likely to continue and could spread to additional states. On a second level, the regional rivalries between Iran and a Saudi led coalition on the one side and Israel on the other, seem likely to intensify. On a third level, there is no plausible scenario for establishing a sustainable peace between Israel and the Palestinian people. On a fourth level, with the reassertion of Russian engagement and the U.S. pursuit of a strategic agenda related to Israel, oil, political Islam, Iran, and nuclear nonproliferation, the region has as in the Cold War become a site of dangerous geopolitical maneuver and confrontation. On a fifth level, perhaps less serious than the others, is the sort of intra-regional tensions that have given rise to the Gulf Crisis centered upon the relations of Qatar to other Gulf countries, and to the role of Turkey as partner and antagonist, especially in relation to the continuing search of the Kurdish peoples for self-determination. Finally, on a sixth level, there is almost certain to be new expressions of internal strife and various extremisms that strike against the West, inviting retaliation, which will probably be accompanied by further migratory flows that aggravate relations between the Middle East and Europe.

 

The drastic and prolonged victimization of the Middle East also exhibits the failure of the West to understand, much less address, the root causes of conflict and chaos that have produced mass suffering and material deprivations throughout the region. These root causes can be traced back at least a century to the imposition of European style states on the region, reflecting colonial ambitions, in the aftermath of World War I and by way of a colonial pledge to the world Zionist movement to support the establishment of a Jewish homeland in Palestine, then inhabited by a Jewish minority not larger than 6%. The other principal root cause related to the abundance of oil in several parts of the Middle East, which created rentier mentalities in development contexts and provided strong strategic motivations for intervention and control by global political actors.

 

In the end, this complexity joining the historical past to the tormented past creates a dismal set of prospects for the future of the Middle East. At this point, only paradoxical, although unrealistic, hopes for prudence and moderation can make the portrayal of the situation less gloomy than the evidence and trajectory suggest.

After the Interview: A Postscript on the Land Day Massacre (‘Great March of Return’)

 

The precise statistics remain inconclusive, although there exists general agreement that more than 15 Palestinians were killed by live ammunition fired by Israeli snipers stationed at the border with Gaza, another estimated 750 Palestinians were injured by ammo and rubber bullets resulting in an estimated total of 1,500 injuries, including from tear gas dropped on the largely unarmed demonstration. Whether the Israeli behavior should be viewed as ‘excessive force’ or ‘collective punishment,’ or both, is a matter for debate, but there is no question that the killings and firepower were in direct conflict with Israel’s obligations as an Occupying Power as specified in the Fourth Geneva Convention. Israel’s ‘disengagement’ in 2005 did not end the occupation from the perspective of international humanitarian law, but rather rearranged its management, with control and deployments being concentrated on the borders rather than throughout Gaza, and reinforced by periodic massive military incursions causing large numbers of civilian casualties and widespread devastation.

 

This latest interaction returned the Palestinian litany of grievances to the front pages of the world’s media often accompanied by gruesome pictures, but also revealed two kinds of gaps: between the Western and non-Western media and between the mainstream media response and that of civil society. The mainstream media worries that this is a public relations setback for Israel and urges restraint on both sides. In contrast, the activist segment of civil society condemns the Israeli tactics as constituting a massacre, and calls for an arms embargo. This distinction at the level of response is revealing, with the mainstream and almost every Western government pinning their public hopes on reviving negotiations aiming at a political solution based on the establishment of a sovereign and independent Palestine. Engaged civil society has lost all faith in diplomacy under current conditions, believes only escalating nonviolent pressure can change the political climate sufficiently to make negotiations sufficiently promising to undertake, and then only if the two-state mantra is abandoned once and for all.

 

 

 

 

Recognizing Jerusalem as Israel’s Capital

[Prefatory Note: The following post is a modified version of an article published on December 8th in Middle East Eye. It considers the normative and geopolitical sides of Trump’s unilateralism. Apologists claiming Trump finally acknowledged the operational reality that Jerusalem has been serving as the capital of Israel for the last 50 years, and the disruptive effects have been exaggerated as Saudi Arabia has not reacted in a strongly negative manner. Critics, including myself, regard the initiative as a gratuitous slap at the Palestinians and a further confirmation of Trump’s disregard of international law, international morality, and the authority of the United Nations. The status of Jerusalem serves as a focal point for the tension between the old geopolitics of hard power realism and the normative geopolitics of soft power new realism that is struggling through a birthing process in many settings. In my view the resolution of this tension will shape the trajectory of 21st century humanity. In other words, the stakes are high.]

 

Recognizing Jerusalem as Israel’s Capital

 

With the deftness of a bull in a china shop, Donald Trump has ignored the advice of several close advisors, disregarded the fervent pleas of several of Israel’s closest Arab neighbors, ignored warnings of America’s traditional allies in the Middle East and Europe, and ruptured a key element of an international consensus that had long prevailed at the UN, by going ahead to proclaim formally Washington’s view that Jerusalem is and will be the capital of Israel. Such a declaration serves also to rationalize the prior pledge to move the American Embassy from Tel Aviv, the city where every other country in the world insists on maintaining its government to government relationship with Israel, to the city of Jerusalem, sacred to all three of the monotheistic religions.

 

The most obvious question to pose is one of motivations: Why? Strange as it may seem to those living in the Middle East, the most persuasive explanation is that Trump saw this act of recognition as an opportunity to show his most fervent supporters at home that he was being true to his campaign promises. Trump has been frustrated during the first year of his presidency by his embarrassing inability to carry out the program that helped get him elected in 2016. It is true that by taking this further step toward relocating the American embassy Trump’s popularity in Israel spiked and as he has pointed out he is actually doing what his predecessors and Congress has long proposed.

 

In essence, Trump seems to have taken this internationally controversial step because he cares about pleasing the Christian Zionists and the Israeli Lobby in America more than he does about ruffling the feathers of UN diplomats, possibly inflaming the Arab masses, removing the last shred of doubt among Palestinians that the U.S. could ever be trusted to play the role of ‘honest broker,’ or even partisan intermediary, in the pursuit of a two-state solution, and perhaps most of all, connecting American foreign policy in the turbulent Middle East is some durable and coherent way with strategic national interests in regional stability.

 

From this perspective, Trump has once again demonstrated his extraordinary talent for choosing the worst possible alternative in delicate international situations where dire consequences could follow from the wrong policy turn, and the rewards of going it alone seem minimal and transient, at best.

This vivid instance of Jerusalem unilateralism parallels the geopolitical stupidity of withdrawing from the Paris Climate Change Agreement of 2015 a few months ago. There also the Trump approach to foreign policy seemed perversely designed to burnish its already secure reputation as the first rogue superpower of the nuclear age. This global spoiler role is also dangerously evident in the apocalyptic threat diplomacy adopted by Trump in the Korean Peninsula as a response to Kim Jong-un’s nuclear weapons program, which include provocative bluster, weapons developments, and grave risks of mutual miscalculation.  

 

Liberal opinion in the U.S. and abroad lamented the Trump initiative on Jerusalem for the wrong reasons. Especially prominent was the assertion in various forms that Trump had damaged, if not destroyed, the ‘peace process,’ and its special role as convening party. Such a concern presupposes that a peace process sufficiently existed to be susceptible to being destroyed. While promising ‘the deal of the century,’ Trump turned over his supposed peace offensive, to pro-Zionist extremists and settler fundamentalists (David M. Friedman, Jared Kushner, and Jason Greenblatt) whose obvious goal was not peace, but putting the finishing touches on what they regarded as an Israeli victory that only needed a face-saving exit arrangement for the Palestinian Authority to complete the job. Working in tandem with the Netanyahu leadership, the Trump effort has been so far focused on killing ‘the two-state solution,’ at least in its claim to satisfy reasonable Palestinian expectations of self-determination in the form of a viable and truly independent sovereign state with its capital in East Jerusalem. In its place, one supposes that the Trump ‘dream team’ will come up with a non-viable polity in what remains under Palestinian control in the West Bank, either tied to Gaza or separated in some enduring way, affronting reality by calling the plan a fulfillment of two-state expectations, and dismissing Palestinian objections as ‘rejectionism,’ a stubborn insistence on having it all, and in the end, a take it or leave it version of Hobson’s Choice.

 

As matters now stand, the status quo is also very unfavorable from the point of view of the Palestinian national struggle and the implementation of the international community’s version of a reasonable compromise. This status quo of occupation and dispossession facilitates the continuing conversion of the 1967 ‘occupation’ of Palestinian territory into a permanent reality that unlawfully blends the annexation of the West Bank and East Jerusalem with the maintenance of control over the Palestinian people by means of apartheid structures of subjugation. If this assessment is correct, then moving the American Embassy to Jerusalem can be seen as supportive of Netanyahu’s apparent conception of the end-game of this hundred year struggle between the national aspirations of these two embattled peoples. In this regard, the bluntness of the Trump approach exposes to the world an ugly reality that should have been obvious all along to anyone looking at Israeli behavior with a critical eye, or grasping the policy fallout from the ‘America First’ mantra.

What gives this regressive turn its plausibility, posing yet another challenge to the Palestinian movement, is the blind eye that the new look in Riyadh has turned toward even the Judaization of Jerusalem, which would seem to confirm the Saudi priority of geopolitical collaboration with the United States and Israel, even at the expense of fundamental Islamic concerns and the maintenance of solidarity in the Muslim world. In this sense, it is well to take some note of the declaration of the Organization of Islamic Cooperation (OIC), endorsed by all 57 of its member states (including Saudi Arabia), that Jerusalem is the capital of Palestine, denying Israel any right to a formal governing process in the city.

 

While this substantive analysis helps us grasp the geopolitical context that makes recognition of Jerusalem as Israel’s capital a kick in the groin of Palestinian delusions about a viable peace diplomacy while at the same time leading most Israelis to dance in the streets. It also underscores the hypocrisy of the international community’s call for reviving the peace process when it should long have been evident that Israeli settlement expansion as well as Tel Aviv’s approach to Jerusalem had passed the point of no return, and thus the occasion for abandoning an unworkable diplomacy, and facing with honesty the daunting question—‘What next?.’ Israel’s recent behavior makes it clear for all except hasbarists that the Israeli government has no current willingness whatsoever to end the conflict if this means creating an independent Palestinian state delimited by 1967 borders, thereby encompassing West Bank, Gaza, and East Jerusalem. For Israel the alternatives are perpetuating the apartheid status quo or allowing for the emergence of ‘Bantustan Palestine’ as the diplomatic price that the Netanyahu leadership is willing to pay for a certification of ‘peaceful solution.’

 

From the issuance of the Balfour Declaration in 1917 to this historic moment acknowledging Israel’s claims to Jerusalem, Zionism and since 1948, the state of Israel, have disseminated a double-coded message to the world. In its public utterances, Israel’s public posture is one of a readiness for compromise and peaceful coexistence with the Palestinians, while its practices and actual objectives, can only be understood as the step by step consistent pursuit of the visionary ideal of Greater Israel or Our Promised Land. The present Israeli ambassador to the U.S., Ron Dermer, in the course of thanking Trump for standing so strongly with Israel, told an American TV audience that Jerusalem has been truly the capital of the Jewish people for 3,000 years. No where has Israel’s double-coding been more evident than in relation to Jerusalem. It uses the grandiose claims of Jewish religion tradition when it can and the somewhat more constraining diplomacy of statecraft when it offers opportunities, and does its best to avoid altogether the precepts of international humanitarian law or the UN consensus.

 

On the public discourse side stands Israel’s public acceptance of the partition arrangements embodied in General Assembly Resolution 181, which included the internationalization of Jerusalem under UN administration. More critically viewed from a behavioral discourse perspective, Israel’s actual conduct flagrantly consistently defied international law by formally enlarging and annexing Jerusalem as ‘the eternal capital’ of the Jewish people and manipulating the demographics and cultural heritage of the city in ways that made it seem more credible to regard the whole of Jerusalem as a Jewish city.

 

It is difficult for even notorious Israeli apologists, such as Elliot Abrams or former American ambassadors to Israel to defend the actual Trump decision. Such apologists prefer to adopt a default position. Yes, the timing of the White House initiative was tactically questionable, but its international condemnation greatly exaggerates its importance and inappropriateness. They view criticisms and concerns as overblown, amounting to a display of ‘heavy breathing.’ In effect these apologists agree with Trump’s core contention that the acceptance of Israel’s claim to have its capital in Jerusalem, is an overdue recognition of reality, nothing more, nothing less, and that the rest of the world will have to learn to live with this recognition. Time will tell whether this downplaying of fears of renewed violence of resistance and anti-Americanism are anything other than a feeble attempt by apologists to reaffirm Israel’s legitimacy in the face of what should turn out to be a geopolitical fiasco.

 

What should dismay the region and the world the most about Trump’s Jerusalem policy is its peculiar mixture of ignoring law, morality, and the international consensus while so blatantly harming America’s more constructively conceived national interests and tradition of global leadership. This mixture becomes toxic with respect to Jerusalem because by humiliating the Palestinian national movement and ignoring the symbolic status of Jerusalem for Muslims and the Arab peoples, it makes violent extremism more likely while lending support to existing postures of anti-Americanism. How incoherent and self-defeating to proclaim the defeat of ISIS and political extremism as the top American priority and then making this Jerusalem move that is virtually certain to produce populist rage and an extremist backlash. No ISIS recruiter could have wished for more!

Jerusalem Is (Is Not) the Capital of Israel

 Jerusalem Is (Is Not) the Capital of Israel

 Those who speak on behalf of Israel like to defend Donald Trump’s provocative decision of December 6th to recognize Jerusalem as the capital of Israel with this contention: “Israel is the only state in the world that is not allowed to locate its capital in a national city of its choice.” It seems like an innocent enough proclamation, and even accurate pushback against global double standards, until one considers the political, moral, and legal dimensions of the actual situation.

 

With the benefit of just a moment’s reflection, a more thoughtful formulation of the issue would be: “Israel is the only state in the world whose government dares to locate its capital in a city located beyond its sovereign borders and subject to superior competing claims.” Granted, Israel has declined to date to define its borders for purposes of international law, presumably to leave room for its own further territorial expansion until the whole of the promised land as understood to comprise biblical Israel is effectively made subject to Israeli sovereign control. At stake, in particular, is the West Bank, which is known within Israel by its biblical names of Judea and Samaria, signifying Israel’s outlier belief that the ethnic and religious heritage of the Jewish people takes precedence over modern international law.

 

Further reflection casts additional doubt on this Trump/Netanyahu approach to the status of Jerusalem. It is helpful to go back at least 70 years to the controversial UN partition proposals set forth in General Assembly Resolution 181. Israel over the years has often congratulated itself on its acceptance of 181, which it contrasts with the Palestinian rejection. Palestinians suffered massive dispossession and expulsion in the war that ensued in 1947, known as the Nakba among Palestinians. Israel has argued over the years that its acceptance of 181 overrides the grievances attributable to the Nakba, including the denial to Palestinians of any right to return to their homes or place of habitation however deep and authentic their connections with the land and regardless of how persuasive their claims of Palestinian identity happen to be. What Israelis want the world to forget in the present setting is the UN treatment of Jerusalem that was integral to the 181 approach. Instead, Israel has sold the false story to the world that 181 was exclusively about the division of territory, and thus the bits about Jerusalem contained in the resolution can be ignored without comment, and deserve to be long forgotten.

 

What the UN actually proposed in GA Res. 181, and what Israel ‘accepted’ in 1947 was that the city of Jerusalem, in deference to its connections with Palestinians and Jewish national identity, should not be under the sovereign control of either people, but internationalized and subject to UN administration. Beyond the difficulty of reconciling Jewish and Palestinian claims to the city, the symbolic and religious significance of Jerusalem to the three monotheistic religions provided a parallel strong rationale for internationalization that has, if anything, further vindicated with the passage of time.

 

It can be argued by proponents of Trump’s recognition that even the Palestinians and the Arab World (by virtue of the 2002 Arab Peace Initiative) have silently replaced the internationalization of Jerusalem with the so-called ‘two-state solution’ in which the common assumption of both sides is that Jerusalem would be shared in ways that allowed both Israel and Palestine to establish their respective capital within the city limits. Most two-state plans called for the Palestinian capital to be located in East Jerusalem, which Israel has occupied for the past 50 years, that is, ever since the 1967 War. The clarity of this conviction is what explains the view that the thorny question of the relationship of both Israel and Palestine to the disposition of Jerusalem should be addressed at the last stage of peace negotiations. But suppose that the prospect of genuine peace negotiations is postponed indefinitely, then what? The geopolitical effort to fill this vacuum is undertaken at the expense of UN authority, as well as international law and international morality.

 

Here again we encounter an awkward split between what Israel claims (as reinforced by U.S. foreign policy) and what international law allows. Israel after the war ended in 1967 immediately asserted that the whole of Jerusalem was ‘the eternal capital’ of the Jewish people. Tel Aviv went even further. It expanded by Israeli legal decree the area encompassed by the city of Jerusalem, almost doubling its size and incorporating a series of Palestinian communities in the process. Israel acted unilaterally and unlawfully, against unified opposition within the UN, in defiance of world public opinion, and even in the face of rebuke by such a widely respected moral authority figure as Pope Francis.

 

East Jerusalem, at least, is ‘Occupied Territory’ according to international humanitarian law, and as such is subject to the Geneva Conventions. The Fourth Geneva Convention governs ‘belligerent occupation,’ and rests on the basic legal norm that an Occupying Power should take no steps, other than those justified by imperative security considerations, to diminish the rights and prospects of a civilian population living under occupation. In this regard, it is hardly surprising that Israel’s actions designed to obliterate East Jerusalem as a distinct ‘occupied’ territory have met with universal legal and political condemnation within the UN. For Trump to depart from this international consensus is not only striking heavy blows against the U.S. role as intermediary in any future peace process, but also mindlessly scrapping the two-state approach as the agreed basis of peace without offering an alternative, leaving the impression that whatever reality Israel imposes the United States will accept, giving scant attention to international concerns or Palestinian rights.

 

Returning to the burning question as to why Israel should be denied the right to locate its capital wherever it wishes, as other states do, it is clarifying to reformulate the Israeli claim: “Does any state have the right to establish its capital in a city that is ‘occupied’ rather than under the exclusive sovereign authority of the territorial government?” This is especially relevant in this instance, given the general agreement within the international community that the Palestinian right of self-determination includes the right to have its national capital both within its territory and in Jerusalem.

 

Trump’s initiative tries to ease the pain by the confusing accompanying assertion that the final disposition of Jerusalem’s borders is something for the parties to decide as part of final status negotiations, that is, at the end of the diplomatic endgame. Aside from Israel’s belief that it need not make further concessions for the sake of peace, a geopolitical assertion of support for Israel’s approach to Jerusalem, especially without the backing of the Arab League, the UN, and the European Union is worse than an empty gesture. It uses an iron fist on behalf of the stronger party, where a minimal respect for law, morality, and justice would counsel giving support for the well-grounded claims of the weaker side, or at least staying neutral.

 

The harm done by the Trump initiative on recognizing Jerusalem as the capital of Israel, and declared intention to start the process of moving the embassy is impossible to assess fully at this time. Whether there will be an upsurge in resistance violence, political extremism, anti-American terrorism, and wider warfare is now essentially unknowable, although the stage has been recklessly arranged so that these developments seem more likely to occur than earlier, and if they do, will be treated as outcomes of Trump’s faulty diplomacy.

 

What is already evident on the basis of the decision itself is the severe damage done to the global and regional leadership reputation of the United States. As well, the authority of the United Nations has been shown to be no match for geopolitical resolve, and international law and world public opinion have been pushed aside. For the Trump presidency the special relationship with Israel has been enlarged beyond previous outer limits and the part of the Trump base that wanted these policies has been appeased for the moment. Prospects for a diplomacy based on the equality of rights of Palestinians and Israelis have been reduced to zero, and thus no just end of the Palestinian ordeal can be foreseen. Overall, it is not a pleasant balance sheet of gains and losses if evaluated from the perspective of American grand strategy in the Middle East, and if the wider regional setting of Iran’s spreading influence is taken into account, the situation looks even worse.

The Geopolitics of Shimon Peres’ Legacy

The recent death of Shimon Peres is notable in several respects that are additional to his salient, contradictory, and ambiguous legacy, which may help explain why there has been such an effort to clarify how best to remember the man. Basically, the question posed is whether to celebrate Peres’ death as that of a man dedicated to peace and reconciliation or to portray him as a wily opportunist, a skillful image-maker, and in the end, a harsh Zionist and ambitious Israeli leader. My contention is that the way Peres is being perceived and presented at the time of his death serves as a litmus test of how those on opposite sides of the Israeli/Palestinian divide experienced Peres and beyond this, how various prominent personalities for their own purposes position themselves by either championing the well orchestrated ‘Peres myth’ or seeking to depict the ‘Peres reality.’ This rich obscurity of perceptual interpretation is part of what led the death of Shimon Peres to be taken so much more seriously than that of Ariel Sharon or Moshe Dayan, who were both much more instrumental figures in the history of the Zionist project and the evolution of the state of Israel. As Shakespeare taught us, especially in Julius Caesar, it is the quality of opaqueness that creates heightened dramatic tension in reaction to an historically significant death.

 

These divergent assessments of the life of Shimon Peres can be roughly divided into three categories, although there are overlaps and variations within each. What can we learn from these divergences? (1) the rich, famous, and politically powerful in the West who have been bewitched by Peres’s formidable charms; (2) the rich, famous, and politically influential who know better the moral and complexity of Peres, but put on blinders while walking the path of politically correctness, which overlooks, or at least minimizes, his blemishes; (3) the marginalized, often embittered, whose self-appointed mission it is to be witnesses to what is deemed the truth behind the myth, and especially those on the Palestinian side of the fence.

 

 

Peres is unique among those recently active in Israel as his long life spans the entire Zionist experience, but more than longevity is the credibility associated with the claim that Peres should be set apart from other Israeli politicians as someone genuinely dedicated to establishing peaceful relations with the Palestinians via the realization of the two-state solution, and achieving more generally, good relations with the wider Arab world. Peres’ own presentation of self along these lines, especially in his latter years during which he served as President of Israel, provided international personalities with an excellent opportunity to exhibit the quality of attachment not only to the man, but to Israel as a country and Zionism as a movement. Allowing Peres’ idealist persona to epitomize the true nature of Israel created the political space needed to affirm contemporary Israel without being forced to admit that Israel as a political player was behaving in a manner that defied law and morality.

 

As already suggested, those praising Peres without any reservations fall into two of the categories set forth above. There are those like Barack Obama and Bill Clinton who seem to believe that Peres is truly a heroic embodiment of everything they hoped Israel would become, and to some extent is; in effect, the embodiment of the better angels of the Israeli experience. As well, displaying unreserved admiration and affection for Peres present Western leaders with a subtle opportunity to express indirectly their displeasure with Netanyahu and their concerns about the recent drift of Israeli diplomacy in the direction of a de facto foreclosure of Palestinian aspirations and rights.

 

Of course, such politicians are also eager to be seen at the same time as unconditionally pro-Israeli. Obama made this abundantly clear in his fawning and demeaning farewell meeting with Netanyahu at the UN, which Israel reciprocated by a provocative approval of a controversial settlement expansion, basically one more slap in Obama’s face.

 

Clinton, as well, seems understandably eager to make sure that no daylight appears between his solidarity with Israel and that of his presidential candidate spouse who has topped all American politicians, which says a lot, by tightening her embrace of everything Netanyahu’s Israel currently hopes for in Washington, including even an explicit commitment to join the fight against BDS. By so doing, Hilary Clinton has committed her presidency to favor what appear to be unconstitutional encroachments on freedom of expression that should be an occasion to vent public outrage, but has so far survived the gaze of the gatekeepers without eliciting the slightest critical comments from her opponents and even the media.

 

In the second category of fulsome praise for the departed Peres a variety of private motives is evident. There are those self-important braggarts like Tom Friedman, who clearly knows all about the complexity of the Peres story, but pretends to be gazing wide eyed at the brilliant blue of a cloudless sky as he describes his supposedly idyllic friendship with Peres over a period of 35 years. Friedman is definitely informed and intelligent enough not to be taken in by the Peres myth, and despite his signature demeanor of fearless candor, his views tend to be in total alignment with the liberal pro-Jewish mainstream, whether the topic is assessing Peres’s life or for that matter, assessing America’s global role or the current race for the presidency. He is as anti-Trump and as he is pro-Peres, exhibiting his mentoring stature as the guru of centrist political correctness, which is slightly disguised to the unwary by his brash tone that purports to be telling it like it is even when it isn’t.

 

And then in this same category, strange bedfellows to be sure, are quasi-collaborationist Palestinian leaders, most notably, Mahmoud Abbas who showed up in Jerusalem at the Peres funeral, described in the media as a rare visit to Israel, and seized the opportunity of Peres’ death to demonstrate that the Palestinian leadership is not hostile to Israeli leaders who the world recognizes as committed to peace based on the two-state solution. Abbas was presumably seeking, as well, to enhance his image as a reasonable, moderate, and trustworthy partner in the search for peace, which of course understandably infuriated not only Hamas but all those Palestinians who know better, given the daily ordeal that Palestinians are enduring as a result of policies that Peres never opposed, and in some instances, as with settlements and occupation, helped to establish. The portrayal of Peres by the respected Israeli historian, Tom Segev can hardly be news to Abbas who has endured first hand the long Palestinian ordeal: “Mr. Peres would certainly liked to enter history as a peacemaker, but that’s not how he should be remembered: indeed his greatest contributions were to Israel’s military might and victories.”

 

Hanan Ashrawi, a Palestinian Christian who has had important positions with the PLO for many years, and has long worked for a real peace in a spirit of dedication, but without succumbing to the deceptions surrounding the Oslo diplomacy. Ashrawi has managed to keep her eyes open to the reality of Palestinian suffering, making her inevitably more critical of Peres and suspicious of those who would whitewash is life story. She writes of Peres after his death, as follows: “Palestinians’ faith in Mr. Peres had been tested before. Not forgotten by Palestinians and others in the region is the role that he played arming the Israeli forces that expelled some 750,000 Palestinians during the establishment of Israel in 1948; the regional nuclear arms race he incited by initiating Israel’s secret atomic weapons program in the 1950s and ’60s; his responsibility for establishing some of the first Jewish settlements on occupied Palestinian land in the ’70s; his public discourse as a minister in Likud-led coalitions, justifying Israeli violations of Palestinian rights and extremist ideology; and his final role in Israeli politics as president, serving as a fig leaf for the radically pro-settler government of Prime Minister Benjamin Netanyahu.” [NY Times (international edition, Oct 3, 2016)]

 

 

 

Above all, this overly elaborate observance of Peres’ death serves as an informal litmus test useful for determining degrees of devotion to Israel and its policies without bothering to weigh in the balance the country’s obligations under international law or the cruel reality being imposed on the Palestinian people year after year. Those who praise Peres unreservedly are deemed trustworthy within the Beltway, scoring high marks from AIPAC, and those who point to his shortcomings or to policies that went awry are viewed as unredeemably hostile to Israel. They are correctly assumed to be critics of the Special Relationship and of the over the top flows of U.S. military assistance (at least $3.8 billion over the next ten years), or worse, identified as sympathizers with the Palestinian struggle. This description fits such respected and influential critics of the Peres myth as Robert Fisk (British journalist), Uri Avnery (Israeli peace activist, former Knesset member), Gideon Levy (Israeli journalist), and Ilan Pappé (noted Israeli revisionist historian living in Britain).

 

 

 

In my view only those who see the dark sides of Shimon Peres are to be trusted, although it is excusable to be an innocent devotee in the manner of Obama. In this regard the knowledgeable liberal enthusiast is the least acceptable of the three categories because of the willful deception involved in painting a picture of Peres that is known to feed a misleading myth that is itself part of the Israeli hasbara manipulating international public awareness of the Palestinian ordeal, and thus encouraging a false public belief that the leadership in Israel, even the Netanyahu crowd, is sincere in their off again on again advocacy of a two-state solution or of the establishment of a truly independent Palestinian state. Remember that even Netanyahu joined the chorus at the funeral by treating Peres with a moral deference that should be reserved for the gods.

 

There is another aspect of what was signified by the ardent eulogies delivered by Western leaders at the Peres funeral that was dramatically underlined by the renowned Israeli columnist, Gideon Levy, yet entirely overlooked in the extensive commentary: “Anti-Semitism died on Friday — or at least, its use as an excuse by Israel. On the eve of Rosh Hashanah 5777, the world proved that while anti-Semitism remains in certain limited circles, it can no longer frame most of the world’s governments. Also, hatred of Israel is not what it is said to be, or what Israel says it is.” Levy’s observation is timely and relevant. It goes beyond an expression of the view that Peres was partly lauded because he was ‘not Netanyahu.’ Far deeper is Levy’s understanding that the Peres funeral gave the West an opportunity to express their affection and admiration for a prominent Jew being celebrated because he fashioned for himself and others the image of a ‘man of peace.’ Independent of whether or not this is a true appreciation, it allows a distinction to be sharply drawn between rejecting Jews as a people and criticizing Israel and its leaders for their practices and policies. In effect, if Israel were to embody the supposed worldview of Peres, and bring peace, then Israel would be welcomed into the community of states without any resistance arising from the Jewish identity of its majority population.

 

We in the United States are particularly grateful to Gideon Levy for making this point so clearly. We are faced with the opposite syndrome. Namely, criticisms of Israel’s policies and practices with respect to the Palestinian people are being deliberately treated as ‘hate speech’ and worse, as a new virulent form of post-Holocaust anti-Semitism. Such attacks have been recently mounted with hurtful fury against pro-Palestinian activists and supporters of the BDS Campaign.

 

May Shimon Peres rest in peace, and may the Palestinian people through their representatives intensify their struggle to achieve a real peace with Israel based on law, justice, and mutual empathy.

 

 

 

The Yemen Catastrophe: Beset by Contradictions of Will and Intellect

[Prefatory Note: This post modifies an article published in Middle East Eye on September 21, 2015, with title, “Yemen pays the price for Saudis’ sectarian paranoia.” Whether the Saudis are being paranoid about political developments in their neighbors (Egypt, Bahrain, Yemen) or prudent in view of regional threats to the stability of the Kingdom is difficult to ascertain. However this issue is resolved, portraying what has gone wrong as a consequence of sectarianism or an expansionist Iran, evades the real challenges being posed in Yemen, in Syria, and elsewhere in the region. Only in Iraq, where American occupation policy injected

a self-defeating sectarianism as the centerpiece of its post-Saddam Hussein state-building project, does this optic misused when applied to Middle East conflict seem to explain the course of developments, including the alignment of Iraq’s current leaders with Iran rather than with their supposed liberators from the West!]

 

 

 

Yemen Catastrophe: Beset by Contradictions of Will and Intellect

 

Any attempt to provide a coherent account of the political strife afflicting Yemen is bound to fail. The country is crucible of contradictions that defy normal categories of rational analysis. If we look beyond the political fog that envelops the conflict the tragic circumstances of acute suffering imposed on the civilian population do emerge with stark clarity. Long before the outbreak of civil warfare, Yemen was known to be the poorest country in the region, faced with looming food and water scarcities. The UN estimates 80% of the population is in urgent need of humanitarian assistance, 40% live on less than $2 per day. Further there are high risks of mass famine and epidemic outbreaks of disease will occur, while continuing chaos is a near certainty, with the prospect of yet another wave of desperate migrants swept ashore in Europe.

 

Against this background, the UN Security Council seems shockingly supportive of a major Saudi military intervention via sustained air attacks that started in March 2015, severely aggravating the overall situation by unanimously adopting a one-sided anti-Houthi Resolution 2216. This Saudi use of force is contrary to international law, violates the core principle of the UN Charter, and magnifies the violent disruption of Yemeni society. The success of the Houthi insurgency from the north that swept the Yemeni leadership from power, taking over the capital city of Sanaa, was perversely treated by the Security Council as a military coup somehow justifying the intervention by a Saudi led coalition of Gulf countries pledged to restore the ‘legitimate’ government to power. To grasp the geopolitics at play it is clarifying to recall that the 2013 blatant military coup in Egypt, with much bloodier reprisals against the displaced elected rulers, aroused not a murmur of protest in the halls of the UN. Once more the primacy of geopolitics is showcased in the Middle East. It’s not what you do, but who does it, that matters when it comes to a UN response.

 

What makes it even more difficult to make sense of developments in Yemen is the geopolitical tendency, as abetted by the media, to reduce incredibly complex national histories and the interplay of multiple contending forces to a simplistic story of Sunni versus Shia rivalry for the control of the country. Such a prism of interpretation, above all, allows Saudi Arabia to portray once again the strife in Yemen as another theater of the wider region proxy war pitting Saudi Arabia and its Gulf allies against Iran, which is a guaranteed way of securing U.S. and Israeli backing. The same rationale has served the Kingdom well (and the world badly) in explaining why it supports anti-Assad forces in Syria during the last several years. It also was the pretext for intervening in Bahrain in 2011 to crush a popular pro-democracy uprising. If considered more objectively we begin to understand that this sectarian optic obscures more than it reveals, and not accidentally.

 

For instance, when it came to Egypt, however, the sectarian template was completely discarded, and the Saudis immediately used their financial muscle to help the anti-Muslim Brotherhood coup in 2012 led by General Sisi to consolidate its control over the country. Even when Israel attacked Gaza a year ago, seeking to destroy Hamas, a Sunni Islamic version of the Brotherhood, Saudi Arabia made no secret of the startling fact that it gave Tel Aviv a green light. What emerges, then, is not a regional politics based on sectarian priorities, but rather a pathological preoccupation with regime stability in the Saudi monarchy, with anxieties arising whenever political tendencies emerge in the region that elude its control, and are perceived as threatening. Part of the truer explanation of Saudi pattern of behavior also has to do with the Faustian Bargain struck with the powerful Wahabi establishment, which has allowed the Saud royal clan to flourish at home while spending billions to spread the most repressive version of Islam far and wide to madrassas throughout Asia. The fact that the application of Wahabism at home, including more than 100 beheadings already this year and confinement of women to an extent that makes the Islamic Republic of Iran appear liberal by comparison, is a further sign that international clamor of human rights is selective to put it mildly.

 

The people of Yemen are paying a huge price for this brand of Saudi violent security politics. Whether it is paranoia at work or a healthy respect for the mass unpopularity of its policies, or some mixture, is difficult to assess. Yet what seems clear is that much of the world is lulled to sleep, not taking the trouble to peer below this sectarian cover story. Only scant account taken of the fact that the real threats to regional order in Yemen do not come from a reasonable Houthi insistence on power-sharing political arrangements, but mainly arise from the presence in Yemen of Al Qaeda of the Arabian Peninsula (AQAP) and ISIS that have been long targeted by American drones as part of the war of the terror ever since 2007. So while the West supports the Saudi fight against the Shia Houthis at the same time it does its best to weaken their most formidable domestic opposition, and in the process further alienates the Yemeni civilian population by its military tactics, which recruits more extremists committed to fighting against this second form of external intervention that finds no basis in international law and enjoys the tacit support of the UN Security Council.

 

If this was not enough to make the Yemeni crystal ball opaque, there is the internal alignment of forces. On the one side, the 2012 successor regime to the corrupt dictatorial rule of Ali Abdullah Saleh that is headed by its equally corrupt former vice president, Abd Rabbaah Mansour Hadi, now apparently ‘governing’ from exile, although rumored to be seeking a return to Aden. On the anti-regime side, in addition to the Houthis, are the main military and police forces that still respond to the authority of the ousted leader, Saleh, who has returned to the Yemen struggle to oppose the Saudi intervention and have helped turn the tide of battle on the ground against the Hadi-led government. Despite this adverse battlefield reality, the Saudi ambassador to the U.S., Adel al-Jubeir, was quoted as saying “We will do whatever it takes to protect the legitimate government of Yemen from falling.” Tragically, what this seems to mean, is reducing the country to a shambles that brings starvation and disease to the population, and possibly escalating at some future point of frustration by the launch of a ground offensive. There are confirmed reports of a massing of Saudi troops close to the Yemen border.

 

At this point, it is difficult to know what would bring some kind of peace and stability to Yemen. What we do know is that both the sectarian optic, Saudi intervention, and American drone warfare are dead end options. The beginning of a constructive approach is to take root causes of the current conflict into account. Several need to be considered. There is a long experience of division in the country between the north and the south, and this means that any unity government for the whole of Yemen can only be sustained by an iron-fisted dictator like Saleh or through a genuine power-sharing federalist kind of arrangement based on decentralized autonomy and a weak central governmental structure. Beyond this, the country bears the scars of Ottoman rule intermixed with a British presence in Aden and the surrounding area, vital to earlier colonial priorities of controlling the Suez and the trade routes to the East.

 

Additionally, and often forgotten and ignored, Yemen remains a composite of tribes that still command the major loyalty of people and reign supreme in many locales. The modern European insistence on sovereign states in the Middle East never succeeded in overcoming the primacy of Yemeni tribal identities. Any possibility of political stability requires subsidizing and respecting Yemen’s tribes as Saudi Arabia did during Saleh’s dictatorship (1990-2012) or creating a multi-colored quilt of autonomous tribal polities. When the background of the north/south split and persisting tribalism are taken into account recourse to the Shia/Sunni divide or the Riyadh/Tehran rivalry as an explanation of Yemen’s strife-ridden country is more than a simplistic evasion of a far more complicated reality. It is a cruel and futile fantasy.

 

What should be done, given this overall situation? One potential key to achieving some kind of peace in Yemen is held by policymakers in Washington. So long as the U.S. Government remains beholden to the rulers in Saudi monarchy, to the extremists running Israel, and insistent on striking at AQAP targets with drone missiles, this key is unusable. This combination of factors is what makes the wider political turmoil in the Middle East stuck on a lethal fast moving treadmill. How to get off the treadmill, that is the question for which there answers, but as yet no relevant political will.

 

There are two obvious moves, neither ideal, but with the modest goal of a first step in creating a new political order: first, negotiate a ceasefire that includes an end to the Saudi intervention; secondly, establish a more credible revival of the National Dialogue Conference that two years ago made a failed attempt at Gulf initiative in Sanaa to find a power-sharing arrangement. It did not help matters then that two successive Houthi representatives at the diplomatic discussions were assassinated on their way to participate. What is needed is establishing a political transition sensitive both to the north/south split and the strength of Yemeni tribes coupled with massive economic assistance from outside, as well as the establishment of a UN peacekeeping presence tasked with implementation and the termination of all forms of external armed intervention. Nothing less has any chance of working.

 

Such a rational path is currently blocked, especially by the intense militancy of the aggressive Saudi leadership of King Salman bin Abdul Aziz Al-Saud, and his son, Prince Mohammed bin Salman, Secretary of Defense, the apparent champion of military intervention. The United States, with its special relationship to Israel, its strong ties to Saudi Arabia, and faith in drone led counterterrorism seems to be swallowing the central contradiction between opposing both its real adversaries, AQAP and ISIS, and its implicit ally, the Houthis. Instead of treating the enemy of their enemy as a friend, Washington has reversed the proverb. This Gordian Knot is strangling the people of Yemen. Cutting it will require a drastic break with current policy. The way forward is evident, but how to get there is not, in the meantime the bodies pile up in what has long been considered the poorest country in the region severely stressed by the prospect of severe water scarcities.

  

Voting for Hilary Clinton? Red Lines versus Lesser of Evils

Assuming that the current prospects for presidential candidates hold firm, and Hilary Clinton is nominated by the Democrats and Jeb Bush, Rick Rubio, or Scott Walker win the Republican nomination, what should a conscientious citizen do when it comes to voting in November 2016? Of course, step one is to rule out support for the Republican candidates due to their regressive views on a range of social and economic issues, and their militarist bluster on foreign and defense policy. Step two is more difficult. Clinton is clearly preferable if the domestic agenda is taken into account, and probably no worse than the Republicans when it comes to foreign policy, but also not noticeably better, and in some ways more objectionable.

 

For instance, she begins her recent letter to the billionaire arch Zionist mega-donor and longtime Clinton family supporter, Haim Saban, on July 7, 2015 this way: “I am writing to express my alarm over the boycott, divestment, and sanction movement, ‘BDS,’ a global effort to isolate the State of Israel by ending commercial and academic exchanges.” She seeks Saban’s guidance in pursuit of this nefarious goal with this deferential language: “Now I am seeking your thoughts and recommendations on how leaders and communities across America can work together to counter BDS.”

 

I am sure it didn’t escape the gurus of the Clinton campaign that Saban had joined with the casino mogul, Sheldon Adelson not long ago to headline a donors gathering at which each participant was expected to pledge $1 million to fight BDS. Although Adelson identifies as Republican and Saban as Democrat, both fervently embrace the Netanyahu brand of Israeli leadership. Saban has been quoted on Iran in language that manages to outdo Bibi, “I would bomb the daylight out of those sons of bitches.”

 

Clinton has a variety of other scary credentials, including voting in support of the Iraq War of 2003, and to this day remains unwilling to admit that the war was at the very least a tragic mistake, and more accurately, a costly international crime. She not only argued for intervention in Libya in 2011, but made a chilling comment on CBS News after learning of the grisly vigilante execution of Muammar Qaddafi: “We came, we saw, he died.” Further, among the emails that Clinton has long withheld from the public are several that substantiate the charges that France from the outset both intended to overthrow the Qaddafi regime, and expected to reap economic benefits by way of the spoils of war, especially with respect to Libya’s oil wealth. It is not that Clinton actually conspired with such plans while serving as Secretary of State, but she did knowingly lead the effort to support the French-led NATO intervention in 2011, claiming that its limited goal was the protection of Libyan civilians in Benghazi, when she was well aware that the real purpose of the UN-mandated intervention was regime-change in Tripoli.

 

Here is my dilemma. In view of such considerations, does one vote for Hilary Clinton with eyes wide open because she is likely to be better for ordinary Americans on a range of crucial issues, including some effort to challenge the obscene scandal of growing inequalities and sustained slippage in the real income and labor rights of workers and the accumulated hardships on much of the middle class? Or does one say there are certain candidates whose views are so abhorrent as to be unsupportable without weighing their suitability against alternatives? Many remember the acrimonious debates along the same lines concerning the 2000 campaign pitting Bush against Gore, and allegedly lost by Gore in Florida because Ralph Nader, running as a third party candidate, received over 90,000 votes, arguably more than enough to swing the state to Gore’s side of the ledger, and thus enough electoral votes to win the presidency. Most Democrats angrily dismissed Nader as a spoiler and harshly criticized supporters for indulging in irresponsible political behavior. As someone who voted for Nader in 2000, while coming to detest the Bush presidency, I continue to believe that primary duty of citizens in a democratic society is to be on most occasions responsive to their conscience rather than to attempt pragmatic calculations often glamorized as ‘the best being the enemy of the good.’ In the case more accurately phrases as ‘the worst being the enemy of the bad.’ I do admit that I didn’t realize in 2000 that Bush would turn out as badly as he did, and if I had, I might have wavered.

 

Looking ahead to 2016 the issue of choice can be at this stage put as follows: vote for Hilary Clinton as ‘the lesser of evils’ or vote for Jill Stein of the Green Party as the most attractive presidential candidate, but someone with no chance to do more than enliven the debate and give alienated voters like myself a positive option that feels better than not voting. Remember that there were those establishment liberals who in the tense days after the 9/11 attacks were ready to rationalize torture as the lesser of evils. It was alleged lesser as compared to the need for information that would lead to dangerous terrorist suspects, but where it actually led was to Abu Ghraib and Guantanamo, and a nationally humiliating orgy of torture with very little security payoff. The Kathryn Bigelow film on the search for and execution of Osama Bin Laden, “Zero Dark Thirty,” also gave a bright green light to the torture policies of the Bush presidency, fed to the public by the grotesque evasion embedded in the words ‘enhanced interrogation.’

 

The alternative logic may be described as respect for ‘red lines.’ I happen to believe that the BDS campaign is a desirable and an essential step in the redesign of a peace process that might produce a just and sustainable peace for Palestinians and Israelis

after more than 67 years of agonizing failure, including the recent frustrations associated with the Oslo diplomacy initiated by the handshake in 1993 between Yitzhak Rabin and Yasir Arafat, with a beaming Bill Clinton standing in between. For me, Hilary Clinton crossed my red line with her craven letter to Haim Saban, making it impossible for me to vote for her by invoking the alternative logic of the lesser of evil. But maybe, although unlikely, by the time November 2016 comes around, I might reconsider.

 

I realize that if one of those awful Republicans is elected president by a close vote that is skewed by Green Party votes, I will be bitterly criticized by liberal friends. I admit that it is a tricky issue on principled grounds. Livelihoods and wellbeing will almost certainly be adversely affected by a Republican victory, whereas the differences in foreign policy between the two candidates are murky at best, and on Israel/Palestine there is no up side regardless of which party prevails. At the same time, the American plutocracy has become a bipartisan enterprise, calling for resistance as an ethical and political imperative, acknowledging the validity of Chris Hedges’ powerfully reasoned insistence that the country is experiencing pre-revolutionary tremors.

 

At this stage of the electoral process, my overall sense is that the lesser of evils is still evil, and that morally significant red lines are important for citizens to draw and respect. Until further notice, then, I have decided not to cast my vote for Hilary Clinton.

As long ago as 1998 Edward Said reminded the world that acting as if Palestinians were equally responsible with Israelis for the persisting struggle of the two peoples was not only misleading, but exhibited a fundamental in misunderstanding of the true reality facing the two peoples: “The major task of the American or Palestinian intellectual of the left is to reveal the disparity between the so-called two sides, which appears to be in perfect balance, but are not in fact. To reveal that this is an oppressed and an oppressor, a victim and a victimizer, and unless we recognize that, we’re nowhere.” [interview with Bruce Robbins published in Social Text (1998)] I would rephrase Said’s statement by substituting ‘any engaged citizen and morally sensitive intellectual’ for ‘the American or Palestinian intellectual of the left.’ We do not need to be on the left to expose the cruel hypocrisy of suppressing gross disparities of circumstances, or more to the point, blocking out the multiple diplomatic, military, material, and psychological advantages enjoyed by Israel as compared to the Palestine. “It is elementary, my dear Watson!” as Sherlock Holmes so often exclaimed, or at least it should be.

 

Unfortunately, a principal instrument of the mind numbing diplomacy of the United States is precisely aimed at avoiding any acknowledgement of the disparity that at the core of the encounter. As a result, the American public is confused as to what it is reasonable to expect from the two sides and how to interpret the failure of negotiations to get anywhere time and again. This failure is far from neutral. It is rather the disparity that has done the most damage to peace prospects ever since 1967: This pattern of delay has kept the Palestinians in bondage while allowing the Israelis build and create armed communities on occupied Palestinian land that was supposedly put aside for the future Palestinian state.

 

Beyond this appeal to intellectuals, Said’s message should be understood by everyone everywhere, and not just by Americans and Israelis, although these are the two populations most responsible for the prolonged failure to produce a peace based on justice. Elsewhere, except possibly in parts of Western Europe, such a discourse as to shared responsibility for the ongoing struggle is not so relevant because the ugly forms of Israeli exploitation of the Palestinian ordeal have become increasingly transparent in recent years. Only in America and Canada has the combined manipulations of hasbara and the Israel Lobby kept the public from sensing the extremities of Palestinian suffering. For decades Europeans gave Israel the benefit of the doubt, partly reflecting a sense of empathy for the Jewish people as victims of the Holocaust without giving much attention to the attendant displacement of the indigenous Arab population. Such an outlook, although still influential at the governmental level, loses its tenability with each passing year. 

Beyond this, there are increasing expressions of grassroots solidarity with the Palestinian struggle by most peoples in the world. It is a misfortune of the Palestinians that most political leaders in the world are rarely moved to act to overcome injustice, and are far more responsive to hegemonic structures that control world politics and their perception of narrowly conceived national interests. This pattern has become most vividly apparent in the Arab world where the people scream when Israel periodically launches its attacks on Gazan civilian society while their governments smile quietly or avert their eyes as the bombs drop and the hospitals fill up.

 

In Israel, the argument as to balance also has little resonance as Israelis, if they pause to wonder at all, tend to blame the Palestinians for failing to accept past Israeli conflict-resolving proposals initiatives made over the years. Israelis mostly believe that the Barak proposals at Camp David in 2000 and the Sharon ‘disengagement’ from Gaza in 2005 demonstrated Tel Aviv’s good faith. Even Netanyahu, at least when he is not seeking reelection, and is speaking for the benefit of an American audience disingenuously claims Israel’s continuing dedication to a peace process based on seeking a two-state solution while he explains diplomatic gridlock by contending that lacks a Palestinian partner in the search for peace, and never deigns to mention the settlement archipelago as an obstacle.

 

Looked at objectively, by assessing behavior and apparent motivation, it is the Palestinians that have no partner for genuine peace negotiations, and should have stopped long ago acting as if Israel was such a partner. That is, Israel inverts the Said disparity, contending that the public should point its finger of blame at Palestine, not Israel. Of course, this is hasbara in its impurest form. Israel never made a peace proposal that offered Palestinians a solution based on national and sovereign equality and sensitive to Palestinian rights under international law. And as for Sharon’s purported disengagement from Gaza, it was justified at the time in Israel as a way to deflect international pressures building to pursue a diplomatic solution and it was managed as a withdrawal that didn’t loosen the grip of effective control, leaving Gaza as occupied and more vulnerable than it was when the IDF soldiers patrolled the streets. Since 2005 the people of Gaza have suffered far more from Israel’s military domination than in all the years following 1967 when occupation commenced, and it should be clear, this outcome was not a reaction to Hamas and rockets. Hamas has repeated sought and upheld ceasefires that Israel has consistently violated, and offered long-term arrangements for peaceful coexistence that Israel and the United States have refused to even acknowledge.

 

Where the equivalence argument is so influential is with the Obama administration and among liberal Zionists, including such NGOs as J Street and Peace Now that are critical of Israel for blocking progress toward a two-state solution. It is a blindfold that obscures the structural reality of the relationship between the two sides, and believes that if Israel would make some small adjustments in their occupation policy, especially in relation to settlements, and if the Palestinians would do the same with respect to refugees and accepting Israel as a Jewish state, then a negotiated peace would follow as naturally as day follows night. In effect, Israel is expected to curtail unlawful settlement activity in exchange for Palestine suspending its rights under international law affecting the situation of several million Palestinian refugees. As is widely known, Jews from anywhere in the world have an unconditional right to immigrate to Israel, whereas Palestinian living abroad with deep residence roots in the country are almost totally banished from Israel including if their purpose is to resume residence so as to live with close family members.

 

In Ramallah back in March 2013, and speaking to a Palestinian gathering, President Obama did forcefully say that “The Palestinians deserve an end to occupation and the daily indignities that come with it,” and this will require “a state of their own.” Obama even then acknowledged “that the status quo isn’t really a status quo, because the situation on the ground continues to evolve in a direction that makes it harder to reach a two-state solution.” Such a display of circumlocution (“..continues to evolve in a direction”) so as to avoid clearing mentioning Israel’s continuous encroachment on the land set aside by the international consensus, is for a discerning reader all that one needs to know. The unwillingness to challenge frontally Israel’s unlawful and obstructive behavior is underscored by Obama’s reassurances given to a separate Israeli audience in Jerusalem on the same day that he spoke guardedly to the Palestinian, with such phrases as “America’s unwavering commitment,” ‘unbreakable bonds,” “our alliance is eternal, it is forever,” “unshakeable support,” and “your greatest friend.” No such language of reassurance was offered the Palestinians. His two speeches left no doubt that Israel retained its upper hand, and could continue to rest easy with this status quo of simmering conflict that had worked so long in its favor.

 

The Secretary of State, John Kerry, ploughs the same field, calling on both sides to make “painful concessions.” Obama in his Jerusalem speech illustrated what this concretely might mean, assuming that the two sides were equally called upon to act if peace were to be achieved. The Palestinians were called upon to recognize Israel as a Jewish state, while Israel was politely reminded in language so vague as to be irrelevant, “Israelis must recognize that settlement activity is counterproductive.” To ask Palestinians to recognize Israel is to affirm as legitimate the discriminatory regime under which the 20% Palestinian minority lives, while asking the Israelis to recognize that the counterproductive character of settlement expansion is to misunderstand Israeli intentions. If their goal is to avoid the establishment of a Palestinian state then being ‘counterproductive’ is exactly the result being sought. Besides asking the Palestinians to abridge their rights while requesting Israel to admit that their settlement activity is not helping the diplomatic process is to appeal to their self-interest, and avoid a demand to cease and reverse an unlawful, likely criminal, activity. The false equivalence is a metaphor for the deformed framework of diplomacy that has unfolded largely as a result of the United States being accepted as the presiding intermediary, a role for which it is totally unsuited to play. This lack of qualification is admitted by its own frequent declarations of a high profile strategic and ideological partnership with Israel, not to mention the interference of a domestic Israeli lobby that controls Congress and shapes the media allocation of blame and praise in relation to the conflict.

 

Kerry expresses the same kind of one-sidedness in the guise of fairness when he calls on the parties to make compromises: “..we seek reasonable compromises on tough complicated, emotional, and symbolic issues. I think reasonable compromises has to be a keystone of all of this effort.” What kind of compromises are the Palestinians supposed to make, given that they are already confined to less and less of the 22% of the British Mandatory territory of Palestine, and since 1988 have sought no greater proportion of the land. Kerry’s approach overlooks, as well, the defiant refusal of Israel to act in good faith in relation to the 1967 Security Council Resolution 242 that called upon Israel to withdraw without claiming territory through its use of force or by taking advantage of being the occupying power. In the interim, while being unwilling to do anything concrete to implement its view of decades that Israeli settlement activity is ‘counterproductive’ the United States proclaims and proves its readiness to oppose any Palestinian attempt to gain access to the UN to express its grievances, an effort which Obama denigrated as “unilateral attempts to bypass negotiations through the UN.” The Palestinian Authority has repeatedly made clear that it favors a resumption of direct negotiations with Israel, despite being at a great disadvantage within such a framework, and insists persuasively that there is no inconsistency between its seeking greater participation in international institutions and its continued readiness to work toward a diplomatic solution of the conflict. If Israel and the United States were sincerely dedicated to a sustainable peace, they would encourage this Palestinian turn away from violent resistance, and their increased effort to push their cause by persuasion rather than missiles, to advance their cause by gaining respectability through joining institutions and adhering to lawmaking treaties instead of being confined in a prolonged rightless lockdown euphemistically disguised as ‘occupation.’

 

In the end, we cannot see the situation for what it is without reverting to theSaid insistence that the relation between oppressor and oppressed is a paramount precondition for sustainable peace. Unless the structural distortion and illegitimacy is acknowledged, no viable political arrangement will be forthcoming. From this perspective the Kerry emphasis on ‘reasonable compromise’ is as mind numbingly irrelevant as it would have been in seeking a peaceful end to racial struggle in apartheid South Africa by demanding that ANC and Nelson Mandela become amenable to compromise with their racist overlords. Peace will come to Israel and Palestine, and be sustained, if and only if the oppressor becomes ready to dismantle its oppressive regime by withdrawing, not merely by disengaging Gaza style. At present, such a readiness is not to be found on the Israeli side, and so long as this is so, direct negotiations and these periodic calls issued by Washington to resume direct talks have one main effect–to free Israel to realize its ambition to establish ‘Greater Israel’ while keeping the Palestinians in chains. This ambition has not yet been explicitly embraced by the Israeli leadership, although only those who refuse to notice what is happening on the ground can fail to notice this expansionist pattern. Israel’s new coalition government even more rightest and pro-settler than its predecessor makes Israel’s ambition to end the conflict by self-serving unilateral action less and less a well kept state secret.

Preliminary Observations

 

In this period when the centenary of the genocidal victimization of the Armenian people in 1915 is being so widely observed and discussed, it seems especially appropriate to call attention to the comparable victimization of the Palestinian people. This second story of prolonged collective victimization also received its jump start almost a century ago with the issuance by the British Foreign Office of the Balfour Declaration supporting the Zionist movement project of establishing a Jewish national home in historic Palestine. The most striking difference between these two experiences of severe historical wrongs is that the Armenian people are seeking acknowledgement and apology for what was done to their ancestors a century ago, and possibly seeking reparations, while the Palestinian people may sometime in the future have the opportunity to seek similar redress for the past but now their urgent focus is upon liberation from present daily structures of acute oppression. This Palestinian situation is tragic, in part, because there is no clear path to liberation, and the devastation of oppressive circumstances have gone on decade after decade with no end in view.

 

The political puzzle of the Israel/Palestine conflict continues to frustrate American policymakers despite their lengthy diplomatic engagement in the search for a peaceful future that satisfies both peoples. There are significant changes, of course, that have occurred as time unwinds. Perhaps, the most crucial change has involved the gradual extension of Israeli control over virtually the whole of historic Palestine with American acquiescence. This coincides with a growing and more vivid awareness around the world of how much suffering and humiliation the Palestinian people have endured over the course of the last century, and the degree to which this frozen situation can be blamed on the unlimited willingness of the United States to deploy its geopolitical muscle on Israel’s behalf.

 

My approach to the Palestinian struggle reflects four points of departure: first, regarding the long suffering of the Palestinian people as having become the primary international moral challenge of our time, which does not deny that there are other equally serious moral challenges, but none is so implicated in wider global patterns of past injustice or as salient in the political consciousness of the peoples of the world; secondly, believing that international law and morality should be allowed to provide essential guidance in determining the contours of a just and sustainable peace between these two long embattled peoples; thirdly, emphasizing the decisive liberating role of nonviolent civil society militancy in finding a solution for the conflict, achieving liberation from below by the mobilization of people, not the action governments as offering the most promising present scenario for ending the Palestinian ordeal; and fourthly, approaching the struggle for Palestine as matter of human wellbeing without privileging a particular ethnicity, nationality, and religion, that is, from a sense of shared humanity rather than from adversary perspectives of Jewish and Palestinian exclusivity.  

 

The Palestinian struggle is about far more than the ‘end to occupation,’ although the concreteness of the Israeli occupation of Palestine lends itself to visualization, as would Israeli withdrawal, and this partly explains why so many liberal activists equate peace with ending the occupation. Yet conceiving the conflict in this territorial manner is profoundly misleading. It ignores the depth and complexity of what is at stake for both Jews and Palestinians, but especially for Palestinians. I consider the Palestinian national struggle within its broader scope and less distinct parameters as a persisting struggle to achieve the right of self-determination. Self-determination is the solemn promise of common Article 1 in the two international human rights covenants made to all peoples in the world, in effect, a legal, moral, cultural, and frequently a political entitlement to determine collective destiny so long as the equal right of other peoples is not encroached upon. These 1966 covenants set forth the content of international human rights law in their most authoritative treaty form. The extended inability to realize this right is the core tragedy of the Palestinian people, informing the hardships and humiliations of daily life.

 

In some respects, even describing the Palestinian goal in the language of self-determination is too restrictive, and by itself, not very clarifying. Ultimately the preconditions and contours of a just and sustainable peace is what should concern us most. It is an outcome that controversially also addresses the overlapping and conflicting right of self-determination enjoyed by those of Jewish identity who are now long enough resident in Israel to possess their own legitimate basis for claiming self-determination. The key strategy of accommodation is to find the best formula for reconciling these basic competing claims of self-determination, and to reject as unacceptable contentions of their fundamental incompatibility or their resolution by force of arms. It is important at this stage to recognize that Israeli unilateralism and Zionist maximalism are making it increasingly difficult for the affected parties to find such a formula, much less give it life.

 

When considering the content of this underlying right of self-determination additional substantive concerns are disclosed, above all the fate of the several million Palestinian refugees many living for more than 50 years in miserable refugee camps in Jordan, Syria, and Lebanon. If Palestinian goals or the requirements of peace are confined to the territorial language of ending the occupation, the plight of Palestinian refugees tends to be left in limbo or at best consigned to the periphery of peacemaking that implicitly denies any right of repatriation and leaves the refugee communities without adequate representation.

 

There are other challenges facing peacemakers, as well. Edward Said, and other sensitive commentators on the interminable Palestinian ordeal have repeatedly observed that one catastrophic dispossession, that of the Palestinians in 1948, in no way justifies seeking a second dispossession, this time of Jews. In effect, the illegitimacies of the past that have victimized the Palestinians and produced the present intolerable state of affairs, must be put to one side in peacemaking contexts, and the future framed by reference to how Palestinians and Jews can best live together when account is taken of all the circumstances of past and present, including the allocation of rights by the application of international law. This injunction of mutuality should not be interpreted as a readiness to forget the past, or to minimize its relevance. Rather it is an insistence that replicating past wrongs by superimposing on all of historic Palestine a new power structure that excludes or subjugates Jews is not ethically acceptable or politically feasible as goals of conceiving Palestinian empowerment. Said did insist, however, that grave past injustices endured by the Palestinians, especially the massive dispossessions of 1948 and again in 1967, must be confronted and acknowledged by Israel before any sustainable progress toward peace and reconciliation is possible. Similarly, there is no way of reconciling the contending claims of self-determination if Zionism clings to its demand of ‘a Jewish state’ and an exclusive unlimited right of return for Jews only.

 

The contention that Israel has become an apartheid state is highly relevant to grasping the fate endured by the Palestinian people over the course of the last hundred years. Most poignantly, if the quest for Palestinian self-determination continues to fail, the outcome of the unresolved struggle will almost certainly result in the further entrenchment of existing systematic structures of ethnic discrimination. Such structures possess the key elements of the international crime of apartheid. If this is so, it means that the very arrangement relied upon to sustain public order in Palestine and Israel is itself an ongoing international crime of utmost gravity. Apartheid is designated as a crime against humanity in the Rome Statute of 2002, the treaty that regulates the operations of the International Criminal Court.

 

In other words, the present and the future of the Israel/Palestine relationship cannot be understood in neutral, symmetrical, and static terms of both sides more or less equally thwarting the path leading to conflict resolution and enduring the same consequences if that path remains blocked. Unfortunately, this has long been the official American rebuke to both parties. John Kerry, the American Secretary of State, and President Barack Obama, never tire of telling Israel and Palestine that each must make ‘painful concessions’ if the deadlock is to be broken and peace to be attained. Such language conveys a fundamentally distorted image of the present reality because it refuses to take account of the essential and vital difference between the situation of the oppressor and the oppressed, a difference that becomes unmistakable if you experience directly the many dimensions of everyday inequality between the two peoples. Said (Pantheon, 2001, 443-458, esp. 445-449.]

 

The imagery of deadlock and equal responsibility for the unsatisfactory present reality also falsely implies a static situation that would seem detrimental to both sides. This is a false image because with the passage of time Palestine loses, and Israel gains. This is so territorially, but also to live as the oppressor is consistent in most respects with living well, while living under conditions of oppression or as refugees in to varying degrees living badly. Of course, power shifts are common, and roles can be reversed, although this does not seem likely anytime soon.

 

The existing Israel and Palestine interplay is constantly evolving. This understanding leads me to have a quite different overview of the present situation that I will express in a deliberately provocative way–either the future will witness a further entrenching of the Israeli apartheid state or Israel will abandon and dismantle current apartheid structures and accept a Palestinian call for peace in accord with international human rights law, and more generally, agree on steps that need to be taken to realize the Palestinian right of self-determination. As previously stated such a Palestinian realization of self-determination must not be exercised at the expense of a complementary Jewish right of self-determination. This is not meant as an indirect endorsement of Zionist goals as articulated by currently dominant Israeli forces. It is obviously difficult to adjudicate between these overlapping claims of self-determination, and doing so most likely requires help from genuinely detached third parties. Putting this more concretely, a spiritual homeland for the Jewish people in ancient Palestine would could be maintained, but not the current Jewish state with its preferential ethnically framed nationality laws, making Israel what the Jewish leader Henry Siegman perceptively identifies as an ‘ethnocracy’ rather than a ‘democracy.’

 

Let me acknowledge, without delving into the matter, that the Palestinian Authority (PA) and the Palestinian Liberation Organization, the formal representatives of the Palestinian people in international venues, has been partly responsible for the confusion about these fundamental points by seeming to go along with both a territorial definition of the conflict and a solution based on the Oslo process despite it being tainted by the United States acting in the role of intermediary. The PA posits its primary goal to be the establishment of some kind of Palestinian state on the currently occupied territory of the West Bank, and indeed claims that such a state already exists, a position affirmed by the General Assembly in a resolution adopted on November 29, 2012. This also allows Israel and the United States to continue treating ‘the peace process’ as necessitating direct negotiations between the parties despite Israel’s multiple efforts to de facto annex portions of the West Bank at Palestine’s expense ever since the early 1990s. By now it should be evident that these direct negotiations have given the Palestinians zero benefits for the last 20+ years while bestowing on Israel a golden opportunity to pursue its expansionist agenda in violation of international law. The fact that Israel continues to lend rhetorical support to such a peace process sustains for many the illusion that its government favors a genuine effort to solve the conflict through diplomatic compromise. Washington does its part, going sheepishly along not only because it habitually defers to Israel, but because playing this particular diplomatic game enables the United States to continue portraying itself as patron of a process dedicated to producing peace.

 

 

 

Understanding Israel’s Recourse to Apartheid

 

At a conference at the National Press Club on April 10, 2015 in Washington devoted to assessing and depicting the Israel Lobby as it operates in the United States, the influential Haaretz columnist, Gideon Levy, painted a picture of the current Palestinian ordeal concisely with a few verbal brush strokes. He emphatically told the audience what every follower of this ‘peace process’ should have understood long ago: “The two state solution is dead!” What does that mean? According to Levy, neither Israeli motivation nor any practical possibility of moving toward Palestinian self-determination is present, even in that constricted and inadequate sense of territorial empowerment with respect to currently occupied Palestine. Israel’s main policies have long been subversive of the establishment of an independent and sovereign Palestine, the major presupposition of the ‘two state solution.’ The centerpiece of this subversion is, of course, the settlement phenomenon—the establishment and continuous expansion of 121 settlements authorized by Israel (along with 102 so-called ‘settlement outposts’ that are formally unauthorized but are nevertheless officially supported and subsidized) that now provide unlawful homes for between 700,000-750,000 Israeli settlers. This massive encroachment on any future independent Palestine has been abetted by the multi-billion dollar construction of a network of settler only roads, and by building a separation barrier of several hundred miles many segments of which cut deep into occupied Palestinian territory. This notorious wall was authoritatively declared illegal by 14 of 15 judges of the International Court of Justice back in an advisory opinion issued in 2004, endorsed by the General Assembly, and summarily rejected by Israel.

 

Although Levy didn’t explain exactly what he meant by using the word ‘dead,’ it can be interpreted in two distinct ways: first, as Benjamin Netanyahu himself proclaimed in the recent Israeli electoral campaign, as long as he and the Likud Party control the government, Israel will never allow the formation of a Palestinian state in historic Palestine. This also seems to express the real views of a majority of Israeli citizens, and thus the utterance of views to the contrary by Netanyahu and other Israeli leaders for international consumption should be disregarded as a cynical move to placate public opinion; and secondly, even if the words were to be treated as sincere, the settlements, roads, and wall make a viable sovereign Palestinian state incapable of establishment even if Israel some day possesses the political will to bring it into being.

 

The two-state solution has long been what the NY Times columnist Paul Krugman calls a ‘Zombie Idea’, that is, a discredited idea that continues to be accepted as the way to solve a problem because it upholds the self-interest of some powerful political actors, thereby diverting attention from alternative solutions that could be burdensome for those who benefit from freezing the status quo; it is a zombie, as in being a ghost, which lives on beyond its natural death causing torment to those it haunts. In ghostly respect the two sate solution continues to be treated as the only solution for the convenience of the parties, including the United States, Europe, and the UN, despite their private awareness of its irrelevance. During my period as UN Special Rapporteur I was often privy to corridor conversations that acknowledged the absence of any hope for a two state solution, but in public it was business as usual with these same individuals expressing their fervent hopes that talks would soon resume and finally find common ground.

 

 

In the contrasting theater of ‘reality politics’ the prospects are for further Israeli unilateralism. This impression has been reinforced by the selection by the Knesset two years ago of Reuven (Ruvi) Rivlin as President of Israel. Rivlin is a rightest Likud figure long known for his unapologetic embrace of a one state solution that envisions the Israeli incorporation of the whole of occupied Palestine. Netanyahu, a wily politician, differs from Rivlin in fundamental respects, and despite both men belonging to the same political party, they disagree on key issues and are personal antagonists: Netanyahu has previously given lip service internationally to a diplomatic process built around bilateral negotiations, as well as expressing his provisional support on behalf of Israel to a two-state solution; somewhat surprisingly Rivlin, unlike Netanyahu, strongly opposes an apartheid approach to internal Israeli security. In its place, Rivlin offers the Palestinians a Faustian Bargain, if Palestinians agree to live in an orderly manner while foregoing self-determination they deserve to be treated as fully equal citizens within a Jewish state comprising Greater Israel, including a guaranty of unrestricted political participation that might even include a Palestinian victory someday in national elections. [elaborated in by David Remnick, “The One-State Reality,” The New Yorker, Nov. 17, 2014.] To obtain this equality of treatment, the Palestinians would be expected to accept this consummation of the Zionist Project in a form that was originally proposed by Ze’ev Jabotinsky the Zionist visionary who inspired the founding of the Likud Party!

 

It should be obvious that the Palestinians will never agree to such an outcome of their national struggle, which would amount to the acceptance of a humiliating political surrender. In the unlikely event that the Ramallah leadership of the PA ever dared to accept such a deal, perhaps disguised in its presentation by granting Palestinians some community and local rights of self-government, the Palestinian people are almost certain to reject it. Such an arrangement would not bring peace, but at most it would be seen as nothing other than one more ceasefire to be broken by a further cycle of renewed resistance.

 

In effect, combining the physical encroachment on any Palestinian expectations of a viable sovereign state of their own with the rightward drift of internal Israeli politics, makes the apartheid solution a near certainty whether in the form of a perpetuation of the present condition of irresolution or by adopting a version of the Israeli one-state outcome within which discriminatory structures will have to be maintained to uphold public order. In light of such futures, robust Palestinian resistance can be anticipated, and for Israel to contain and suppress it will require police and paramilitary structures of control at least as strong as has has long been operative in the West Bank, and in different modalities in Gaza, ever since occupation commenced in 1967.

 

Again referring to Levy’s Washington talk, he regards the cumulative impact of the occupation as having produced the “systematic dehumanization of the Palestinians.” Collective dehumanization is an almost sure sign of the presence of apartheid when those experiencing abuse are ethnically and territorially distinct, and have a sufficient demographic weight as to consider themselves as ‘a people’ rather than a victimized minority.

My own experience with Palestinians has certainly confirmed this dynamic of dehumanization, but it has also been coupled with shining instances of Palestinian humanization despite everything as well as with Israeli dehumanization associated with forcing its will by brute force on a totally vulnerable people being denied their most elemental rights.

 

At this point, a glance at history helps us appreciate the perversity of this emergence of apartheid in Palestine. It needs to be remembered that the Zionist project received its first decisive international endorsement in a strictly colonialist form, by way of an assurance in 1917 given by the British Foreign Secretary, Lord Alfred Balfour, to Lord Rothschild, the head of the Zionist Movement in Britain, that the British government would “view with favor the establishment in Palestine of a national home for the Jewish people.” At this initial stage, a Jewish state, as distinct from a national home, was neither endorsed in the text nor envisioned as an overt goal, although Zionist leaders seemed to have had this in mind from the beginnings of the movement in the late 19th century. Even the limited idea of a Jewish homeland was qualified by the clause “it being clearly understood that nothing shall be done to prejudice the civil and religious rights of existing non-Jewish communities in Palestine.”

 

The Balfour promise of a Jewish national home was intended to be fused with the British plan to govern the whole of Palestine primarily in pursuit of its strategic goals of safeguarding trade routes to India, and especially the Suez Canal. Britain resorted to its habitual colonial tactic of ‘divide and rule’ with respect to its administration of relations between Jews and Arabs. But as the peace diplomacy unfolded after World War I, the British were forced by the United States to roll back their overt colonial ambitions, and operate within the mandate system that entailed an international commitment to grant Palestine eventual national independence as a single independent state but also contained the Balfour promise of a Jewish national home. In actual fact, the British governed Palestine as a de facto colony during the mandatory period from 1920-1948, but their divide and rule approach backfired as the Jewish presence disproportionately increased and as Zionist statist ambitions became evident they began colliding with British policy. In the end Zionist extremists resorted to systematic terrorism with the goal of inducing the British to abandon Palestine. Palestine became ungovernable, and the British shifted from their divide and rule tactics to the advocacy of a partition plan that would divide Palestine into two national entities, one for Palestinians, the other for Jews.

 

After World War II, when Britain could no longer handle the burdens of administering Palestine, the UN was given the job of addressing these conflicting claims, and in GA Resolution 181 influenced by the British approach, a partition plan for Palestine was approved over the objection of Arab countries. In the UN plan, 55% of historic Palestine was awarded to the Jewish claimants, and the remaining 45% to the Palestinians. Jerusalem was given to neither side nor split, but was designated as a corpus separatum to be administered as an international enclave by the UN with the Trusteeship Council given the assignment.

 

There was no attempt by the UN to implement, or even consider, self-determination by consulting the will of the resident population in Palestine, which was then overwhelmingly opposed to partition. Partition was a paternalistic initiative of the international community that in effect ratified the settler colonialist approach of the Zionist movement as initially facilitated by Britain and later greatly strengthened due to developments in Europe, especially Germany. Not surprisingly partition was at the time rejected by the Palestinian majority population and accepted by the Zionists, resulting in the 1948 War, decisively won by the Jewish side. This battlefield outcome shrank the Palestinian remnant from 55% to 22% of the land, and also de-internationalized the city of Jerusalem, putting West Jerusalem under the control of Israel and East Jerusalem under the administrative authority of Jordan ; in the course of the 1948 war, there occurred the forcible dispossession of an estimated 750,000 Palestinians accompanied by the destruction and depopulation of as many as 531 Palestinian villages. The Palestinians recall and observe these events as the nakba, or catastrophe, a narration of national tragedy that combines the politics of dispossession with the tactics of massive ethnic cleansing.

 

Subsequent consequences, associated with refugee camps in neighboring countries, the 1967 War that resulted in Israel’s occupation of the rest of Palestine, and intensifying hostility toward Gaza, especially after 2006, are viewed by Palestinians as a continuation of the nakba, conceived now more adequately as a process through time rather than as a circumscribed event.

 

If we consider the sweep of developments over the course of the century a pattern emerges that continues into the present. Put simply: ever since the Balfour Declaration of 1917, the Palestinians have survived within a steadily diminished horizon of expectations, while the Zionist Movement was continuously widening its horizons. The unfolding of this dual process can be crudely expressed by reference to three periods: the first, lasting from 1917 to 1947, the mandate period during which the demographic balance of Palestine started shifting due to Jewish immigration, a dynamic accelerated by the emergence of Nazism that also increased international attention to and support for a Jewish homeland, and later, Israeli statehood; secondly, from 1948 to 1967 during a state-building period in Israel, with the West Bank and East Jerusalem administered as occupied territory in the aftermath of the 1948 War by Jordan and Gaza by Egypt; thirdly, from 1967 to the present when these Palestinian territories (as well as the Syrian Golan Heights) were shifted from Arab occupation to Israeli occupation, during which de facto annexation of portions of the West Bank, East Jerusalem, and Golan Heights took place. Gaza was first occupied and settled, with Israel ‘disengaging’ in 2005, but continuing to exert effective control over Gaza through its total regulation of borders, air space, and shoreline.

 

The UN is typically criticized for devoting too much attention to Palestinian grievances while overlooking other issues where the humanitarian urgency is as great or greater. This criticism that is frequently invoked by political leaders in Israel and the U.S. completely overlooks the degree to which the UN, and the League before it, have a special responsibility for the failure to resolve the conflict over Palestine. No where else in the world can such a humanitarian fiasco be laid so directly at the feet of the UN making it seem more appropriate to blame the Organization for doing too little or doing what it did ineptly, rather than blaming it for being obsessively focused on Israel’s wrongdoing with respect to Palestine and Palestinians.

 

 

 

 

The Politics and Ethics of Naming

 

Calling the Israeli domination of Palestinians within the various governmental zones of Israeli domination apartheid is one facet of the wider controversy. For ardent defenders of Israel the mere allegation of apartheid is inflammatory and viewed as so totally inaccurate as to suggest that anyone calling Israel an apartheid state is an anti-Semite. Israel defends its policies toward Palestinians in Israel and under occupation by invoking the democratic character of Israel in which Palestinians vote, form political parties, and enjoy membership in the Knesset. For Palestinians who live outside of Israel under occupation in the West Bank or Gaza, Israel justifies its policies by security considerations. And for the Palestinian refugees, Israel shifts blame to the Arab countries in which they are resident.

 

As the accusation of Israeli apartheid has become more and more mainstream pro-Israeli responses have become harsher. Even revered and eminent figures such as Jimmy Carter and Archbishop Desmond Tutu after expressing their opinion as to the actual and potential apartheid character of Israel have been defamed. Despite this effort to intimidate the use of the terminology of apartheid to describe not only the occupation of the West Bank but also the discriminatory regimes operative in Israel itself and East Jerusalem, as well as the oppressive securitization of Gaza, is increasing. Apartheid as the descriptive label of Israeli policy toward the Palestinian people has been gaining acceptability throughout the world, including within the UN. It has also captured the imagination of many campus groups in the West that organize Palestinian solidarity efforts and justify the BDS campaign under the banner of ‘Israel Apartheid Week,’ believing that the idea of apartheid now better expresses the essential character of Israel’s policies toward the Palestinian people than any other descriptive language. In retaliation, Israel and its NGO global network of support are seeking to criminalize civil society initiatives that flow from the apartheid analysis.

 

It is important to distinguish the political use of the terminology of apartheid in expressive and impressionistic modes from its legal usage in international law, although the two types of usage overlap. The legal conception of apartheid has evolved via the International Convention on the Suppression and Punishment of the Crime of Apartheid adopted in 1973. This treaty criminalized apartheid and made clear that the essence of the crime involved maintaining systematic regimes of extreme discrimination based on race or ethnicity, and although derived from the South African experience the crime was not limited to that particular type of discriminatory separation. The Rome Statute of 2002 that underpins the operations of the International Criminal Court categorizes the crime of apartheid within its broader classification of crimes against humanity in Article 7(1)(j). Article 7 provides a clear definition of apartheid as an: “..institutionalized regime of systematic oppression and domination of one racial group over any other racial group or groups and committed with the intention of managing that regime.” It is understood that ‘race’ is used here in a broad sense to encompass diverse ‘ethnicities’ or ‘religions.’

 

The political use of apartheid in relation to Israel does not attempt to pass legal judgment. It is rather an assessment based on the systematic character of structures of domination and discrimination that cannot be convincingly rationalized as either non-discriminatory or by reference to the reasonable requirements of Israeli security. In the background of the apartheid debate is the overarching idea of international humanitarian law as mainly set forth in the Fourth Geneva Convention to the effect that an occupying power has as its primary obligation the protection of civilians living in a society under occupation, subject only to the right of the occupier to adopt measures necessary to uphold security. The apartheid perception with respect to Palestinians is diverse and fragmented. This corresponds to the sub-regimes of control that Israel has established to deal with different segments of the Palestinian resident population.

 

The most clearly delineated apartheid structures are maintained in the West Bank where there is a pervasive subjugation of the Palestinian population by a regime of rightlessness as administered by Israeli military authorities, and to some extent since 1993 delegated to the Palestinian Authority. This regime gives rise to contrasts between the Palestinian experiences of everyday abuse and uplifting Israeli experiences of the rule of law and the stable life circumstances enjoyed by unlawful settlers. This bright line of discrimination is reinforced by the checkpoints, house demolitions, settler only roads, an intrusive separation wall, settler violence, and epitomized by the grossly unequal allocation of Palestinian water resources.

 

The 1.8 million Palestinians living in Gaza, especially since the Israeli ‘disengagement’ of 2005 followed by the Hamas electoral victory in 2006, have been subjected to the most severe sub-regime of discriminatory domination. The Gazan civilian population has been locked within the borders of Gaza and subject to periodic military attacks, chillingly described in Israel as ‘mowing the lawn.’ Jerusalem and pre-1967 Israel are administered by the government of Israel, and here discriminatory laws are based on nationality and administrative rulings limiting Palestinian rights and stability of residence, denying family unification, restricting employment and education opportunities, and imposing the domination of a Jewish state, creating a situation of pervasive human insecurity for the Palestinian minority. There are also about 1.6 million Palestinians living behind the Green Line within Israel’s 1967 borders as Israeli citizens, while being denied real equality due to this wide variety of nationality laws that blatantly privilege Jewish nationality.

 

In its totality, the Israeli apartheid system can be compared to the colonial governance approach of the British. The British derived security by ‘divide and rule’ tactics while the Israel approach can be summarized as ‘divide, dominate, and discriminate.’ In the first case, we have the traditional format of a colonial power, while in the second, the most obvious label is that of ‘settler colonialism,’ yet it must be particularized in relation to Palestine to be fully understood.

 

 

 

The Palestinian National Movement

 

The Palestinian struggle has gone through a series of overlapping stages during the course of almost a century. There was an early period of a building internal resistance by the native population to continuing Jewish immigration during the mandate period coupled with growing Zionist influence and militancy in Palestine. The British colonialist approach tended to support this buildup of the Jewish presence in Palestine, initially feeling more kinship with Jews as mainly fellow Europeans. This widening cleavage eventually led the British and then the UN to seek stability and conflict resolution via partition, dividing the two peoples territorially, with the hope of creating separate polities. The British reached the conclusion, which was endorsed by the UN, that Jews and Palestinians would never peacefully live together, and that separation was the only viable approach. This idea of partition, eventually accepted as a goal by many world leaders, including those representing the Palestinian people, has since the 1990s morphed into ‘the two state solution.’ Among its original flaws, aside from the arrogance of imposing a solution from without and above, was the dispersion of the native Palestinian population throughout all of Palestine, whereas the Jewish population was confined to certain portions of the country. This meant that even with dispossession many Palestinians would find themselves captive in the incipient Jewish state, and consigned to the status of a subjugated minority in what had been their homeland for countless generations.

 

The failure of partition led to a phase of Arab belligerency in relation to the Palestinian struggle. In wars waged in 1948, 1956, 1967, and 1973, it was the goal of neighboring Arab countries to liberate Palestine and Jerusalem by joint military action. These efforts were unsuccessful, resulting in a series of Israeli military victories, coupled with territorial expansion, and belligerent occupation.

 

The failure of such liberation from without was followed by a period of resistance from within, the formation of the Palestinian Liberation Organization under the leadership of Yasir Arafat. This rise of national resistance activity was especially pronounced in the years following the 1967 War, a period of nationalist resurgence by the Palestinian people. It was in this period that Palestinian armed resistance activity began being portrayed in the West as ‘terrorism’ and its suppression by Israel was welcomed, especially in reaction to internationalizing the Palestinian struggle through the staging of shocking violent incidents at the Munich Olympics, hijacking, exploding planes, attacking airports and passenger ships.

 

Armed struggle by Palestinians also was discredited and defeated by Israel’ effective counter-terrorist tactics and by its ability to tilt in its favor the media treatment of the conflict. In a spontaneous show of civil society activism, the Intifada of 1987 created a new previously unexpected challenge to Israeli dominance. In a show of populist unity and courage, ‘the war of the stones’ was defiantly waged by the Palestinian people. It communicated to the world the dramatic refusal of the Palestinian people to allow the occupation to be normalized. The inequalities in weaponry and suffering between the two sides began to shift the balance in the war of ideas and images, especially giving enhanced credibility to Palestinian narratives of victimization.

 

In response, the conflict once again became internationalized. The United States playing a leading role, culminating in the formulation of the Oslo Framework of Principles solemnized by Itzaak Rabin and Yasir Arafat with a historic handshake on the White House Lawn in 1993. Oslo diplomacy reflected the power disparity that exists between Israel and Palestine, and the naively bewildering trust of the Palestinian leadership in the good offices of the U.S. Government to deliver a decent agreement. It should not have been surprising that the diplomacy over these many years was of a one-sided variety that relied on fruitless periodic negotiations between the parties, with the United States serving as intermediary and wrongly assigning blame for failures to find an agreed solution to the inflexibility of the Palestinians.

 

The unwillingness of Israel even to stop settlement expansion during the negotiating sessions both exhibited the one-sidedness of the process and the underlying absence of political will in Israel to reach a fair settlement. Of course, there is an element of subjectivity with respect to the content of ‘fair,’ but international law could have offered guidelines had it been allowed to be relevant. And what is objectively clear was translating Israel’s unlawful ‘facts on the ground’ into new negotiating positions that continuously diminished Palestinian prospects. In retrospect, the Oslo diplomacy was based on the relative bargaining power of the two sides, combined with the intensity of their respective political will. It was also shaped by the American deference to Israel’s policy priorities, above all, its refusal to give ground on the right of return of dispossessed Palestinian refugees or to accept shared governmental authority in Jerusalem.

 

The intifada was the basis for what later became the legitimacy war strategy of struggle. The energy of Palestinian resistance shifted from top down to bottom-up, that is, to the agency of civil society. The formal authority or top-down Palestinian leadership is being bypassed. There is a rejection under existing conditions of both armed struggle and inter-governmental diplomacy, including via the UN. Major mobilization efforts are directed at delegitimizing Israeli policies and practices, as well as stimulating militant forms of nonviolent coercive support for Palestinian empowerment and liberation. This Palestinian version of a legitimacy war has been deeply influenced by the successful anti-apartheid campaign in South Africa, and has centered its actions in relation to a comparable BDS Campaign that responded to an appeal from a coalition of Palestinians NGOs in 2004, and has been gaining global momentum, including within the United States, especially, in the aftermath of the massive military onslaughts carried out against Gaza in 2008-09, 2012, and 2014.

 

Many sympathetic commentators believe that the Palestinians are winning this Legitimacy War, including the important Palestinian founder of the Electronic Intifada, Ali Abunimah. It is also the thesis of my book Palestine: The Legitimacy of Hope. I take note of the international experience since the end of World War II in which the side that prevailed in a Legitimacy War generally controlled the political outcome of conflicts, despite being militarily inferior. Recourse to a Legitimacy War strategy usually reflects two kinds of developments: a societal sense of moral outrage that combines with the refusal of governments and international institutions to promote a just solution.

 

This unfolding of the legitimacy discourse has definitely moved in a direction favorable to Palestinian hopes. In the years following World War II, Israel was seen as the David battling the Arab Goliath, with Israel scoring unexpected military victory after military victory against hostile larger neighbors accused of seeking to throw the Jewish people into the sea. The Palestinians were portrayed as ‘rejectionists’ that defied the UN’s plan widely deemed at the time in the West to be a reasonable compromise. This negative image of Palestinian political behavior was further strengthened by the portrayal of Palestinian resistance as ‘terrorism.’ This violence was widely perceived as unacceptably threatening the Jewish people, and reminded the world of the Holocaust and the fate of Jews during the Nazi period. Such a link between Jewish victimization in the Holocaust and the Palestinian/Arab struggle was strongly promoted through intense Israeli propaganda efforts. (hasbara)

 

This image, which remains strong in the West, and certainly is powerful in the United States where Israel is viewed not only as the most admirable and dynamic country in the region, but also as the most important strategic partner Washington possesses and a recipient of intense support in Christian evangelical circles. This strategic bonding was greatly facilitated by Israel’s military prowess as revealed in its victorious wars, especially the 1967 War, and given additional reinforcement through its long experience of counter-terrorism that was treated as a major Israeli contribution to American security policies in the aftermath of the 9/11 attacks.

 

Concluding Comments

 

The basic drift of my argument is as follows:

            –UN authority was not able to obtain a solution;

            –armed struggle and international statecraft were tried, but both failed to resolve the conflict or improve the Palestinian position;

            –what this leaves is either Israeli unilateralism, carrying out the Zionist endgame of incorporating the whole of Jerusalem and the West Bank into Israel, and claiming to be the state of the entire Jewish people, or a Legitimacy War victory by the Palestinian people that induces a cycle of ‘new diplomacy’ on a level playing field;

            –in the interim, any further attempts to revive the Oslo diplomacy, even enjoying should they enjoy the cynical of the Netanyahu government should be resisted as a dead end that is more harmful to the Palestinian struggle than is facing the realities of Israeli expansionism.

 

Given this understanding of the conflict, and considering the extraordinary record of military assistance given to Israel by the United States government, the American people have an increasingly dishonorable connection to the conflict. The American indulgence of Israeli exceptionalism includes issuing a free pass to Israel when it secretly became a nuclear weapons state. American citizens have a special responsibility for the long ordeal of the Palestinian people. The Jewish philosopher, Abraham Heschel observed “[f]ew are guilty, but all are responsible.” The Legitimacy War scenario gives each of us ample opportunities to exercise our individual responsibility. We owe the Palestinian people and ourselves nothing less.

 

Five Palestine Futures

Background and Foreground      

 

 

For years, perhaps going back as far as the Madrid Peace Conference of 1991, influential international debate on the future of Palestine has almost exclusively considered variations on the theme of a two-state solution. The American Secretary of State, John Kerry, stampeded the Palestinian Authority and Israel into negotiations that ‘failed’ even before they started a year ago. At least Kerry was prudent enough to warn both sides that this was their do or die moment for resolving the conflict. It was presumed without dissent in high places anywhere that this two-state outcome was the one and only solution that could bring peace. Besides the parties themselves, the EU, the Arab League, the UN all wagered that a resolution of the conflict required the establishment of a Palestinian state. Even Benjamin Netanyahu became a reluctant subscriber to this mantra in his 2009 speech at Bar-Ilan University, although always in a halfhearted spirit.

 

The reasoning that underlay this consensus went along these lines: a viable solution to the Israel-Palestine conflict could not challenge the Israeli commitment and the essential Zionist Project to create a homeland for Jews worldwide; this meant that self-determination for the Palestinian people would have to be addressed separately, and the only way to do this was by way of a partition of historic Palestine. The British had come to this conclusion as early as 1936 in the Peel Commission Report (a British Royal Commission that concluded that the British mandate as applied to the whole of historic Palestine was unworkable because of the tensions between the two ethnic communities, and proposed that partition be imposed), which became the basis for the solution proposed in 1947 by the UN in General Assembly Resolution 181. It was reaffirmed in Security Council Resolution 242 unanimously adopted after the 1967 War that reduced the portion of Palestine assigned to the Palestinian from 45% to 22%, calling for the withdrawal of Israeli forces from the territory occupied as a result and reaffirming the principle of international law that territory could not be validly acquired by force of arms.

 

Underneath the partition consensus there is an intriguing puzzle to solve: why has the consensus persisted despite the leadership of neither Israel nor Palestine seeming to have opted for partition except as a second best outcome. The Palestinians made their dislike of partition manifest from the outset of large scale Jewish immigration in the decades after the Balfour Declaration of 1917, believing that imposing a Jewish homeland, much less a Jewish state, was an unacceptable colonial encroachment. In the late 1980s the Palestinians, as represented by the Palestine Liberation Organization, adjusting to the realities of Israel’s presence, accepted the idea of partition in the historic decision in 1988 of the Palestine National Council. In its essence, the Palestinians endorsed the vision embedded in SC Res. 242, envisioning a Palestinian reality based on an Israeli withdrawal to the pre-war green line borders, an expectation that, of course, never materialized.

 

More subtly, the Zionist leadership was at best ambivalent about partition, appreciating it initially as a path leading to sovereignty, which exceeded ‘homeland’ as a political outcome, and represented more than they could have hoped for earlier in their movement, yet decisively less than the biblical vision of Israel as encompassing the whole of historic Israel. As the situation evolved since Israeli independence, Israel has continuously revised its sense of a favorable balance of forces making it seem realistic to seek a fuller realization of the Zionist dream. In recent years, the Israeli one-staters have started to gain the upper hand, based partly on what has been happening on the ground, partly by the rightward drift of the governing coalition, and partly from the absence of real incentives to compromise territorially due to the falling away of Palestinian armed resistance and the absence of meaningful pressure from Washington. There is a renewed reliance in Israel on the contention that the ‘Palestinians’ do not really have a distinct ethnicity, and hence are not a ‘people’ entitled to self-determination under international law. Palestinians are and should be viewed as ‘Arabs.’ As such, they have no need for another state as already 22 Arab states exist. In my experience, within Israel, almost no Israelis refer to Palestinians as other than as Arabs, except of course the Palestinians.

  

Of course, what a Palestinian state meant to the Palestinians was different than what it meant to the Israelis. Additionally, what it meant for the Palestinian Authority was also far apart from what the Palestinians overseas dispersed communities and the refugee camps believed to be the necessary components of peace. Almost necessarily, the focus on Palestine as a state rather than Palestine as the communal recipient of rights reduced the conflict to a territorial dispute supposedly susceptible to solution by a ‘land for peace’ formula. This approach marginalized other Palestinian grievances, above all, the right of return of Palestinian refugees, creating tensions between Palestinians living under occupation and Palestinians living in refugee camps and in exile. It also situated issues relating to Jerusalem in some indeterminate zone that was neither territorial nor distinct from territorial claims.

 

On the Israeli side, too, there were big variations. The dominant Israeli position in recent years has been one in which the dimensions of a Palestinian state must be subordinated to the imperatives of Israeli security as defined by the Israeli government. In effect, that would mean confiscating all of Occupied Palestine to the West of the separation wall and the settlement blocs as well as controlling the borders and maintaining for an indefinite period Israeli security forces in the Jordan Valley. In addition, Palestinians must renounce all their claims as part of a final status agreement, which would seem also to imply the end of any assertion of a right of return for 1948 and 1967 Palestinian refugees. More maximalist versions involve even larger annexationist features and treat the city of Jerusalem as exclusively belonging in perpetuity to Israel. On top of all these demands is the insistence by Netanyahu that the Palestinian Authority recognize Israel as a Jewish state, which both relegates the Palestinian minority in Israel to permanent subjugation and effectively renounces any Palestinian right of return.

 

The Israeli government having in recent years become virtually inseparable from the settler movement has long appreciated that the function of endorsing a Palestinian state was little more than a way of appeasing, and thereby neutralizing, world public opinion, given its insistence that a political solution was possible and necessary, and could only happen if the Palestinian got their state, satisfying at the very least, the territorial core of self-determination. Even now the Palestinian Authority continues to sing the same lyrics, although the melody is more solemn. The Palestinian governmental representatives in recent years have lost even the ability to say ‘no’ to international negotiations despite having nothing to gain from the recurrent charade of such American orchestrated gatherings and quite a bit to lose by way of expanding settlements, the altered makeup of Jerusalem, and a gradual shifting international mood in the direction of accepting Israeli maximalism as unassailable, if regrettable. Ironically, Israeli media influence and the supportive voice of the U.S. Government also blames the Palestinians for each round of failed peace talks, although for the first time, the Israel obstructionist role was so evident, Washington blamed both sides.

 

 

There is no light at the end of this particular tunnel. With what appears to be the death throes of a failed peace process is being acknowledged in the form of an eerie silence in high places. There is an absence of conjecture or advocacy as to how the conflict might end abetted by the recent focus on the turmoil in the region, especially the renewed chaos in Iraq and intensifying strife in Syria that has shifted public and media attention away from the Israel-Palestine agenda. This evasive silence has for the present replaced earlier false hopes invested in futile diplomatic negotiations. In retrospect, it is easy to conclude that political preconditions for conflict-resolving negotiations premised on a viable Palestinian sovereign state never truly existed on the Israeli side, assuredly after the assassination of Yitzhak Rabin in 1995. This is mainly because the expansionist vision of the right-wing settlers became more and more accepted as official state policy in Tel Aviv, and there was no longer pressures being mounted by Palestinian armed struggle. On the Palestinian governmental side, in contrast, there was an eagerness to end the occupation and attain the status and rituals associated with being a sovereign state. Confusion surrounded the practicalities of what such an arrangement would yield. It always seemed doubtful as to whether a deal like this could be sold to the Palestinian people if it left the several million Palestinians living in refugee camps and overseas out in the cold. This assessment is especially true since the death of Arafat in 2004, which has led to a virtual leadership vacuum on the Palestinian side.

 

The security logic of the Israeli right is that Israel will only be able to maintain its security over time if it continues to control all or most of the West Bank. This image of security reflects the view that real threat to Israel no longer comes from Palestinian armed resistance. It comes from the surrounding Arab world that is moving toward more advanced weaponry, and at some point is almost sure to again turn its guns and missiles in an Israeli direction. Additionally, pushing toward a similar understanding, is the view that the full realization of Zionism involves the incorporation of the West Bank, always referred to in internal Israeli discourse by their biblical names of Judea and Samaria.

 

Peace through bilateral negotiations presided over by the United States has long seemed moribund to many close observers, but after the recent collapse of the talks this top down diplomatic approach seems discredited even among governments and at the UN, at least for now. Yet it is impossible for most of the world to accept the finality of such a stalemate that favors Israel, in effect, ratifying land grabs and apartheid structures, while consigning the Palestinians to regimes of misery of for the indefinite future, which translates into the rigors of permanent denial of rights, oppression, refugee camps, and involuntary exile. This bleak assessment raises the question ‘What Now?’

 

           

Constructing a New Box

 

 

In situations of this sort, where differences seem irreconcilable, the common call is ‘to think outside the box.’ The old box was the consensus associated with the two-state mantra, which appeared to have a solidity that never truly existed. Now appearances are more reliable. At present there is not even a box to think within. Yet silence and despair is not an option while Palestine suffering and denial of rights endures. Future alternatives need to be imagined and appraised. Five seem worth pondering, and each has some plausibility.

(1)  Israeli One-State: Such an end game involves extending Israel’s border to incorporate most of the West Bank, keeping the settlements except, perhaps, relinquishing control over a few isolated outposts. This vision of Palestine’s future takes on heightened political relevance considering that Reuven Rivlin, the newly elected Israeli President, is an open advocate of a supposedly humane version of an Israeli one-state outcome, a position that directly contradicts Netanyahu’s endorsement of an eventual Palesinian state. This benevolent version, spelled out in some detail by an influential settler advocate, Dani Dayan, calls for a radical easing of Palestinian life in relation to day to day humiliations, ranging from the numerous checkpoints, restrictions on mobility, and anticipates and supports the dismantling of the separation wall. Dayan proposes that the Israeli government take a series of steps to raise the Palestinian standard of living significantly. He admits that this type of ‘economic peace’ will never satisfy Palestinian political/legal grievances relating to territory, independence, and the right of return. Such a proposal is essentially offering the Palestinians a Faustian Bargain in which Palestinians give up their rights of resistance in waging a political struggle for self-determination in exchange for the tangible psychological and economic advantages of living better lives materially and enjoying some measure of dignity within an Israeli structure of governance. The obstacle here is that the authentic voices representing the Palestinian people seem united in refusing to renounce their political ambitions and their right of resistance. The acceptance of such an arrangement would be widely understood, including among the Palestinian people, as a political surrender to the de facto realities of Israeli settler colonialism carried to its maximalist endpoint. It is relevant to note that the Dayan proposal is coupled with the expectation that the Palestinians would renounce in principle and practice any right of violent resistance, while the Israeli state would be entitled to engage in violence whenever the perceived imperatives of security so demanded.

 

 

(2)  Binational One-State: The more idealistic version of the one-state solution presupposes a secular state that encompasses the whole of historic Palestine, establishes a unified government with democracy and human rights for all, and creates semi-autonomous regions where Jews and Palestinians can exercise self-administration and freely express their separate national and ethnic identities. In effect, the two dominant peoples in Palestine would agree to live together within a single sovereign state on the basis of equality and democracy, but with agreed provisions creating separate national communities preserving culture, tradition, ethnicity, and religious affiliation. There are several obstacles: given the realities on the ground and the attachment of an overwhelming majority of Israelis to the Zionist Project of a Jewish State with its unlimited right of return for Jews worldwide, the proposal seems utopian, lacking political traction. Furthermore, the disparities in wealth and education would likely lead to Israeli hierarchy, if not dominance and continued exploitation, in any process that purported to unify the country on a non-Zionist basis.

 

 

(3)  Israeli Withdrawal from Occupation: In this proposal, there would be no explicit shift in the structures of governance. In a manner similar to the 2005 Sharon Disengagement Plan for Gaza, this new initiative would apply to those portions of Palestine that Israel seeks to incorporate within its final international borders. This arrangement would leave the Palestinian Authority in charge of the remnant of the West Bank, as well as Gaza. It would maintain the actuality of the occupation regime, but without the presence of Israeli security forces and keep the separation wall, imposing rigid border controls and continue repression, effectively depriving Palestinians of the enjoyment of their most basic human rights. This approach                          rests on the assumption that Israeli military control is able to implement such a solution as well as to deal with external threats mounted from hostile forces in the region. The main obstacle is that Palestinians would have no incentive to accept such an outcome, it would be denounced in most international settings, including the United Nations, and it would have the likely political consequence of further isolating Israel in global settings.

 

(4)  Palestinian Self-Determination: There is some new thinking in the Palestinian camp, most articulately formulated by Ali Abunimah in his important book, The Battle for Justice in Palestine. The emphasis is on civil society activism and nonviolent Palestinian resistance as building global support for a solution that is responsive to the Palestinian right of self-determination. What form self-determination eventually assumes is a matter, above all, for Palestinians to decide for themselves. The realization of self-determination presupposes leadership that is accepted by authentic representatives of the whole of the Palestinian people, including those living as a minority within Israel, those living under occupation, and those in refugee camps and involuntary exile. The contours of the territorial division or unity that emerges would be the outcome of negotiations, but its embodiment would address the legitimate grievances of the Palestinian people as defined by international law and international human rights and include a formal acknowledgement by Israel of past injustices done to the Palestinian people. The main obstacle here is one of hard power disparities and rigidities, as well as the continuing, although weakening, Jewish worldwide engagement with the Zionist Project. The way around such an obstacle is to gain worldwide support that mounts sufficient pressure on Israel, the United States, and Europe so as to induce a recalculation of interests by Israeli leaders and citizens based on a new realism associated with the increasing leverage of growing Palestinian soft power capabilities.

 

(5)  Peaceful Co-Existence: In recent years, Hamas, strangely seems to be the last holdout for a version of the two-state solution, although in its maximalist form. Israel would need to withdraw to the 1967 borders, end its blockade of Gaza, and give Palestine control over East Jerusalem. The main obstacle here is that Israel would have to abandon its expansionist goals and dismantle the settlements, although it could retain the Zionist Project in its more limited territorial applications to Israel as it existed in 1967. The secondary obstacle is that the Hamas Charter calls for the total removal of the entire Jewish presence from historic Palestine, making the proposal seem tactical and untrustworthy, and at most intended to serve as an interim arrangement, an uneasy truce and unsustainable peace. Hamas officials have indicated a willingness to commit to 50 years of coexistence, a period in which much could change, including even the primacy of the statist framing of political community. It is impossible to imagine Israel accepting such a blurry outcome that rolled back the factual realities of expansion that have been created by Israel over the course of several decades. Besides, whatever its content the very fact that Hamas was the source of such a proposal would alone be sufficient to produce an Israel rejection.

 

A Concluding Comment

 

It is obvious that none of these five approaches seems either attractive enough to challenge the status quo or politically persuasive enough to shift the balance of forces bearing on the conflict. Yet, there are signs indicating both that the Israelis are moving toward a unilaterally imposed option and the Palestinians are becoming more inclined to combine nonviolent resistance with support for militant global solidarity. On the one side, the Israeli settler movement is on the front line, and on the other, the Palestinian BDS campaign is gathering momentum as the leading expression of the Palestine National Movement. In both instances, at this time the relevant governmental entities have been marginalized as political actors in relation to the struggle. This is itself an extraordinary development, but where it will lead remains obscure. Two images of the near future seem most relevant. From an Israeli perspective: the consummation of the Zionist project by the incorporation of all or most of the West Bank, the further ethnic consolidation of control over the whole of Jerusalem, and the rejection of any humanitarian responsibility or political ambition with regard to the Gaza Strip. From a Palestinian perspective: the growth of the global solidarity movement to a point where an increasing number of governments impose sanctions on Israel, reinforced societal initiatives associated with the BDS campaign, giving rise to new thinking in Israel and the United States about how best to engage in damage control. If such a point is reached, the experience of transforming apartheid South Africa into a multi-racial constitutional democracy is almost certain to intrigue the political imagination.
