Making Peace: Israel/Palestine

[Prefatory Note:  Interview with Samu Tamás Gergő, a Hungarian journalist, April 9, 2019, on conditions of peace for the Palestine/Israel, with some initial emphasis on my experience as UN Special Rapporteur addressing human rights in Occupied Palestine on behalf of the Human Rights Council in Geneva.]

 

 

 

– Mr. Falk, you were an UNHCR special rapporteur on “the situation of human rights in the Palestinian Territories occupied since 1967” for six years. How normal is that, a UN member, Israel worked against your appointment? What is the goal in this job? The UN needs “independent” experts or members from the “two sides” (pro-Palestine and pro-Israel)?

 

The Special Rapporteurs of the UN Human Rights Council fall into two categories: most address thematic issues such as torture, religious freedom, and rights of indigenous peoples; a few deal with country scale problems, including Iran, North Korea, and the Occupied Palestinian Territories. SRs are appointed after the President of the HRC approves consensus vote of the 49 member states for a three year term, generally renewable for another three years. The position is unpaid, and SRs are not international civil servants, which gives them independence and insulates their role from political pressures to some extent. They can be dismissed only if they exceed their mandate.

 

The idea of having SRs is to secure independent and trustworthy information pertaining to a particular concern, especially of controversial issues. Reports are prepared for submission to the HRC in Geneva and the Third Committee of the General Assembly each year. The expectation is for the SR to be objective, and present both sides of contested issues.

 

My role as SR for the Occupied Palestinian Territories was sharply contested from the outset. Israel objected to the very idea of having a SR for the OPT, and did their best to get someone appointed who would report the facts in a manner that was consistent with their propaganda. I found that Israel’s occupation was so clearly and flagrantly in violation of the rules and principles of the Fourth Geneva Convention governing Belligerent Occupation that my reports were consistently critical of Israel’s behavior, especially with respect to extension of settlements to the OPT, annexation of Jerusalem, imposition of collective punishment, and use of excessive force to maintain security.

 

By and large, Israel and its main allies did not challenge the substance of my reports, but directed their complaints at my alleged bias and lack of credibility. The effort was to wound the messenger and avoid the message.

 

– What are the specific consequences of such reports? In addition to forcing the violators of international treaties into self-restraint, is Israel in this case?

 

It is difficult to assess the precise effects of these SR reports. Israel rejects the validity of inquiries under UN auspices, claiming bias and sovereign authority. It also refuses, contrary to its obligations as a UN Member to cooperate with SRs and most UN activity that its administration of Jerusalem’s sacred sites. At the same time Israel is sensitive to the impact of such reports on world public opinion, and relies mainly on Zionist. Watchdog NGOs, UN Watch and NGO Monitor to push back by doing their best to discredit the reports most often by questioning the credentials of the author.

 

The reports on Occupied Palestine did have two broad effects. First, their assessments influence the way issues bearing on Palestinian rights and Israeli wrongs are discussed at the UN, by some important governments, by NGOs, and especially by non-Western media. I remember meeting with the Foreign Minister of Brazil who told me that his ministry relied on these SR reports to obtain their understanding of developments in the OPT.   Over the years the role of SRs has gained in stature as their reporting provides generally reliable information, and their independence, including of the UN bureaucracy has. created credibility and some respect for willing to accept such a position that entails much work, no pay, and can be met with defamatory responses.

 

The. second impact of the reports is to confer legitimacy on pro-Palestinian nonviolent initiatives in civil society throughout the world. The most meaningful such initiative is the BDS Campaign (Boycott, Divest, and Sanctions). There are other initiatives that involve cutting off institutional cooperation between academic institutions in Israel and other foreign countries, such as study abroad programs. Israel is aware that such global solidarity efforts were a principal cause of the collapse of the apartheid regime in South Africa. Israel seems to regard this legitimacy war conducted against their policies and practices as now posing a larger threat than armed resistance by the Palestinians.

 

In particular, Israel has been affected by the increasing acceptance of the view that its form of control of the Palestinian people as a whole constitutes apartheid, which according to the Rome Statute governing the International Criminal Court is one type of Crime Against Humanity, as specified in Article 7. The assessment of Israel as an apartheid state was the principal conclusion of a UN report in 2017 of which I. was the co-author prepared at the request of. the UN under the auspices of the UN Economic and Social Commission for West Asia (ESCWA).

 

Overall, I think we can conclude that these reports are important although they fail to modify Israeli behavior to alter their policies and practices to bring them into conformity with international law. Their importance is informational and with potential impacts on international public opinion, which often translates into soft power, and this has been more important in the end in shaping the political outcome of many conflicts since World War II than has hard power.

 

– What about the imprisoned Palestinians? Are interrogations and other prison conditions in compliance with the international law and Israeli law?

 

Israeli practices with respect to imprisonment has come under constant criticism, especially with respect to the treatment of children, reliance on administrative detention, torture, and unsanitary conditions. Particular attention has been to the Israeli practice of nighttime arrests, taking children from their homes in the presence of their parents, often with accompanying violence that has terrifying effects that are. long-lasting. Children are giving heavy prison terms for minor acts of symbolic resistance to prolonged Israeli occupation, including the throwing of stones at distant soldiers that have been rarely if ever been injured as a result. There are reliable studies of Palestinian children in Gaza that reveal severe demoralization even to the extent of losing a will to life itself. Suicide rates among adolescents and young adults have been rising.

 

Another violation of international standards is to take those arrested to prisons outside occupied Palestine located within Israel. This deprives prisoners of family visits, and isolates prisoners in a cruel manner over prolonged periods of time.

 

There have been frequent long hunger strikes in Israeli prisons protesting conditions. Israel, contrary to international medical ethics, has tried to force feed fasting individuals to avoid their dying in such a way, thereby creating adverse publicity.

 

There are several published collections of prison writings that convey the abuse of human rights associated with the manner in which Palestinians are treated by Israeli administering authorities.

 

– You told me earlier, “extension of settlements to the OPT, annexation of Jerusalem, imposition of collective punishment, and use of excessive force to maintain security” are the main violations of the Geneva Conventions. What is your opinion about the new situation with Jerusalem?

 

I assume that here you are referring to the 2017 initiative by the Trump White House to move the American Embassy from Tel Aviv to Jerusalem. Such a move defies a deeply held longtime international consensus. The UN position is that Jerusalem has. been ‘occupied territory’ according to international law since the 1967 War and it is hence unlawful to alter its status in any way that interferes with its societal character and status. The proposed embassy move was condemned as null and void, with a demand to rescind the decision, by a one-sided UN General Assembly vote. (see GA Res. 11935, 128-9-35 absentions, 21 December 2017). The future of Jerusalem is a matter that according to this global consensus can only be settled by negotiated agreement between the two parties for which there is no present prospect. The United States defied the General Assembly and officially moved the U.S. Embassy to Jerusalem on 14 May 2018. From an international law and diplomacy points of view, the status of Jerusalem remains unresolved.

 

Israel defied this consensus immediately after the 1967 War by unilaterally annexing Jerusalem, enlarging its territory by incorporated large additional amounts of Palestinian occupied land, and declaring that an undivided Jerusalem would be the eternal capital of Israel. This annexation of Jerusalem was condemned by the UN Security Council in Resolution 478 (by vote of 14-0, with USA abstaining, 20 August 1980). As with the embassy move, this Israeli initiative was a violation of the law governing belligerent occupation, as set forth in the 4thGeneva Convention, including especially the unconditional prohibition on states acquiring territory by force of arms. As such, the annexation lacks any legal significance, but it does create a political set of conditions that are difficult to reverse, and become more so, given the long passage of time.

 

Thinking ahead to the future, there will be no genuine peace until the claims of the Palestinians with respect to Jerusalem, which also reflect the wider claims and concerns of especially Islam, but also Christianity, are given formal recognition. The future of Jerusalem is a test case of whether the Palestinian right of self-determination will be someday realized, or will be forever frustrated by Israeli expansionism reinforced by the geopolitical support it receives from the United States, which has been carried to new heights under the Trump presidency in ways that have brought strong denunciations from governments traditionally supportive of Israel and allied with the United States.

 

– As far as I know, you have Jewish ancestry. Does this mean you ethnically Jewish and/or religiously? Nonetheless, you were called “antisemitic”, because you criticized Israel. In is your opinion is the Jewish community in the US mostly Zionist, or is there a relatively strong part of the Jewish community that recognizes the right of Palestine to have an independent, internationally recognized,  and sovereign state?

 

To respond to the personal part of your question first, yes I am Jewish genetically, but neither culturally nor religiously. By this I mean I was brought up in New York City in a secular and assimilationist atmosphere where what was important was to be ‘American’ and ‘human’ rather than to emphasize ethnicity or religious identity. My parents were extreme versions of secularism, and this prompted a reaction that may explain my strong lifelong interest in comparative religion. In my own identity, I consider my species identity as ‘human’ to be primary, and other signifiers,  including nationality, to be secondary.

 

The reason I have been called anti-Semitic by militant Zionist NGOs and their followers is because I support the national struggle of the Palestinian people for their rights, and I have in the context of UN activity described Israel as ‘an apartheid state.’ This description of Israel is based on the academic study of Israeli policies and practices toward the Palestinian people as a whole, and not only those living under occupation, in relation to the crime of apartheid as defined in international criminal law. It is unfortunate, and harmful to Jews, for Zionists to extend the meaning of anti-Semitism from hatred of Jews to criticism of Israel. In my view only when Israel dismantles its apartheid structures of control over Palestinians will sustainable peace be attainable for both Jews and Arabs.

 

Turning to the part of the question concerning the outlook of Jews in America, according to polls more than 85% of Jews do consider themselves to be Zionists in the minimal sense of supporting the existence of Israel as a. Jewish state. But a growing minority of Jews is critical of the Likud/Netanyahu leadership of Israel, and an even larger number would favor a balanced approach by the US Government to the relationship between Israel and Palestine. This latter Jewish viewpoint is usually identified with what is called ‘liberal Zionism’ that tends to favor a two-state solution. In American domestic politics the split is obvious in Washington lobbying groups. AIPAC is unconditionally pro-Israeli, and with rare exceptions refrains from criticism of Israeli wrongdoing, adopting a punitive approach to those who like myself are critical of Israel.  J-Street is a smaller lobbying organization representative of liberal Zionism that is critical of some Israeli policies while being avowedly pro-Israeli, while lending support to the. two-state solution.

 

My own position is critical at this stage of all forms of Zionism. I believe the original failure of the Zionist project was to impose a Jewish state on a non-Jewish society. It is important to remember that at the time of the Balfour Declaration (1917) pledging British support for a Jewish homeland in Palestine the Jewish population was less than 8%, and even in 1947 when the UN General Assembly recommended partition, the Jewish population was about 30%. What this means is that from the very beginning the inalienable right of self-determination of the resident Arab population was being ignored and an essentially settler colonial arrangement was being promoted and later imposed by force.

 

I agree that as of now, however dubious the earlier history, the Jewish population must be accommodated in any future peace agreement, but I am very doubtful that this could or should be done within a framework of two separate sovereign states. Israel by its deliberate actions over many years has made this outcome a practical impossibility. The encroachment of more than 600,000 Jewish settlers onto occupied Palestine cannot be reversed by nonviolent means. In this regard, the only sustainable peace would be a single democratic secular state with the protection of human rights for all. Ethnic or religious states are by definition suppressive of minority rights, and thus inconsistent with the modern commitment to human rights as originally set forth in the Universal Declaration of Human Rights.

 

Such a one-state solution is not endorsed by liberal Zionism as it would mean the abandonment of the core idea of ‘a Jewish state’ as a sanctuary of the Jewish people. It is my view that Jews and others would be better off in a secular environment dedicated to the implementation of human rights for all. True an ethnic state may impose a protective regime for the favored ethnicity but it is likely to arouse enmity among other ethnicities, and over time likely to generate external pressures. The underlying challenge for all communities is to live together humanely on the basis of equality.

 

What is your opinion, could be peace and two separated but cooperative states in the territory of Palestine/Israel in the near future?

 

Earlier, I was of the view that it is up to the parties to decide how to reconcile their overlapping claims to self-determination in Palestine. I thought that the Palestinians had suffered for too long from external. political actors seeking to shape the future of Palestine. The Balfour Declaration in 1917 and the UN partition resolution of 1947 were both interferences by international actors as to how the conflict over Palestine should be resolved. It was time, I felt, to let the two peoples to work out their own solution. In retrospect, there were problems with my position: First, it was not clear that the Palestinian people were being legitimately and adequately represented within international venues, especially after the death of Yasir Arafat. This raised the question, still not answerable, of who could speak authoritatively on behalf of the Palestinian people. Secondly, the disparity in power, accentuated by the U.S. role as a partisan third party intermediary, presiding over the diplomatic framework, made it unlikely that a sustainable peace could be negotiated by relying upon such a flawed process.

 

In recent years, I have shifted my view to a one democratic state position. Israel through a variety of actions, including expanding the settlements, building the wall, establishing security zones has made it a practical impossibility to establish an independent, equal, sovereign state of Palestine. Furthermore, Israel’s leadership and public opinion feel triumphant, especially with Trump in the White House, and no longer feel the need for a political compromise, and seem to be moving step by step toward imposing their own apartheid version of a one-state solution on the Palestinian people.

 

It is true that the UN and the international community continue to affirm the two-state solution as the only viable outcome if peace is the goal. Why, when it is so obviously a dead-end? To abandon the two-state approach would acknowledge the failure of UN and international diplomacy. Additionally, the durability of two-state thinking results from the influence of Zionism on the international approach to peace. A democratic and secular one-state would necessitate giving up the goal of a Jewish state, requiring a retreat to the original Balfour pledge of a Jewish homeland, and involve a major Zionist downsizing.  Such a retreat is a necessity, in my view, if there is ever to be a political arrangement for Palestine based on the essential equality of the two peoples and creating the conditions for a sustainable peace.

 

The reason for a mood of despair is obvious. What is desirable seems politically unattainable, while what is attainable seems unacceptable. Under these conditions false consciousness is bound to flourish. To overcome this mood of despair, we should not look to the UN or the United States. Our best hope for a just peace for both peoples is a heightening of pressure from civil society to such a level as to prompt Israeli leaders and the Israeli public, as well as diaspora Jewry to. recalculate their own interests so as to incorporate the realization of basic Palestinian rights.

 

  

 

 

Jerusalem and Foreign Embassies: Legal, Political, and Diplomatic Implications

Jerusalem and Foreign Embassies: Legal, Political, and Diplomatic Implications

 

Q1—A few days ago Prime Minister Benjamin Netanyahu met with president of Honduras and with Mike Pompeo in Brasilia to discuss establishing of an Israel embassy  in Tegucigalpa and the transfer of Hondurean embassy from Tel Aviv to Jerusalem. Pompeo then travelled to Colombia to try to convince the government in Bogota to relocate its embassy in Jerusalem. How do you interpret these efforts and their implications?

 

A: It seems obvious that Israel is trying to induce enough governments to move their embassy to Jerusalem so as to weaken the legal, political, and diplomatic weight of the General Assembly Resolution of 22 December 2017 [Res. ES-10/L.22] that declared such an initiative by the United States to be ‘null and void’ by a vote of 128-9 (with 35 abstentions), finding the proposed move unlawful and lacking any political effect. Such a one-sided pushback by the UN was undertaken as an angry reaction to the announced decision of the U.S. Government to make such a move in defiance of the international consensus that had for 50 years overwhelmingly supported the consensus of governments that the future of Jerusalem would be determined by diplomatic negotiations between the parties, and any premature recognition of Jerusalem as Israel’s capital would be inappropriate and disruptive. This challenge to this UN consensus has definitely become a high priority for Israel’s foreign policy, at least so long as Netanyahu remains Prime Minister.

 

It may also be relevant that the upcoming Israeli elections on April 9th, and Netanyahu’s troubles at home with corruption charges directed at him and his wife, provide an added incentive to show that he has achieved positive results from the perspective of the Zionist Project to extend Israel’s national sovereignty to Jerusalem, as well as to most of the remaining portions of ‘the promised land’ supposedly belonging to Israel by biblical entitlement and historic tradition. Such Israeli expansionist ambitions and actions are encroachments on the inalienable right of self-determination belonging to the Palestinian people.

 

The U.S. motivations are related, but somewhat different. Of course, during the Trump presidency Israel can do no wrong, and what Israel wants, the U.S. does despite political opposition and moral opprobrium. The embassy move is a prime example of American unilateralism with respect to Jerusalem. Additionally, the U.S. Government wants to be less diplomatically isolated on a global level, and thus appear less disruptive when it so acts. This issue also provides the Trump leadership with an opportunity to create alternative alliance networks to outmaneuver the kind of regional groupings that have existed in the past. Independent of this issue, American foreign policy seeks to substitute a network of likeminded autocratic leaders for such traditional solidarities as NATO or the OAS, or for that matter, the UN. In this connection it is notable that such traditional American allies as Britain, France, Germany, and Japan voted for the UN resolution condemning the U.S. proposed action with respect to Jerusalem, and this reciprocated by acting independently of Washington’s strongly declared preferences.

 

 

 

Q2– What would be real symbolism of transfering embassies from Tel Aviv to Jerusalem? Why such maneuvers are being considered so polemical? 

 

A: In my view, the real significance of the embassy move, aside from it being consistent with other steps viewed as displaying the extreme nature of Trump’s support for Israel’s approach to resolving decades of tension with the Palestinian people and their national movement, is to demonstrate that U.S. foreign policy will not be constrained by multilateral diplomacy or the positions prevailing in international institutions, and especially the UN. This ultra-nationalist approach to policymaking and problem solving is an overt rejection of cooperative approaches to difficult collective challenges in international relations that had previolusly enjoyed Washington’s support ever since the end of World War II.

 

On another level, the embassy move is supportive of Israel’s rejection of a political compromise with Palestine, and Tel Aviv’s current strategy that seems to hover between allowing the present unresolved future to go on indefinitely, while the settlements expand in Jerusalem and the West Bank, and taking advantage of its present position to achieve, or at least declare, an Israeli victory and Palestinian defeat. In this regard, the status of Jerusalem is part of a broader context of settlement expansion, excessive force in responding to Palestinian resistance, Knesset legislation in which Israel is proclaimed to be a state belonging exclusively to the Jewish people, who alone are entitled to national self-determination, and a denial of refugee status to descendants of Nakba refugees.

 

These moves are treated as so controversial because they are seen as imposing an ordeal without an end in sight upon the Palestinian people as a whole, including those languishing in refugee camps throughout the Middle East, in exile, and as a discriminated minority in Israel itself. Israel as an apartheid state cannot maintain such structures of racial domination without relying on these oppressive and discriminatory patterns of governance. In this regard Israel has moved in the eyes of the world from being ‘the only democracy in the Middle East’ to being ‘the only apartheid state in the Middle East.’ Erasing this perception is part of what is at stake by such efforts to confer legitimacy on its territorial expansionism and its ethnic hegemony.

The Middle East is Heating Up — Again: An Interview with Richard Falk (with C.J. Polychroniou)

 

[Prefatory Note: This is a somewhat modified text of an interview of two weeks ago conducted by the Greek journalist and author, C.J Polychroniou. Since then several developments have occurred, none more significant than the Return Home Land Day demonstrations of March 30, 2018. The original interview appeared in several online publications. The format is altered to make somewhat more reader friendly.]

 

CJP: Richard, let’s start with Donald Trump’s decision to officially recognize Jerusalem as Israel’s capital and to move the US embassy there by May of this year. First, is this legal from the standpoint of international law, and, second, what are likely to be the long-term effects of the US recognition of Jerusalem as Israel’s capital on the region as a whole?

 

RF: There is no question, Chronis, that Trump’s Jerusalem policy relating to recognition and the move of the American embassy is regionally and religiously provocative and disruptive, underscoring the abandonment by Washington of even the pretense of being a trustworthy intermediary that can be relied upon by both sides to work for a sustainable peace between the two peoples. Some critics of the initiative are saying that the U.S. is free to situate its embassy in Jerusalem, but the whole of Jerusalem isn’t Israel. The status of this holy city remains to be determined and East Jerusalem, where the Old City is located, which for the present is considered to be an ‘occupied territory’ in international humanitarian law.

 

Recognition of Jerusalem as the capital of Israel is a clear violation of international humanitarian law, which rests on the central proposition that an occupied territory should not be altered in any way that changes its status and character without the consent of the occupied society. It also is a unilateral rejection of a near unanimous international consensus, endorsed by the United Nations, that the future of Jerusalem should be settled by negotiations between the parties as a part of a broader peacemaking process. Israel had much earlier violated both international law and breached this international consensus by unilaterally annexing an enlarged Jerusalem, and declared that the whole city, within expanded boundaries, would be the ‘undivided, eternal capital’ of Israel. It is notable that the General Assembly on December 21, 2017 approved by an overwhelming majority of 128-8 (35 abstentions) a strong condemnation of the U.S. move on Jerusalem, with even America’s closest allies joining in this vote of censure.

 

It is difficult to predict the long-term consequences of this diplomatic rupture. It depends, above all, on whether the U.S. Government acts convincily to restore its claim to act as a conflict-resolving intermediary. The Trump administration continues to insist that it is working on a peace plan that will require painful compromises by both Palestine and Israel. Of course, given the unconditional alignment of Washington with Netanyahu’s views of Israel and the Palestinian future, as well as the orientation of those entrusted with drafting the plan, it is highly unlikely that even Mahmoud Abbas and the Palestinian Authority, generally accommodationist will be inclined to enter a diplomatic process that is virtually certain to be weighted so heavily in favor of Israel. Yet as many have come to appreciate, nothing is harder to predict than the future of Middle Eastern politics.

At the same time, Jerusalem has an abiding significance for both Islam and Christianity that makes it almost certain for the indefinite future that there will be formidable regional and civilizational resistance to subsuming Jerusalem under Israeli sovereign control.

CJP: Israel appears bent on restricting Iran’s rising influence as a regional power in the Middle East. How far do you think the US can go in assisting Israel to contain Tehran’s strategy for empowering Shia’s?

 

Richard Falk: Israel and Saudi Arabia are both for different reasons determined to confront Iran, and quite possibly, initiate a military encounter with potentially widespread ramifications for the entire region, if not the world. A quick glance at the Syrian conflict suggests how complex and dangerous is this effort to destabilize the Iranian governing process, with the dual objectives of destabilizing the governing process mixed with the more ambitious goal of causing civil strife of sufficient magnitude as to produce a civil war, and ideally from the perspectives of Iran’s adversaries, regime change.

 

The Israeli adherence to this recklessness seems partly motivated by its overall security policy of seeking to weaken any country in the region that is hostile to its presence and has the potential military capability to threaten Israeli security and regional role in a serious manner. Israel has been so far successful in neutralizing each of its credible adversaries in the region (Saudi Arabia, Iraq, Egypt, Syria) with the exception of Iran. In this sense, Iran stands out as the last large unfinished item on Israel’s post-1967 geopolitical agenda. Israel’s real intentions are difficult to pin down, shifting with context and perceived opportunity. Netanyahu and other Israeli leaders frequently manipulate the alleged Iranian threat to cause fear among Israelis. Their goal seems to be the mobilization of domestic support for adhering to an aggressive foreign policy. This manipulation panics many Israeli security specialists who express are more alert to the risks of an actual military confrontation with Iran than are political leaders.

 

Saudi motivations are quite different, associated with a fierce regional rivalry that is articulated in terms of a sectarian clash between Shia and Sunni Islam, aggravated by a concern that Iran’s influence increased as a result of the Iraq and Syrian Wars, which both seem to have outcomes favorable to Tehran. The sectarian rationale of the conflict seems intended to disguise the more fundamental explanation, which is that there is a power struggle between these two sovereign states to determine which one will achieve regional ascendancy. The sectarian explanation was also somewhat undermined by the intensity with which the Saudis and other Gulf monarchies used their financial and diplomatic resources to crush the Muslim Brotherhood in Egypt despite its strong Sunni identity. From the time of the Iranian Revolution in 1979 Tehran looked upon the monarchy governing Saudi Arabia as corrupt and decadent in the same manner as it regarded the Shah’s dynastic rule in Iran as politically illegitimate.

 

Your focus on how far the U.S. can go in restricting Iran’s influence is difficult to assess at this point. Trump’s virtual repudiation of the agreement on Iran’s Nuclear Program seems to express a commitment to join with Israel and Saudi Arabia to engage in coercive diplomacy, consisting of intensifying sanctions, covert operations to encourage internal opposition, and a variety of military threats. Where this will lead, if indeed it goes forward in defiance of the other parties to the agreement and almost all UN members, is anybody’s guess, but it is a highly irresponsible diplomatic gambit that risks a deadly ‘war of choice.’

 

Trump’s regional diplomacy, such as it is, has been most notable for giving even greater emphasis to the ‘special relationships’ with Israel and Saudi Arabia than earlier American leaders. Even previously, under Obama, George W. Bush, and prior presidents, the subordination of American strategic interests and national values to this posture of unquestioning support, which is the operational significance of designating these links as special relationships.

 

 

 

CJP: Syria’s civil war not only continues unabated but the country has become a battlefield for the spread of the influence of various powers in the region, including Turkey and Russia. Do you see a way out of this mess?

 

Richard Falk: The Syrian War is among the most complex conflict patterns in the history of warfare. Not only is there an internal struggle for control of the Syrian state that has been waged by not one, but by several insurgent movements that are not even compatible with one another. There is also a regional proxy war pitting Saudi Arabia, UAE, and Qatar against Iran, with Turkey playing a confusing role that sometimes seems guided by anti-Damascus goals but at other times is preoccupied with curtailing the Kurdish challenge. The various national struggles of the Kurds for autonomous rights, possibly independent political communities, threatens the territorial integrity of several Middle Eastern states, as well as Syria. In addition to all of this there are major multi-faceted and fluid Russian and American involvements on opposite sides, although not even this opposition is clear cut and consistent. For a time there was an almost collaborative effort to defeat ISIS and obtain a Syrian ceasefire, although the basic involvement has been to put Russia on the side of the Damascus government and the U.S. as aligned with the insurgencies.

 

Because the anti-ISIS dimension of the conflict is at odds with the anti-Damascus dimension, depending on the priority accorded to one rather than the other, alignments are contradictory and shifted over time. Sometimes precedence has been given to achieving regime-change in Damascus by removing Assad from power, and in such contexts, it was acknowledged silently that ISIS was the most effective military challenge on the ground being mounted against the Syrian government. At other times, the counterterrorist campaign against ISIS was given uppermost prominence, and there was even high-level indications that Washington was willing to live with the Assad regime, a position given added credence recently due to the success of the Syrian government in quelling its opposition, making continued opposition futile politically and irresponsible ethically. Whenever pragmatism gained the upper hand, Russia and Iran were accepted as partners in these efforts to defeat and destroy ISIS.

 

All wars eventually come to an end, and I am sure Syria will not be an exception. Yet it difficult at present to project a solution that brings about more than a ceasefire, and even this kind of ending of what has become an orgy of senseless killing is highly elusive, as each of the many parties to the conflict jockeys violently for minor positional advantages to improve its bargaining leverage when the conflict enters some kind of negotiating phase. Although all wars end eventually, internal wars of this kind, especially with such complex regional and international aspects, can simmer for decades with no clear winner or loser as has been the case in the Philippines and Colombia. It seems as if at present the Syrian government believes it is on the verge of victory, and is pressing for an outcome in East Ghouta and Idlib such that it will not be expected to make significant concessions.

 

The best hope, which has been the case for several years, is that the various parties will recognize that the situation is indeed a mess that is causing mass suffering and widespread devastation without producing political gains. Yet translating that recognition into a formula that produces an end to the violence has so far proved futile and frustrating as each party sees the conflict from its partisan perspective of gain and loss.

 

 CJP: With the two-state solution having ceased long ago being a viable alternative, what are the most likely prospects for the future of Israeli-Palestinian relations?

 

Richard Falk: The safest response is to anticipate a persistence of the present status quo, which involves continuing Israeli expansionism by way of the settlements and the persistence of the Palestinian ordeal, with some resistance in the occupied West Bank, Gaza, and East Jerusalem and a growing global solidarity movement exerting pressure on Israel in the form of the BDS campaign. There may be some attention given to a variety of proposals to end the conflict by revived diplomacy. The Trump blustery promise of ‘a deal of the century’ has received skeptical attention, but its likely one-sidedness makes it almost certain to be a non-starter, especially as the Israeli government feels insufficient pressure to produce a peaceful solution based on a genuine political compromise and the Palestinian Authority remains unwilling to accept a demilitarized statelet as a token Palestine state, or even to participate in negotiations that are so obviously stacked against it. For public relations reasons, the international consensus clings to the two-state solution even though, as your question suggests, its viability has long been superseded by Israeli expansionist policies intended to fulfill the Zionist goal of making the boundaries of Israel coterminous with the whole of the Jewish biblical conception of the ‘promised land.’

 

There are other outcomes that are possible. Daniel Pipes has been promoting what he dubbed ‘the victory caucus,’ which posits Israel as the victor in the struggle to establish a Jewish state and Palestine the loser. Pipes argues that diplomacy has failed to resolve the conflict after years of effort, and hence that the only alternative is for one side to win and the other to lose if peace is to be established. He encourages Israel to escalate pressure on the Palestinians to make them see the light, accept the reality of a Jewish state, and move on. Such an initiative is distasteful to those who support the Palestinian struggle, and it seems oblivious to the claims of international law and international morality as these are generally understood in the 21st century when colonialism and ethnic nationalism are illegitimate forms of political control and the right of self-determination has become universally accepted as an inalienable right of an oppressed people in the circumstances of the Palestinians.

 

In my view, neither the two-state nor a consensual one-state outcome of the struggle is currently within the realm of political feasibility. We are necessarily speculating about future political scenarios within the domain of ‘political impossibility.’ Yet the impossible sometimes happens. Colonialism was successfully challenged, the Soviet Union collapsed, South Africa renounced apartheid, the Arab Spring erupted. In none of these cases did such occurrences seem possible except in retrospect. After the events, as expected, experts appeared who explained why these impossible developments were, if closely considered, inevitable.

 

In this spirit, I think it useful to acknowledge the limits of rational assessment, and either remain silent, or offer for consideration, a solution that is ‘impossible,’ yet ‘desirable’ from the perspective of humane values, which in this case involves a secure, equitable, and sustainable peace for both peoples that is, above all, sensitive to their equality and to their distinct, yet legitimate, claims to self-determination. I find it unimaginable to realize such a peace within the current structure of the Middle East, which consists of a group of artificial and autocratic states held together by varying mixtures of coercion, corruption, and external military assistance. Israel/Palestine peace cannot unfold in a benevolent manner without a structural return to the Ottoman framework of regional unity and ethnic community, and possibly Islamic caliphate, adapted to post-colonial realities. Such a stateless Middle East would reverse the harm inflicted on the region by the imposition of European territorial states through the infamous Sykes-Picot diplomacy.

 

 CJP: South Africa’s former apartheid system has been employed analytically by many to describe the current status of the state of Israel with regard to it’s treatment towards Palestinians. Indeed, it is from such a comparison that the Boycott, Divestment and Sactions (BDS) movement was borne, but to what extent are the two cases compatible? South Africa was pretty much isolated by the early 1980s, but the same cannot be said about Israel today. In fact, Israel has even managed to expand recently it’s network of allies with Greece and the Sunni states. So, what are your thoughts on the comparison between the former South African apartheid regime and Israel and the effectiveness of the strategy of BDS?

 

RF: Your question raises two distinct issues: Is Israel responsibly regarded as an ‘apartheid state’? If so, is Israeli apartheid similar to South African apartheid?

 

Prior to responding to these questions, it seems helpful to clarify the status of the international crime of apartheid as it has evolved in international law, taking particular note of the fact that although the name and core idea is based on the specific condemnation of South African racism, the international crime is detached from this precedent. The essence of the international crime is any form of discriminatory domination by one race over another that relies on ‘inhuman acts’ to sustain its purposes. In this important sense, Israeli forms of domination over the Palestinian people may be quite different than the domination of whites over blacks in South Africa and yet constitute the international crime of apartheid. Treating apartheid as an international crime is based both on the 1973 International Convention on the Suppression and Punishment of the Crime of Apartheid and on the 2002 Rome Statute governing the operations of the International Criminal Court that categorizes ‘apartheid’ in Article 7 as one of eleven types of Crime Against Humanity.

 

In a study commissioned by the UN Economic and Social Commission, Virginia Tilley and I concluded that the policies and practices of Israel toward the Palestinian people as a whole satisfy the requirements of the international crime of apartheid. Our conclusion is based on the view that Israel, to maintain an expanding Jewish state has subjected the Palestinian people to structures of subjugation and victimization that are sustained by excessive violence and other inhuman means. It was our judgment that Jews and Palestinians are distinct ‘races’ as the term is understood in international law. The scope of Israeli apartheid is based on coherent strategies designed to subjugate the Palestinian people whether they are living under occupation, the most obvious case, or as a discriminated minority within Israel or as residents in refugee camps in neighboring countries or living is a global diaspora as involuntary exiles. Each of these domains is connected with the Israeli efforts to ensure not only the prevalence of a Jewish state, but also a secure Jewish majority population that could only be achieved by a process of dispossession, dispersion, and fragmentation, as well as by the denial of any right of return.

 

South African apartheid was very different in its operation as compared to Israeli apartheid. For one thing, white South Africa was a minority demographic in the country and critically dependent on black labor. For another, the South African concept of law, citizenship, and democracy was delineated along racial lines, while Israel claims to be an inclusive democracy, although is more accurately understood to be an ethnocracy. Despite these fundamental differences, the core reality of ‘inhuman acts’ and ‘discriminatory structures of domination’ are present, although distinctly enacted, in both national settings.

 

Finally, it should be understood that such allegations of Israeli apartheid are made on the basis of academic study, and while they may be persuasive morally and politically, it is also true that until a valid tribunal passes judgment on such allegations, the legal status of the allegations remains unresolved, and is of course feverishly contested by Israel and its supporters.

 

CJP: Overall, what are the prospects for restored stability and a positive future for the countries in the Middle East?

 

RF: Without the intervention of unanticipated developments, the prospects are poor. On one level, the extreme turmoil in countries such as Syria, Yemen, Iraq, and neighboring Libya are likely to continue and could spread to additional states. On a second level, the regional rivalries between Iran and a Saudi led coalition on the one side and Israel on the other, seem likely to intensify. On a third level, there is no plausible scenario for establishing a sustainable peace between Israel and the Palestinian people. On a fourth level, with the reassertion of Russian engagement and the U.S. pursuit of a strategic agenda related to Israel, oil, political Islam, Iran, and nuclear nonproliferation, the region has as in the Cold War become a site of dangerous geopolitical maneuver and confrontation. On a fifth level, perhaps less serious than the others, is the sort of intra-regional tensions that have given rise to the Gulf Crisis centered upon the relations of Qatar to other Gulf countries, and to the role of Turkey as partner and antagonist, especially in relation to the continuing search of the Kurdish peoples for self-determination. Finally, on a sixth level, there is almost certain to be new expressions of internal strife and various extremisms that strike against the West, inviting retaliation, which will probably be accompanied by further migratory flows that aggravate relations between the Middle East and Europe.

 

The drastic and prolonged victimization of the Middle East also exhibits the failure of the West to understand, much less address, the root causes of conflict and chaos that have produced mass suffering and material deprivations throughout the region. These root causes can be traced back at least a century to the imposition of European style states on the region, reflecting colonial ambitions, in the aftermath of World War I and by way of a colonial pledge to the world Zionist movement to support the establishment of a Jewish homeland in Palestine, then inhabited by a Jewish minority not larger than 6%. The other principal root cause related to the abundance of oil in several parts of the Middle East, which created rentier mentalities in development contexts and provided strong strategic motivations for intervention and control by global political actors.

 

In the end, this complexity joining the historical past to the tormented past creates a dismal set of prospects for the future of the Middle East. At this point, only paradoxical, although unrealistic, hopes for prudence and moderation can make the portrayal of the situation less gloomy than the evidence and trajectory suggest.

After the Interview: A Postscript on the Land Day Massacre (‘Great March of Return’)

 

The precise statistics remain inconclusive, although there exists general agreement that more than 15 Palestinians were killed by live ammunition fired by Israeli snipers stationed at the border with Gaza, another estimated 750 Palestinians were injured by ammo and rubber bullets resulting in an estimated total of 1,500 injuries, including from tear gas dropped on the largely unarmed demonstration. Whether the Israeli behavior should be viewed as ‘excessive force’ or ‘collective punishment,’ or both, is a matter for debate, but there is no question that the killings and firepower were in direct conflict with Israel’s obligations as an Occupying Power as specified in the Fourth Geneva Convention. Israel’s ‘disengagement’ in 2005 did not end the occupation from the perspective of international humanitarian law, but rather rearranged its management, with control and deployments being concentrated on the borders rather than throughout Gaza, and reinforced by periodic massive military incursions causing large numbers of civilian casualties and widespread devastation.

 

This latest interaction returned the Palestinian litany of grievances to the front pages of the world’s media often accompanied by gruesome pictures, but also revealed two kinds of gaps: between the Western and non-Western media and between the mainstream media response and that of civil society. The mainstream media worries that this is a public relations setback for Israel and urges restraint on both sides. In contrast, the activist segment of civil society condemns the Israeli tactics as constituting a massacre, and calls for an arms embargo. This distinction at the level of response is revealing, with the mainstream and almost every Western government pinning their public hopes on reviving negotiations aiming at a political solution based on the establishment of a sovereign and independent Palestine. Engaged civil society has lost all faith in diplomacy under current conditions, believes only escalating nonviolent pressure can change the political climate sufficiently to make negotiations sufficiently promising to undertake, and then only if the two-state mantra is abandoned once and for all.

 

 

 

 

The Banality of Evil: Diverting the Palestinian Struggle

The Banality of Evil: Language Entrapment or Political Malevolence?

 

It seems a language game is being played. Or is it better understood as a political maneuver suffused with bad intentions?

 

Governments and international institutions with the wonders of modern information-gathering technology at their disposal continue to endorse the ‘two-state solution’ while civil society observers on all sides of the conflict mostly realize that as matters now stand Israel is adamant in its refusal to allow an independent Palestinian state to emerge and feels no pressure from the Trump White House to feel otherwise. Regardless of feelings, with an estimated 700,000 Israeli settlers living in unlawful settlements, the obstacles to creating the sort of Palestinian sovereign state that was supposed to emerge from Oslo diplomacy, the Arab Peace Initiative, and the Quartet Roadmap has long ago evaporated into thin air with hardly a whimper of outrage, or even disappointment, from even the Palestinian official representatives at the UN or the PLO directorate in Ramallah.

 

Daniel Pipes, always at the service of Zionist ambitions, has been beating the drums for an iron-fisted end game that resolves the conflict with the clarity of an acknowledged Israeli victory and a Palestinian defeat. As for the two-state solution, it is ironic that Pipes words ring truer than those that emanate from the capitals of the world, Speaking plainly, Pipes says “(t)he two-state solution, an absurdity at present (it means asking Israel to strengthen its mortal enemy) will make good sense after a Palestinian defeat.” One can only imagine the paltry reality of what Israeli ‘good sense’ will produce after a Palestinian surrender! But the question that interests me here is why Pipes can be clear eyed about a reality that the UN and inter-governmental discourse are unwilling to admit. Trump, forever the outlier, is so far forthright enough to refuse to endorse the two-state solution, thus breaking, at least implicitly, with the inter-governmental/UN consensus that other recent American presidents have all pledged to their utmost to implement. Of course, Trump’s defection is best explained as his docile readiness to take his marching orders from domestic Zionist maximalists who helped bankroll his campaign for the presidency.

 

On a recent visit to Israel for a meeting with Mahmoud Abbas, the German Foreign Minister, Heiko Maas, reaffirmed the zombie international consensus as if was an alive political option, declaring that the new German government remains committed to a two-state solution to the Israeli-Palestinian conflict. Such an assertion can be better understood if decoded—the German government has no intention of exerting any pressure on Israel to reach a political compromise, and he seems to be urging the Palestinian leadership to adopt a similar line.

 

At the UN the harshest criticisms of Israel continue to be its tendency to hamper progress toward a two-state solution, which would be notable if anyone in the know believed it to be a viable political option. For instance, in the important Security Council censure of Israeli settlement behavior (SC 2334. 23 December 2016) the Preamble wrote these words of explanation: “Expressing grave concern that continuing Israeli settlement activities are dangerously imperiling the viability of the two-state solution based on the 1967 lines.” “Dangerously imperiling,” as if the solution was not long since defunct. On what planet are these governmental representatives living? Or do these governments know better, but have secondary reasons for pretending differently?

 

In operative paragraph 3 of the General Assembly resolution (21 Deember 2017, A/ES-10/L.22) overwhelmingly condemning (128-9, with 35 abstentions) the provocative Trump move to recognize Jerusalem as the capital of Israel, and to so relocate the American embassy, a similarly misleading assertion is made: the GA “Reiterates its call for reversal of the negative trends on the ground that are imperiling the two-state solution.” I would be rude enough to say, ‘wake up, world,’ the two-state solution is not in the peace picture any longer, and maybe never really was.

 

The new call for peace that has real potential political traction, and is increasingly endorsed throughout civil society is ‘End Apartheid,” superseding the earlier effort to achieve by direct action an outcome that could be converted into a de facto Palestinian state: ‘End the Occupation.” For several reasons, this emphasis on withdrawal from occupied Palestine was always insufficiently responsive to the full reality of Palestinian suffering and struggle. It failed to emphasize the long-term plight of Palestinian refugees and involuntary exiles, and omitted mention of the discriminatory and in many ways worsening daily reality of the Palestinian minority in Israel.

 

In some respects the most dismaying statement of all along these lines was issued by the Inter-Parliamentary Union (IPU) in their rebuke of Trump’s Jerusalem initiative that was just now disseminated with the evident approval of the Palestinian National Council:  “The IPU noted that the resolution undermines the legal and political status of a peaceful settlement between Israel and Palestine and any hopes for a two-state solution. The IPU stressed that it would continue to pursue its efforts to promote dialogue and peace between the two parties, Israel and Palestine, and in the Middle East region. What is distressing about such a statement is that it seems to suppose that Israel is in the slightest degree interested in participating in a dialogue on the conditions of peace if that means walking a path leading to the emergence of a Palestinian state. The minimum requirement for dialogue is some degree of mutuality, which has not existed on the Israeli side for some years, and to pretend that it does is a way of sidestepping the real challenge—do nothing but watch while Israel moves ahead with its unilateral end game or join the struggle to prevent a culminating Palestinian tragedy by moving out of the diplomatic shadows and into the political arena of coercive politics.

This is not the time for dialogue and displays of good will. That time has long passed. Now is the time for engagement, for pressure, for boycott, and for sanctions. When governments are serious about pursuing elusive goals, whether these are benevolent or not, they choose sanctions, coercive diplomacy, and leave the military option on the table. I am only too glad to leave the military option off the table, while insisting upon a post-diplomatic posture of militant nonviolence. The Palestinian people have suffered long enough! They should not be further enticed to rely on tactics of futility. Not only is silence in the face of evil and suffering unacceptable, so is passivity, and even more, false consciousness.

Finally, we should ponder why the civil society focus on the BDS Campaign is so much more attuned to the Palestinian ordeal than is this nonsesnsical inter-governmental and UN two-state discourse. My reference to Hannah Arendt’s influential, if controversial, treatment of the Eichmann trial, was not lacking in forethought. Governments, and the UN as a global network of governments, is not inclined to confront seriously the suffering of others unless vital national interests and geopolitical priorities of its principal members so decree. Here, considering that Israel has become a regional powerhouse, backed unconditionally by the United States, conditionally by the West as a whole, and now opportunistically even by most Arab governments, the geopolitical realities favor an international posture of hands, given deceptive twists by moralizing rhetoric, occasional slaps on the Israeli wrist, and a garland of illusions in the ritual form of pledging a meaningless allegiance to the continuing vitality of the two-state solution. We need to muster clarity of will to declare that affirming the two-state solution under present conditions is proof that the banality of evil lives on in our time.

 

 

 

 

 

 

 

 

Evolving International Law, Political Realism, and the Illusions of Diplomacy

International law is mainly supportive of Palestinian grievances with respect to Israel, as well as offering both Israelis and Palestinians a reliable marker as to how these two peoples could live normally together in the future if the appropriate political will existed on both sides to reach a sustainable peace. International law is also helpful in clarifying the evolution of the Palestinian struggle for self-determination over the course of the last hundred years. It is clarifying to realize how the law itself has evolved during this past century in ways that bear on our sense of right and wrong in the current phase of the struggle. Yet at the same time, as the Palestinians have painfully learned, to have international law clearly on your side is not the end of the story. The politics of effective control often cruelly override moral and legal norms that stand in its way, and this is what has happened over the course of the last hundred years with no end in sight.

 

 

The Relevance of History

 

2017 is the anniversary of three crucial milestones in this narrative: (1) the issuance of the Balfour Declaration by the British Foreign Secretary a hundred years ago pledging support to the World Zionist Movement in their campaign to establish a homeland for the Jewish people in Palestine; (2) the passage of UN General Assembly Resolution 181 seventy years ago proposing the partition of Palestine between the two peoples along with the internationalization of the city of Jerusalem as a proposed political compromise between Arabs and Jews; and (3) the Israel military occupation of the West Bank, East Jerusalem, and the Gaza Strip over fifty years ago after the 1967 War.

 

Each of these milestones represents a major development in the underlying struggle. Each combines an Israeli disregard of international law the result of which is to inflict major injustices on the Palestinian people. Without due regard for this past, it will not be possible to understand the present encounters between Israelis and Palestinians or to shape a future beneficial for both peoples that must take due account of the past without ignoring the realities of the present.

 

Israel is sophisticated about its use of international law, invoking it vigorously to support its claims to act in ways often motivated by territorial ambitions and national security goals, while readily evading or defying international law when the constraints of its rules interfere with the pursuit of high priority national goals, especially policies of continuous territorial encroachment at the expense of reasonable Palestinian expectations and related legally entrenched rights.

 

To gain perspective, history is crucial, but not without some unexpected features. An illuminating fact that demonstrates the assertion is that when the British foreign office issued the Balfour Declaration in 1917 the population of Palestine was approximately 93% Arab, 7% Jewish in a total population estimated to be about 600,000. Another historical element that should not be forgotten is that after World War I there were a series of tensions about what to do with the territories formerly governed by the Ottoman Empire. In the background was the British double cross of Arab nationalism, promising Arab leaders a single encompassing Arab state in the Ottoman territories if they joined in the fight against Germany and its allies in World War I, which they did. Palestine was one of these former Ottoman territories that should have received independence within a unified ‘Arabia,’ which almost certainly would have led to a different unfolding over the course of the last century in the region.

 

As European greedy colonial powers, Great Britain and France ignored commitments to contrary, and pursued ambitions to control the Middle East by dividing up these Ottoman imperial possessions, making them colonies of their own. These plans had to yield to friction that resulted from United States Government support of the ideas of Woodrow Wilson to grant independence to the Ottoman territories by applying the then innovative and limited idea of self-determination. It should be appreciated that Wilson was not opposed to colonialism per se, but only to the extension of European colonizing ambitions to fallen empires. In this same period, however, two other anti-colonial forces were simmering, the Leninist version of self-determination the core of which was anti-colonialism and the rise of movements of national resistance throughout Asia and Africa.

 

In the end, the diplomats at Versailles negotiated a slippery compromise in the form of the Mandate System. The European colonial powers were authorized to administer various Middle Eastern territories as they wished, not as colonial masters, but by assuming the role of trustee acting on behalf of the organized international community as represented by the League of Nations. Unlike such an arrangement in the contemporary world, the rejection of self-determination and the subjection of a foreign country to this form of mandatory tutelage was not then perceived to be a violation of international law, although it was widely criticized in progressive political circles as imprudent politically and questionable morally.

 

The British were particularly eager to govern Palestine, and eagerly accepted their role as mandatory authority. Their imperial interests revolved around the protection of the Suez Canal and overland trade routes to India. As was their colonial practice, Britain pursued a divide and rule strategy in Palestine despite its mandatory status. With this governing perspective in mind the British were eager at the outset of the mandate in the 1920s to increase the Jewish presence in Israel as quickly as possible so as to create a better balance with the native Arab majority population. This, of coincided with Zionist priorities, and led Britain to endorse strongly the Zionist project of encouraging Jewish immigration to Palestine. This dynamic greatly accelerated in the 1930s, especially after the Nazis took over the German government. In reaction to this influx of Jews, the Arab population in Palestine became increasingly restive, worried by and hostile to this rapid increase in the size of the Jewish and viewed with growing alarm increasingly manifest Zionist state-building aspirations, which gave rise to the so-called Arab Uprising of 1936-39. It should be understood that when it became clear that the Zionists wanted their homeland to be in the form of a Jewish state in Palestine it produced a qualitative escalation of friction between immigrant Jews and indigenous Arabs.

 

This circumstance led in two directions that illuminate the evolution of the conflict. First of all, the Palestinians felt threatened in their homeland in a period of their own rising nationalism, a process evident throughout the non-Western world, and sought political independence for themselves but lacked adequate leadership and a resistance movement with sufficient military skills to bring it about. Secondly, the Zionist movement in Israel by manifested its contrary ambitions to establish its own independent state in Palestine increasingly were in conflict with Britain, their earlier benefactor. To achieve their goals the Zionist movement, or more accurately, the more radical sections of the movement, launched a sustained and intensifying terrorist campaign that had the strategic goal of raising the costs of governance of Palestine past the tipping point. When this goal was achieved it led Britain to contemplate alternatives to a continuation of their role as administrator of the Mandate.

 

As is the British tendency whenever stymied by a large bump in the road, a royal commission is formed and given the job of devising a solution. The commission became known as the Peel Commission, in recognition of its Chair, Lord Earl Peel, which was appointed to assess the situation in 1937. As also was the British tendency after conducting a comprehensive inquiry, the principal and unsurprising recommendation of the commission was partition of Palestine. It is this idea of dividing up the people of Palestine on the basis of ethnic identity that continues to be the preferred solution of the international community, commonly known as ‘the two-state solution,’ and was eventually accepted by the Palestinian Liberation Organization in 1988, seemingly creating the essential common ground that could produce a territorial compromise acceptable to both peoples. It is helpful to realize that at some point in the 20th century such a solution dictated by an external actor lacked legitimacy even if sincerely seeking the wellbeing of the affected peoples, a presumption of good will that was not itself strong in the case of Britain given its past broken promises to Arab leaders. For partition to be legitimate by the time of World War II it would have required some formal expression of approval from the Palestinian population or its recognized representatives. Such approval would not have been forthcoming. Even at the end of World War II the Jewish population of Palestine was definitely a minority, and there is every indication that the non-Jewish majority population would have overwhelmingly opposed both partition and the establishment of a Jewish state. There was also present significant Jewish opposition to the Zionist project that is rarely acknowledged; its extent although non-trivial, is difficult to estimate with any reliability.

 

Nevertheless, with the notable exception of the Arab world, was the near universal acceptance of the two-state solution has it never materialized? There have been numerous diplomatic initiatives up until the present, and yet this two-state outcome has never come close to becoming a reality. Why is this? It is one among several seemingly mystifying dimensions of the Israel/Palestine encounter.

 

I would venture a central line of explanation. The main leaders of the Zionist movement before and after the establishment of the state of Israel in 1948 never subjectively accepted the two-state approach, at least with the parameters understood in Washington, the West, and among Palestinian leaders. Although Israeli political leaders blandly indicated their acceptance of a two-state approach if it meant real peace, the territorial dimensions and curtailed sovereignty of any Palestine state that was to be agreed upon were never set forth in terms that Palestinians could be expected to accept.

 

In this respect, it is necessary to appreciate that both the right of a people to self-determination had become incorporated into international law, most authoritatively in common Article 1 of the two human rights covenants adopted in1966, and that colonialist patterns of foreign rule and settlement had become unlawful in the decades following World War II. A central historical paradox is that Israel successfully established itself as independent state, almost immediately admitted to the UN, in the very historical period during which European colonialism was collapsing throughout the world, and losing any claim to political legitimacy.

 

Israel defied these transforming international developments in several concrete and unmistakable ways. Although at the time of the UN General Resolution 181 recommending partition of Palestine, the resident population was not consulted as to their wishes for the future despite the fact that the Jewish population in 1947, even with the post-Holocaust immigration surge, still numbered no more than 30% of the total. The ‘solution’ imposed by the UN, and ‘accepted’ by Israel as a tactical step on the path to control over all or most of Palestine and rejected by the Arab world and Palestinian leaders, amounted to an existential denial of inalienable Palestinian rights at the time. Undoubtedly moral factors played a decisive role, ranging from sympathy for Holocaust survivors to compensating for the failures of the liberal democracies to do more to prevent the Nazi genocide, but these powerful humanitarian considerations do not provide a legal justification for disregarding the rights of the Palestinian people protected by international law, or even a moral justification. After all, the harm inflicted upon Jews as a people was essentially a European phenomenon, so why should the Arabs of Palestine bear the burdens associated with creating a Jewish national sanctuary. Of course, the Zionist answer rests the claims to Palestine on its status as ‘the promised land’ of the Jewish people, an historical/religious claim that has no purchase in state-centric world order that allocates territorial claims on the basis of sovereign rights and effective control. From the perspective of political realism the strongest basis for Jewish territorial rights in Palestine has always rested on effective control established by successful military operations.

 

Nor did international law uphold the acceptance of the later outcome of the 1948 war in which Jewish forces increased their effective territorial sovereignty from the 55% proposed by the UN to 78% obtained by success in the war, which also resulted in the permanent dispossession of over 700,000 Palestinians and the deliberate destruction of as many as 531 Palestinian villages to ensure that coercive dynamic of ethnic cleansing was not later reversed. The armistice at the end of the 1948 War became internationally accepted, demarcating provisional borders between the two peoples, known as the ‘green line,’ and also separating the military forces at the end of the 1948 War. These provisional borders became the new negotiating baseline to be relied upon to establish agreed permanent boundaries. This enlargement of the territory assigned to Israel in 1948 directly violated one of the prime rules of contemporary international law, the non-acquisition of territory by conquest or use of force. In effect, the politics of effective control was to apply only intranationally, but not internationally.

 

The 1967 War resulted in Israel replacing Jordan as the administering authority in the West Bank and East Jerusalem, and Egypt in the Gaza Strip, as well as occupying the Syrian Golan Heights. At the UN Security Council unanimous Resolution 242 called upon Israel to withdraw from these territories, comprising 22% of the Palestine governed by Britain during the mandate period, and for a just resolution of the refugee problem. 242 carried forward the idea of ethnic separation contained in the UN partition solution, although without mentioning a Palestinian state. 242 also confirmed as authoritative the norm that territory could not be validly acquired under international law by forcible means. The resolution did envision a negotiated withdrawal and border adjustments to reflect Israeli security concerns, but it left the implementation up to the parties with no limits on reasonableness or duration. After 50 years, the various unlawful encroachments on what the UN calls Occupied Palestinian Territories, especially the annexation and enlargement of the entire city of Jerusalem and the establishment of an archipelago of Israel settlements and a related network of Israeli only roads, cast serious doubt on whether Israel ever had the intention to comply with the agreed core withdrawal provision of SC Resolution 242. With respect to Jerusalem Israel defiant unilateralism exhibited a rejection of the supposed compromise that was hoped by UN member would bring an end to the conflict. Israel has compounded its defiance by continuously undermining the stability of Palestinian residence in Jerusalem while engaging in a series of cleansing and settlement policies designed to give the city a higher Jewish demographic profile.

 

These three historical milestones call attention to two important aspects of the relevance of international law: first, what was acceptable under international law 100, 70, and 50 years ago is no longer acceptable in 2017; secondly, that Palestinian grievances with respect to international law need to be taken into account in any diplomatic solution of the conflict, above all the right of the Palestinian people to self-determination, which needs to realized in a context sensitive to the right of the Jewish people resident in historic Palestine. Although injustices and international law violations have shaped the unfolding of this contested country over the course of the last century, history can neither be ignored nor reversed. Giving proper effect to this double right of self-determination is the central challenge facing an authentic peace diplomacy. Thirdly, the entrenched presence of the Jewish population of Israel, and the state structures that have emerged, even if brought about by legally questionable means, are now part of the realistic status quo that needs to be addressed in a humane and politically sensitive manner.

 

 

The Politics of Effective Control

 

In this sense the historical wrongs endured by the Palestinian people, however tragic, do not predetermine the shape of a present outcome reflective of international law. A peaceful solution presupposes a diplomatic process that recognizes this right as inhering in the situation of both peoples. A mutually acceptable adjustment also does not imply either a two-state or one-state solution or something inbetween, or even an as yet unimagined alternative. Any legitimately agreed solution by the two peoples would be in accord with present day international law. How the historical experience is taken into account is up to the parties to determine, but unlike the Balfour Declaration or the UN partition proposal, in this post-colonial era it is unacceptable under international law for a solution to be imposed, whether by force or under the authority of the UN or by a third party intermediary such as the United States. Unfortunately, international law, and related considerations of justice, are not always determinative of political outcomes as effective control maintained over time generates a framework of control that becomes ‘legal’ if internationally recognized in an authoritative manner.

 

Condemning Israeli Settlement Expansion: UN Security Council Resolution 2334 and Secretary Kerry’s Speech

On December 23, 2016 the UN Security Council by a vote of 14-0 adopted Resolution 2334, notably with the United States abstaining, condemning Israeli settlement expansion. It was treated as big news in the West because the Obama presidency had finally in its last weeks in office refused to use its veto to protect Israel from UN censure. Especially in the United States, the media focused on the meaning of this diplomatic move, wondering aloud whether it was motivated by Obama’s lingering anger over Netanyahu’s effort to torpedo his efforts to reach agreement with Iran in 2014 on its nuclear program or meant to challenge the incoming Trump leadership to deal responsibly with the unresolved Israel/Palestine conflict and also by indirection to mount criticism of Trump’s reckless pledge to move the American embassy to Jerusalem and his apparent readiness to side openly with extremist Israeli leadership while in the White House.

 

           

The likely lasting importance of the resolution is the evidence of a strong international consensus embodied in the 14-0 vote, with only the US abstention preventing unanimity. To bring together China, Russia, France, and the UK on an initiative tabled by Senegal, Malaysia, and Venezuela, is sending Israel and Washington a clear message that despite the adverse developments of recent years in the Middle East the world will not forget the Palestinians, or their struggle. It is also significant that the resolution calls upon the new UN Secretary General to report back to the SC every three months on progress implementing the resolution and explicitly keeps the Council seized of the issue. Such provisions reinforce the impression that the unresolved Israel/Palestine conflict will remain on the UN policy agenda in the months ahead, which by itself is extremely irritating to Israel.

 

            It is quite obvious that 2334 is largely a symbolic initiative, which is a way of saying that nothing on the ground in occupied Palestine is expected to change even with respect to Israeli settlement policy. Israel responded to the resolution even more defiantly than anticipated partly because this challenge to its policies, although symbolic, was treated as more threatening than a mere gesture of disapproval. Israeli anger seemed principally a reaction to the American failure to follow its normal practice of shielding Israel by casting its veto. It may also reflect concerns in Israel about the growing civil society challenge posed by the Boycott, Divestment, and Sanctions Campaign (BDS) that is gaining traction in recent years, particularly in Europe and North America. In effect, 2334 may be the beginning of a new phase of the legitimacy war that the Palestinian people and their supporters have been waging in recent years in opposition to Israeli occupation policies and practices, not only in the West Bank and East Jerusalem, but also in Gaza and to discredit its diplomacy on the world stage. If Trump delivers on his provocative pledge to move the American Embassy to Jerusalem it is likely to intensify offsetting international efforts to induce the UN to exert greater pressure on Israel to address Palestinian grievances in a manner more in accord with international law.

           

The motivation for the US change of tactics at the UN was greatly elaborated upon a few days later by John Kerry, the American Secretary of State. He mainly connected 2334 with a US effort to save the two-state solution from collapse. Kerry insisted that the two-state solution could still be salvaged, although he acknowledged that it was being put in increasing jeopardy by the steady expansion of Israeli settlements, which he acknowledged as signaling Israel’s ambition to impose their own version of a one-state outcome on the Palestinians. Kerry articulated the widely held belief that the formal annexation of occupied Palestinian territories would force Israel to choose to be either ‘Jewish’ or ‘democratic.’ It could not be both if the 5 million or so Palestinians living under occupation were added to the 1.7 Palestinian minority in pre-1967 Israel. At such a point Israel would either have to grant all Palestinians full citizenship rights, and no longer be Jewish, or withhold these rights and cease further pretenses of being democratic. Significantly, Kerry refrained from saying that such a solution would violate basic Palestinian rights or antagonize the UN to such a degree that sanctions would be imposed on Israel. Secretary Kerry relied on the practical advantages for Israel of making peace with Palestine, and refrained from warning Israel of dire international consequences of continuing to violate international law and defy the unified will of the international community.

 

For a variety of reasons, as suggested, 2334 and the Kerry speech were welcome corrective to the relative silence of recent years in response to the failure of the parties to move any closer to a sustainable peace. It was also a belated indication that at least part of the American political establishment was no longer willing to turn a blind eye to Israeli wrongdoing, at least with respect to the settlements. Yet 2334, and especially the Kerry speech, do not depart from fundamentally mistaken presentations of how to move diplomacy forward. There is no mention of the widely held belief in civil society that the train carrying the two state baggage has already left the station, stranding the hapless diplomats on the platform. In fact, both 2334 and Kerry seek to breathe life into an opposite impression that the only feasible peace arrangement must be based on achieving two independent, sovereign states; no consideration is given to the alternative of a secular one state solution with equality for the two peoples based on democracy and human rights.

 

            The second serious misrepresentation of the situation is the assertion of a false symmetry as between the parties rather than a necessary recognition of disparities in capabilities and responsibilities that have doomed the ‘peace process’ from its inception. The Palestinians are living under a harsh occupation regime, in refugee camps spread around the region, or in a worldwide diaspora, while Israelis are living in freedom, prosperity, and relative security. Israel violates international law in numerous systematic ways, while Palestine endures an oppressive occupation that it is unable to challenge. In this spirit, Kerry declares that both sides are responsible for the lack of diplomatic progress, which overlooks the consequences of Israeli settlement expansion, ethnic policies in Jerusalem, and the blockade of and attacks on Gaza. Reasonable expectations about how to move forward should be grounded in the realities of these disparities and how to overcome them. A start would be to acknowledge that Israeli compliance with international humanitarian law, especially the Fourth Geneva Convention, is a precondition for the resumption of any further negotiations.

 

Considered more carefully, it is probably not surprising that 2334 is somewhat more critical of Israel than the Kerry speech, although the speech is not nearly as ‘anti-Israeli’ as the mainstream Western media would have us believe. 2334 condemns not only recent settlement expansion moves but declares in its first operative clause that all of the settlements established by Israel since 1967 in occupied Palestine, including those in East Jerusalem, have “no legal validity and constitutes a flagrant violation under international law.” Kerry deep in his speech, almost as an aside, acknowledges the continued US acceptance of this wider illegality of the settlements, but simultaneously reassures Israel that it is taken for granted that land exchanges would enable Israel to keep its largest settlements if future peace diplomacy ever does lead to the establishment of an independent and sovereign Palestine. In effect, the fact that these largest settlements built on the best land in the West Bank are widely considered flagrantly unlawful from the time they were established is treated as essentially irrelevant by Kerry with respect to working out a deal on peace.

 

Even more telling, 2334 while affirming the international consensus supportive of a two-state solution does not go on to give any indication of what that might mean if transformed into political reality. Kerry outlines the American vision of such a solution with ideas, which if carefully considered, would make the plan unacceptable to Palestinians even if we make the huge, and currently unwarranted assumptions that Israel might in the future become a sincere participant in a peace process, including a willingness of its government to dismantle substantially the settlement archipelago.

 

For instance, Kerry reflects Washington’s view of a two-state solution by presupposing that if any Palestinian state is ever established it would be entirely demilitarized while Israel would retain unlimited options to remain as militarized as it wished. Such one-sidedness on the vital matter of security is affirmed, despite an expectation that in the course of allowing a Palestinian state to come into existence the 2002 Arab Peace Initiative would be fully implemented. Such a development would allow Israel to count on demilitarized regional security cooperation with the entire Arab world, including full normalization of economic and cultural relations. Even if the Palestinian Authority were persuaded to accept this fundamental inequality in the sovereign rights of the two states, it is doubtful that the Palestinian people would accept such a humiliating and compromised status over time. In effect, the Kerry outline of peace expresses a continuing commitment to pro-Israel partisanship and is less a formula for a sustainable peace between these two peoples than it is a presumably unintentional setting of the stage for an indefinite continuation of the conflict under altered conditions.

 

Yet there are two qualifying considerations that should be taken into account. There are reliable reports that Kerry wanted to make his speech of late December two years ago, and was prohibited from doing so by the White House that feared a backlash that would burden its already difficult task of governance. In effect, as with such famous retirement speeches as Eisenhower’s warning about the military-industrial-complex a half century ago the citizenry is warned when it is too late even to attempt to address the problem until a new leadership takes office. In my view, even if Kerry had been allowed to speak when there was still time to act, there would have been little behavioral effect because Israel is now unconditionally committed to the Greater Israel image of a solution, there was insufficient political will in Washington and around the world to push Israel hard enough, and because the image of ‘peace’ was too one-sided in Israel’s favor as to be either negotiable or sustainable.

 

 

Similar partisan features undermine the credibility of other aspects of Kerry’s advocacy of how best to proceed. While recognizing the importance of the refugee issue, Kerry calls for some kind of solution that allows Palestinian refugees to receive monetary compensation and the right to return to the state of Palestine, but not to their homes or village if located in present day Israel. And no where is Israel’s unlimited right of return available to Jews worldwide, however slight their connection with Israel or Judaism might be.

 

Kerry went out of his way in the speech to demonstrate that the US abstention in relation to 2334 was in no way intended to rupture the special relationship between Israel and the United States. In this vein, Kerry pointed to the fact that the Obama administration had been more generous than its predecessors in bestowing military assistance upon Israel and had over its eight years protected Israel on numerous occasions from hostile initiatives undertaken it various UN venues. His point being that Israel’s defiance on settlements made it politically awkward for the United States to be an effective supporter of Israel and created tension between its preferred pro-Israeli posture and the more pragmatic pursuit of national interests throughout the Middle East.

 

Despite this friction between Washington and Tel Aviv, the US was the only member of the Security Council to refrain from supporting the resolution, limiting its departure from Israel’s expectations by refusing to block 2334, although it apparently toned down the criticism through threatening to use its veto if the language used was not ‘balanced.’ Kerry went out of his way to celebrate the recently deceased former Israeli president, Shimon Peres as a heroic peace warrior, which amounted to a not subtle dig at Netanyahu. Kerry quotes approvingly Peres’ self-satisfied assertion that 78% of historic Palestine should be enough for Israel, which Peres was comparing to the excessive demands for even more land by the settler one-staters. Of course, 78% gives Israel much more than the 55% it was awarded in 1947 by UNGA Assembly Resolution 181. At the time, the entire Arab world and Palestinian representatives rejected this UN proposal as unacceptable despite given 45% or more than double the territory of Palestine after Israeli withdrawal from Palestinian land occupied since the 1967 War. Beyond this, Kerry’s inclusion of land swaps as integral to his version of the two-state solution would result in further encroachments on territory left to the Palestinians, a result obscured to some extent by giving Palestine uninhabitable desert acreage as a dubious equivalent for the prime agricultural land on which the unlawful Israeli settlements are built. At best, territorial equality would be achieved quantitatively, but certainly not, qualitatively, which is what counts.

 

At the same time there are some positive aspects to Kerry speech. It did create a stir by its sharp criticism of Israel’s policies on settlements, as well as open doors to debate and broke the silence that was enabling Israel to proceed with its plans for territorial expansion. It is worth noting that James Zogby, long a dedicated advocate of Palestinian rights who has been surprisingly effective in the face of the constraints of the American setting, has expressed his strong appreciation for Kerry’s speech in the following words: “To some, especially Palestinians, this may seem like ‘too little, too late.’ But as someone who has been a part of the effort to create an American debate on Israeli policies, Kerry’s intervention is both welcome, validating, and empowering. He laid down markers that should help liberals and progressives define a policy agenda on the Israel-Palestine conflict—exactly what we need as we enter the challenges of the Trump era.”

 

Overall, the impact of 2334 is likely to be greater than it would have been if Israel had not reacted so petulantly. Even if Trump reverses the American critical approach to further Israeli settlement expansion, the UN has been reawakened to its long lapsed responsibility to find a peaceful solution for the conflict and end the Palestinian ordeal that has gone on for an entire century since Lord Alfred Balfour gave a British colonial green light to the Zionist project in 1917 to establish a Jewish homeland in historic Palestine. As well, civil society activists that have thrown their support to the BDS Campaign and governments critical of Israel’s behavior are likely to feel encouraged and even empowered by this expression of virtual unity among the governments belonging to the most important organ of the UN System. Of course, there have been many resolutions critical of Israel in the past, and nothing has happened. The harsh occupation persists unabated, the dynamics of annexation move steadily forward, and the Palestinian tragedy goes on and on. Despite this inter-governmental step at the UN, it still seems that the Palestinian fate will be primarily determined by people, above all by various forms of Palestinian resistance and secondarily by the extent of global solidarity pressures. Whether resistance and solidarity on behalf of justice is sufficient to neutralize the iron fist of geopolitics and state power remains the essential challenge.

James Zogby, long a dedicated advocate of Palestinian rights who has persevered in the face of the many difficulties present in the American setting, deserves a respectful hearing for his praise for of the Kerry speech. He has expressed his strong appreciation with the following words: “To some, especially Palestinians, this may seem like ‘too little, too late.’ But as someone who has been a part of the effort to create an American debate on Israeli policies, Kerry’s intervention is both welcome, validating, and empowering. He laid down markers that should help liberals and progressives define a policy agenda on the Israel-Palestine conflict—exactly what we need as we enter the challenges of the Trump era.” Let us join Zogby in acknowledging a few drops of water in the glass containing Palestinian hopes, but let us also recognize that even with Kerry break with silence, lots has to happen before we can begin to believe that the glass is half full.

While keeping open a suspicious eye, it is important to acknowledge positive aspects of the Kerry speech: It did create a stir by its sharp criticism of Israel’s policies on settlements, as well as open doors to debate and broke the silence that was enabling Israel to proceed with its plans for territorial expansion. In the period ahead, we may even become nostalgic for the posture, even if mainly hypocritical, of seeking a peaceful, negotiated future for the Palestinian people. Or maybe the stripping away of illusions will highlight the continued dependence of the Palestinians on struggle and solidarity.

 

 

 

 

 

Israel’s Security Establishment Makes Public Plea for a Two State Solution

Rarely, if ever, has a newspaper ad mobilized such influential backing for a position of prominent Israelis at odds with the elected leadership of the Israeli state. A full page add appeared in the New York Times on February 4, 2016. It was sponsored by the S. Daniel Abraham Center for Middle East Peace. Considering the main readership of the NYT it is clear that the message was aimed at the American public, and likely, particularly at Jewish Americans and the advisors of the next American president who is to take office a year from now. Its message was proclaimed in large bold type: “Israel’s Security Chiefs Agree: Separation into two States is in Israel’s vital security interest.”

 

This assertion was followed by short supportive quotations beneath a rogues gallery of Israel’s security establishment: three rows of pictures, the top one of Six former Israeli IDF Chiefs of Staff, in the middle five former Shin Bet heads (internal security agency), and on the bottom five former heads of the Mossad (international intelligence agency). To be sure this is an imposing array of top Israeli officials together indirectly expressing their collective dismay with respect to the Likud government led by Netanyahu turning its back on the two-state solution. As such, it is an impressive expression of Israeli elite and informed opinion, but whether it reflects a consensus with political leverage either here in the United States or in Israel seems doubtful. At minimum it conveys the strong impression that an influential part of the Israeli establishment has lost confidence in the Netanyahu leadership to protect Israel’s vital interests, and this is itself significant.

 

The ad consists of two main features: photos of these military and intelligence officials, many familiar and some notorious names to those following Israeli politics and one-line quotations from each one expressing the need and urgency of implementing some version of the two-state solution for the sake of Israel’s security. Not surprisingly, all 16 are men who have been during the careers instrumental in the dispossession and oppression of the Palestinian people.

Also not surprisingly, the ad makes clear that this break with the Netanyahu approach has nothing whatsoever to with seeking deferred justice for the Palestinians or some kind of empathy for their long ordeal. Support for a Palestinian state is exclusively connected with the supposed need to defuse the so-called ‘demographic bomb.’ Or in the language of the ad, “The only way Israel can remain a Jewish, democratic state is if the Palestinians have a demilitarized Palestinian state.” This rationale is the prelude to positing a conclusion in bold type and enlarged format: “It’s Time: Two States for Two People[s].” And to remove any doubt there is a sidebar summarizing the demographics: 2015 52% Jewish, 2020 49% Jewish, 2030 44% Jewish.

 

I find this anti-Likud rejection of the current drift toward an Israeli one-state outcome noteworthy for two different reasons: first of all, it proposes a solution that will not work; not only is there no mention of the need to give up the settlements or to address the rights of Palestinian refugees, but the conception of ‘a demilitarized Palestinian state’ is such an affirmation of the inequality of the two peoples that it is a virtual guaranty that even if the Ramallah leadership turned out to swallow such an arrangement, the Palestinian people would not. The only path to a sustainable peace needs to be based to the extent possible on the equality of the two peoples, and if a Palestinian state is ever acceptably established it must be endowed with the same sovereign rights as Israel.

 

Secondly, it is worth noticing that Netanyahu is far from alone in rejecting the two-state diplomacy. The President of Israel, Reuven Rivlin, elected in 2013 by the Knesset, is an unapologetic proponent of the one-state approach, endorsing the biblical and ethnic claim to the whole of the West Bank, the maximal territorial version of Greater Israel. Similarly, Israel’s ambassador to the UN, Danny Danon, is a settler firebrand and government official who has long spearheaded opposition to any politically viable accommodation with the Palestinians that acknowledges their right of self-determination.

 

Against such a background, it seems obvious that any revival of the two-state diplomacy along the lines proposed in the ad, let’s say at the initiative of the next American president, would soon reach a dead end. There is no doubt that resorting to such an ad in the leading American newspaper is convincing evidence of a deep split in Israeli leadership circles, but its proposed alternative approach fails to move prospects for a just peace forward. It suggests a split between those Israelis worried about ruling over a Palestinian majority population and those Israelis guided by territorial and colonizing ambition. Neither orientation is located on a path leading to sustainable peace.

 

Only a solution and vision based on the equality of Jews and Palestinians deserves respect and engenders hope. Let’s not be further misled, this weighty statement by Israel’s security establishment should not be confused with a revival of the Israeli peace movement or some expression of civil society disaffection directed at the Netanyahu leadership. It is, at most, lending transparency to a long ongoing conversation within Israel’s governing elite, nothing more, nothing less.

 

Furthermore, the idea of safeguarding Israel’s democratic character seems to presuppose that Israel remains a democracy. Yes, as with other apartheid structures, it is ‘democratic’ but for Jews only. For Palestinians, whether living as a minority in Israel, under occupation in the West Bank and East Jerusalem, subject to captivity and collective punishment in Gaza, and in refugee camps scattered within the occupied territories and neighboring countries, the label ‘democracy’ has long been a cruel joke. To qualify as an authentic democracy rights based on non-discrimination must be upheld for all those living under the authority of the governing process.

 

The S. Daniel Abraham Center for Middle East Peace makes no secret of its Zionist leanings and Israeli outlook, although it seems genuinely to believe that Likud governance of the country is endangering Israel’s identity as well as its security. Its webpage proclaims a commitment to peace, honors the memory of Yitzhak Rabin, and calls favorable attention to the Arab Peace Initiative of 2002. At the same time it refrains from criticizing Israel’s treatment of the Palestinian people or any of the numerous daily denials of Palestinian rights, avoids mentioning Israel’s apartheid governance structures, and refrains from expressions of empathy for the multiple forms of suffering imposed upon the Palestinian people.
