Context Matters Except for the Palestinians

 

Just imagine the Israeli reaction to a peace plan put forth by a future U.S. president elected to pursue the agenda of ‘the squad,’*[*]appointing Noam Chomsky, the head of CAIR, and Medea Benjamin on assuming office to lead its moves toward peace in the Middle East. Imagine further that prior to disclosing President Alexandria Ocasio-Cortez’s revolutionary peace initiative, Washington’s new leadership took the following unilateral steps: tabling a Security Council Resolution calling for the dismantling of the Israeli separation wall in accord with the 2004 Advisory Opinion of the World Court, insisting on Israeli adherence to Article 49(6) of the Fourth Geneva Conventions while calling for the prompt re-settlement of all Israeli settlers behind the 1967 Green Line, and informing Congress of its intention to discontinue further annual economic and military assistance to Israel. In addition to these ‘provocations,’ the U.S. energetically pursued a regional diplomacy with Arab neighbors designed to exert the greatest possible pressure on Israel to go along with whatever Washington proposes or suffer severe adverse consequences.

 

I know this would strike even most pro-Palestinians as an absurd way to seek sustainable and just peace arrangements, but this is precisely the road taken by the White House in its multiple acrobatic moves designed to build leverage for the Trump/Kushner ‘deal of the century.’ Even Obama’s feeble attempts to balance the scales ever so slightly brought fury to the lips of most Israelis, including its leaders. We can hardly imagine the Israeli response to a peace initiative launched by the squad along the above lines, which for all of its seeming radical character would actually be reasonable from the perspective of international law and morality even as it was causing collective apoplexy in Tel Aviv. The absurdity of this inverted ‘peace’ scenario should help us understand how extreme has been the pro-Israeli brand of extremism of the Trump White House. The fact that this has to be demonstrated rather than taken for granted underscores how victimized the Palestinian national struggle has become in the eyes of many of us in the West.

 

Equally worth observing is the discourse on the Trump diplomacy adopted by Zionist apologists, and even some anti-Trump liberals and Israeli peace activists such as Gershon Baskin. Their bad faith message to the Palestinians is along three parallel lines: “Don’t repeat past mistakes by simply rejecting Trump’s peace proposals,” “Under the circumstances, what Trump offers is the best Palestine can hope for given altered conditions on the ground and in the region,” and “Don’t reject in advance, participate, listen attentively, responding favorably to any positive elements, and project an image of constructive engagement.” Revealingly, this advice to the Palestinians is set forth without any consideration of the extreme anti-Palestinian contextcreated by a series of deliberate moves by Trump from the moment he was elected. Can you even imagine giving Israeli leadership this kind of advice if the political realities were ever to be reversed?

 

It hardly requires a vivid imagination to conjure up the expletives that would undoubtedly lend color to the most probable Israeli responses to being told what to do in comparable circumstances. The Palestinians, in contrast, are being chastised for not being receptive and refusing to come to the table with an open mind. True, the Palestinian Authority has not shown much finesse in handling the situation, relying on the sufficiency of its skeptical mumbling and an ambivalent public ‘NO.’ Better would have been an explanation along these lines, “Given the hostility toward Palestinian concerns that have been a trademark of the Trump presidency since its beginning, how can anyone in their right mind expect us to be so foolish as to pretend that there exists any basis for exploring the Trump/Kushner proposals as if they might offer a fair resolution of our long struggle for the most basic rights of the Palestinian people?” Sitting down in such a tilted diplomatic atmosphere would be the height of folly for the Palestinians, making them seem without dignity or understanding, mere puppets assembled so that their enemies could manipulate the strings.

 

Palestinians could and should have done better in setting forth their own vision of peace.  The extreme one-sidedness of the Trump approach handed Palestinians a golden opportunity to declare as convincingly as possible the urgent and immediate need for a new peace intermediary that was a facilitator, and not a partisan as past American presidents, or worse, an imposer as this one seems to be. The United States had long overplayed its hand as ‘honest broker,’ but now it had gone so far as to make any further Palestinian acceptance of the American role a source of humiliation, if not a sign of political senility.

 

It is worth noticing always, how the background of pro-Israeli objectionable behavior is treated by international commentary. When the context of justification is overlooked or repressed it usually signals an intention to persuade the audience by excluding complicating considerations, in this instance, the multiple signs that the United States has destroyed all reasonable expectations on the part of the Palestinians of fairness or objectivity in a proposed peace process. The Oslo framework as set forth in 1993 was deficient from these points of view but the deal of the century/peace from prosperity framework is so much worse, and yet it stands unrepudiated. When the context is put forward, it represents a genuine attempt to discover whether there are reasonable grounds for moving forward, and in this case there are none.

 

In the end, there is an underlying misinterpretation that has further distorted most commentary. What is being sought by Trump’s ‘peace diplomacy’ is not a political compromise that takes accounts of the basic rights of the two peoples, but a victory of one side over the other. It is an approach lightly theorized by Daniel Pipes and his confederates at the Middle East Forum, seeking to justify and advocate an increase of coercive U.S. and Israeli moves that will induce the Palestinians to acknowledge political defeat and submit to conditions at the behest of the Israeli victor. Thus, the success of the Trump/Netanyahu approach is not a matter of finding common ground between the two sides to form an agreement, but turning the screws of oppression so tight that the Palestinians will surrender. The approach has relied upon unilateral punitive actions supplemented by regional and global geopolitical leverage, but little direct violence beyond the endorsement of Israeli excessive force in dealing with the Great March of Return over the course of the last 68 Fridays.

 

Against this background, there exists an opportunity for responsible Palestinian leaders to do more than sit sullenly on their hands. In addition to explaining why Trump’s moves makes the traditional U.S. role unacceptable for purposes of negotiation, the Palestinians of all factions should do their utmost to set aside their disagreements, and achieve a unity of purpose, at least for the duration of their national struggle. Even more important might be, seizing the diplomatic initiative by making public a document that develops a comprehensive peace proposal that stakes out in general terms the contours of a political compromise on Jerusalem, settlements, statehood, borders, refugees, water, offshore resources, economic cooperation, security, and whatever else seems relevant. Even if only in the form of a declaration of principles, with explanatory commentary, it would manifest an intention to do more than refuse the paltry offerings that Kushner, Inc. is peddling throughout the region.  Such a positive initiative articulated by the Palestinian side is long overdue, would be of help to the Palestinians in the continuous ‘public relations war’ that may in the end be as relevant to the political struggle as the diplomatic tug of war or even resistance struggles. At this stage, nothing would give greater weight to Palestinian demands than its backing of an approach to peace that would seem so much reasonable and responsible than what is now being promoted by the Trump White House.

 

The basic point lingers. Context matters, and when it is eliminated, assessments of behavioral reasonableness are bound to be distorted and extremely misleading, especially if what is at stake is highly contested. This is particularly true for the Trump/Kushner unabashedly cruel approach to peace that can only be properly understood as placing a thin veil of deception over a concerted push to achieve an Israeli ‘victory’ while pretending to seek peace on the basis of political compromise. This emperor has no clothes! Those who care about justice must not let this happen!

Remembering the World Court Advisory Opinion on Israel’s Separation Wall After 15 Years

 

On July 9, 2004 the International Court of Justice (ICJ) in The Hague issued an Advisory Opinion by a vote of 14-1, with the American judge the lone dissenter, as if there would have been any doubt about such identity even if not disclosed. The decision rendered in response to a question put to it by a General Assembly resolution declared the separation wall unlawful, and that compliance with international law would require it to be dismantled and Palestinian communities and individuals compensated for harm incurred. As with the identity of the dissenting judge, the failure of Israel to comply with the decision was as predictable as the time of tomorrow’s sunrise.

 

Only slightly less anticipated was the American government response, which adopted its customary hegemonic tone, to instruct the parties that such issues should be resolved by politicalnegotiation, which even if heeded would end up as Israel wished, given the hierarchical relationship between Israel as occupier and Palestine as occupied. It doesn’t require a legal education to dismiss the American argument as fatuous at best, cynical at worst. The question put to the ICJ was quintessentially legal, that is, whether the construction of the separation wall on occupied Palestinian territory was or was not consistent with the Fourth Geneva Convention governing belligerent occupation.

 

Although the decision is labeled as an ‘advisory opinion’ it has the authoritative backing of a fully reasoned and documented consensus of the world’s most distinguished jurists as to the requirements of international law in relation to the construction of this 700km wall, 85% of which is situated on occupied Palestinian territory. The degree of authoritativeness of the legal analysis is enhanced by the one-sidedness of the decision. It is rare for a legal controversy before the ICJ to produce such near unanimity given the diversity of legal systems of the 15 judges and considering the civilizational and ideological differences that haunt world order generally.

 

This legaloutcome in The Hague was overwhelmingly endorsed politicallyby the General Assembly mandating Israeli compliance. It is disappointing that Israeli defiance of both the ICJ, the world’s highest judicial tribunal, and the General Assembly, the organ of the UN most representative of the peoples of the world, should have occasioned so little adverse commentary over the years. It is not only a further confirmation that the UN System and international law lacks the capacity to deliver even minimal justice to the Palestinian people but that such institutional authority is subject to a geopolitical veto, that is, international law without the backing of relevant power becomes paralyzed with respect to implementation.

 

When considering the constitutional right of veto given to the five permanent members of the Security Council as augmented by the informal geopolitical veto enabling dominant states to shield their friends as well as themselves from the constraints of international law, the dependence of law on the priorities of power becomes obvious, painfully so. It helps us grasp the perverse ways the world is currently organized.  It is truly pathetic that only the weak and vulnerable are subject to the constraints of law, while the strong and those shielded by the strong are the lawless overlords of this unruly planet.

 

The wall a notorious international symbol of coercive and exploitative separation, as epitomized by the apartheid security structures imposed on the Palestinian people as a whole has a grotesque pattern of implementation. Its ugly structures slice through and fragment Palestinian communities and neighborhoods, separating farmers from their farms, and creating a constant and an inescapable reminder of the nature of Israeli oppression.

 

It may put the issue of the separation wall in historical perspective to recall features of the Berlin Wall. During the Cold War it came to epitomize oppression in East Germany, and more generally in Eastern Europe. If the East German government had dared extend the wall even a few feet into West Berlin it would have meant war, and quite possibly World War III. And finally, when the wall came down it was an occasion of joyous celebration and a decisive moment in the historical dynamic that let the world know that the Cold War was over. It is helpful to appreciate that the Berlin Wall was designed to keep people in, while the Israeli Wall is supposed to keep people out.

 

There is also the question of motivation. As many have pointed out, the wall remains unfinished more than 15 years after it was declared necessary for Israeli security, which tends to support those critics that pointed out that if security was the true motive, it would have been finished long ago. Even if the claim is sincerely, in part, motivated by

security, it illustrates the unjust impacts of ‘the security dilemma’: small increments of Israeli security are achieved by creating much larger increments of insecurity for the Palestinians. Beyond security, it is obvious that this is one more land-grabbing tactic of the Israelis that is part of the wider Israeli strategy of treating ‘occupation,’ especially of the West Bank, as an occasion for ‘annexation.’ Even more insidiously, is the apparent Israeli intention to make Palestinian life near the wall so unendurable, that Palestinians relinquish their place of residence, ‘ethnic cleansing’ by any other name.  

 

What messages does this anniversary occasion deliver to the Palestinian people and the world? It is a grim reminder that the Palestinian people cannot hope to achieve justice or realize their rights by peaceful means. Such a reminder is particularly instructive as it comes at a time when intergovernmental efforts to find a political compromise between Israeli expectations and Palestinian aspirations has been pronounced a failure. This failure, again not surprisingly, has meant a dramatic shift in approaching ‘peace’ and ‘a solution’ from diplomacy to geopolitics, from the Oslo flawed diplomatic framework to the Trump ‘deal of the century’ or as Kushner has rephrased it, ‘peace to prosperity.’ Or more transparently phrased, it is ‘the victory caucus’ that Daniel Pipes and the Middle East Forum that he presides over has promoted so successfully in recent months, in effect, advocating a final betrayal of the rights of the Palestinian people, an approach that has evidently found a receptive audience in both the U.S. Congress/White House and the Israeli Knesset.

 

This geopolitical strategy is a thinly disguised attempt to satisfy Israel’s expectations as to borders, refugees, settlements, water, and Jerusalem while repudiating Palestinian rights under international law, including their most fundamental right of self-determination, supposedly a legal entitlement of all peoples in the post-colonial era.

The question that remains is ‘how much longer can the Zionist Project swim against the strong historical current of anti-colonialism?’

 

The answer in my view depends on whether the global solidarity movement, together with Palestinian resistance, can reach a tipping point that leads Israeli leadership to reconsider its ‘security’ and its future. Such a point was reached in South Africa, admittedly under quite different conditions, but with an analogous sense that the Afrikaner leadership would never give up control without being defeated in a bloody struggle for power.

Decoding the Pipes/Trump/Kushner  ‘Deal of the Century”

 

You didn’t have to be a ‘never Trump’ loyalist to have qualms about proposing to bring peace to Palestinians and Jews by creating conditions that would produce ‘The Deal of the Century.’ And let’s be fair, if the game of nations is now played according to the rules of Madison Avenue, the phrase was a winner despite being a loser if evaluated from a problem-solving perspective. Even in the present degraded political atmosphere, to bet on an advertising slogan as a substitute for healing ideas may be a good formula for ensuring a large audience for a reality TV episode, but it is a cruel evasion when it comes to addressing the daily ordeal of the Palestinian people consigned to the victimization associated with living under the Israeli apartheid state.

 

What may be worse than Trump’s bombastic boasts is that here there seems to be a malevolent logic that underpins this mad proposal that springs from the ultra-Zionist imagination of Daniel Pipes. It was Pipes months ago, using the Middle East Forum as his ideational vehicle, issued a call for what he named ‘a victory caucus.’ Pipes, an intelligent and trained scholar, reasoned that the Oslo diplomatic track had failed badly as a means for ending the conflict via negotiations. He coupled this conclusion with the historical assertion that prolonged conflicts between ethnic antagonists rarely end by compromise or accommodation. They end with the victory on one side, and the acceptance of defeat by the other side.

 

So the trick, as Pipes came to believe, is to convince the Palestinians to accept the writing on the wall and acknowledge to themselves and the world that they have lost the battle to prevent the establishment of a Jewish state in Palestine or to bring into existence a sovereign state of their own. Pipes argues that an objective look at the diplomatic and military relation of forces in Palestine and the Middle East confirms this assessment of the political outcome even without factoring in the unwavering geopolitical support of the United States that provides unconditional support to Israel’s priorities with respect to the Palestinians.

 

With this understanding, the policy puzzle to solve for Pipes then becomes two-fold: how to convince the U.S. Government to shift from its failed promotional effort to negotiate a solution to one of helping Netanyahu’s Israel successfully impose one, and beyond this, how to exert enough additional pressure on the Palestinian situation on the ground and internationally so that their leaders will face reality and surrender their political claims once and for all, and be content with what would then be offered to them—a pledge of economic improvement in their circumstances.

 

On reflection, it does not seem so surprising that such extreme supporters of Israel as the trio of Kushner, Friedman, and Greenblatt are receptive to such an approach, and might have moved in a similar direction even without the Pipes contribution that provides a coherent rationalization. Consider the steps taken by the U.S. government over the course of the past eight months and a pattern emerges that seems to be only compressible as seeking the implementation of the Victory Caucus proposal:

Moving the American Embassy from Tel Aviv to Jerusalem, attacking the UN –including withdrawing from the Human Rights Council because of its anti-Israeli bias, freezing and then cutting off essential financial aid to the UNRWA operations in Gaza and the West Bank, closing the PLO office in Washington, turning a blind eye to Israel’s crimes against humanity committed in response to the Great March of Return at the Gaza fence, threatening the International Criminal Court, and giving tacit blessing to the accelerated expansion of unlawful Israeli settlements (already surpassing 600,000 settlers). There is no other way to read this series of provocative maneuvers other than as a series of signals to the Palestinian people, and most of all to their leaders, to grasp the futility of their suffering, which will intensify more and more if they do not act sensibly, and submit to whatever Israel proposes so as to complete the Zionist Project of dominating the whole of historic Palestine, the biblical rendering of ‘the promised land’ of Jewish entitlement.

 

To call this kind of coercive diplomacy on an already oppressed people ‘a deal’ is a linguistic travesty. It is more a bullying ploy than a deal, which implies the semblance of a meeting of minds. It is what I have called in this and other contexts a ‘geopolitical crime’ that deserves punishment and international condemnation, not careful consideration given to a serious effort to bring peace to the two peoples. In the future such an initiative is likely to be known as ‘the attempted ultimate crime of the century.’

 

Putting aside sentiments of distaste for the immorality and unlawfulness of this Pipes/Trump/Kushner approach, it is important to ask the awkward question, ‘will it work?’ Given the struggles and suffering endured by the Palestinian people over the course of more than a century, it seems that the Pipes Victory Caucus, like the Trump ‘deal,’ will face scornful repudiation, likely accompanied by dramatic renewals of Palestinian resistance as complement by more militant expressions of global solidarity activities. If we take account of the heroic persistence of the Great March at the Gaza border, despite the repeated atrocities committed by IDF defenders of Israel, and of the increasing worldwide support of the BDS Campaign, it seems reasonable to conclude that the deal of the century has been rejected even before it has been revealed with all its shabby window dressing, including ideas of redrawn boundaries with neighboring countries, permanently fragmenting the Palestinian people beyond the darkest imaginings. If, a big if, the Trump trio of ‘Israel, First’ advisors is at all smart this is a deal whose detailed nature will never be revealed for public scrutiny, and whose anticipated rejection will be hidden behind a PR avalanche of denunciations of Palestinian rejectionism as responsible of killing Trump’s plan for peace.

 

Underneath this attempt to make the Palestinians drink such a toxic brew is a flawed reading of the flow of history in our time. The sun has set on colonialism, and no matter how much geopolitical muscle is applied, this reality cannot be overcome. This kind of geopolitical crime will doubtless intensify Palestinian suffering while it also strengthens Palestinian resolve. In these kind of decolonizing struggles it is shifts in the soft powerbalances that most often produces change, and not the tilting of the geopolitical scales or dominance on the battlefield. People, not states and their armed forces, are the movers and shakers of our era, with governments left on the sidelines to weep over the outcome. The European colonial powers learned this the hard way in a series of bloody wars, which they lost despite their military superiority. The United States, despite its experiences in Vietnam, Iraq, and Afghanistan has yet to grasp the limits of military power in the post-colonial world, and so it keeps inventing weapons, tactics, and doctrine without learning this indispensable lesson in the shifting nature of power.

 

True, Oslo diplomacy was a failure that worked to the political benefit of Israel, and was rightly abandoned. But the Trump response to this failure amount to the criminalization of diplomacy that violates the most basic precepts of international law, as spelled out in the UN Charter. It amounts to waging an aggressive war against a vulnerable and helpless people. If the UN and the leading governments watch this dismal spectacle in stony silence it can only be fervently hoped that the peoples of the world will recognize the need for radical reform to avoid a catastrophic future, not just for the Palestinians, but for all of humanity.

The Banality of Evil: Language Entrapment or Political Malevolence?

 

It seems a language game is being played. Or is it better understood as a political maneuver suffused with bad intentions?

 

Governments and international institutions with the wonders of modern information-gathering technology at their disposal continue to endorse the ‘two-state solution’ while civil society observers on all sides of the conflict mostly realize that as matters now stand Israel is adamant in its refusal to allow an independent Palestinian state to emerge and feels no pressure from the Trump White House to feel otherwise. Regardless of feelings, with an estimated 700,000 Israeli settlers living in unlawful settlements, the obstacles to creating the sort of Palestinian sovereign state that was supposed to emerge from Oslo diplomacy, the Arab Peace Initiative, and the Quartet Roadmap has long ago evaporated into thin air with hardly a whimper of outrage, or even disappointment, from even the Palestinian official representatives at the UN or the PLO directorate in Ramallah.

 

Daniel Pipes, always at the service of Zionist ambitions, has been beating the drums for an iron-fisted end game that resolves the conflict with the clarity of an acknowledged Israeli victory and a Palestinian defeat. As for the two-state solution, it is ironic that Pipes words ring truer than those that emanate from the capitals of the world, Speaking plainly, Pipes says “(t)he two-state solution, an absurdity at present (it means asking Israel to strengthen its mortal enemy) will make good sense after a Palestinian defeat.” One can only imagine the paltry reality of what Israeli ‘good sense’ will produce after a Palestinian surrender! But the question that interests me here is why Pipes can be clear eyed about a reality that the UN and inter-governmental discourse are unwilling to admit. Trump, forever the outlier, is so far forthright enough to refuse to endorse the two-state solution, thus breaking, at least implicitly, with the inter-governmental/UN consensus that other recent American presidents have all pledged to their utmost to implement. Of course, Trump’s defection is best explained as his docile readiness to take his marching orders from domestic Zionist maximalists who helped bankroll his campaign for the presidency.

 

On a recent visit to Israel for a meeting with Mahmoud Abbas, the German Foreign Minister, Heiko Maas, reaffirmed the zombie international consensus as if was an alive political option, declaring that the new German government remains committed to a two-state solution to the Israeli-Palestinian conflict. Such an assertion can be better understood if decoded—the German government has no intention of exerting any pressure on Israel to reach a political compromise, and he seems to be urging the Palestinian leadership to adopt a similar line.

 

At the UN the harshest criticisms of Israel continue to be its tendency to hamper progress toward a two-state solution, which would be notable if anyone in the know believed it to be a viable political option. For instance, in the important Security Council censure of Israeli settlement behavior (SC 2334. 23 December 2016) the Preamble wrote these words of explanation: “Expressing grave concern that continuing Israeli settlement activities are dangerously imperiling the viability of the two-state solution based on the 1967 lines.” “Dangerously imperiling,” as if the solution was not long since defunct. On what planet are these governmental representatives living? Or do these governments know better, but have secondary reasons for pretending differently?

 

In operative paragraph 3 of the General Assembly resolution (21 Deember 2017, A/ES-10/L.22) overwhelmingly condemning (128-9, with 35 abstentions) the provocative Trump move to recognize Jerusalem as the capital of Israel, and to so relocate the American embassy, a similarly misleading assertion is made: the GA “Reiterates its call for reversal of the negative trends on the ground that are imperiling the two-state solution.” I would be rude enough to say, ‘wake up, world,’ the two-state solution is not in the peace picture any longer, and maybe never really was.

 

The new call for peace that has real potential political traction, and is increasingly endorsed throughout civil society is ‘End Apartheid,” superseding the earlier effort to achieve by direct action an outcome that could be converted into a de facto Palestinian state: ‘End the Occupation.” For several reasons, this emphasis on withdrawal from occupied Palestine was always insufficiently responsive to the full reality of Palestinian suffering and struggle. It failed to emphasize the long-term plight of Palestinian refugees and involuntary exiles, and omitted mention of the discriminatory and in many ways worsening daily reality of the Palestinian minority in Israel.

 

In some respects the most dismaying statement of all along these lines was issued by the Inter-Parliamentary Union (IPU) in their rebuke of Trump’s Jerusalem initiative that was just now disseminated with the evident approval of the Palestinian National Council:  “The IPU noted that the resolution undermines the legal and political status of a peaceful settlement between Israel and Palestine and any hopes for a two-state solution. The IPU stressed that it would continue to pursue its efforts to promote dialogue and peace between the two parties, Israel and Palestine, and in the Middle East region. What is distressing about such a statement is that it seems to suppose that Israel is in the slightest degree interested in participating in a dialogue on the conditions of peace if that means walking a path leading to the emergence of a Palestinian state. The minimum requirement for dialogue is some degree of mutuality, which has not existed on the Israeli side for some years, and to pretend that it does is a way of sidestepping the real challenge—do nothing but watch while Israel moves ahead with its unilateral end game or join the struggle to prevent a culminating Palestinian tragedy by moving out of the diplomatic shadows and into the political arena of coercive politics.

This is not the time for dialogue and displays of good will. That time has long passed. Now is the time for engagement, for pressure, for boycott, and for sanctions. When governments are serious about pursuing elusive goals, whether these are benevolent or not, they choose sanctions, coercive diplomacy, and leave the military option on the table. I am only too glad to leave the military option off the table, while insisting upon a post-diplomatic posture of militant nonviolence. The Palestinian people have suffered long enough! They should not be further enticed to rely on tactics of futility. Not only is silence in the face of evil and suffering unacceptable, so is passivity, and even more, false consciousness.

Finally, we should ponder why the civil society focus on the BDS Campaign is so much more attuned to the Palestinian ordeal than is this nonsesnsical inter-governmental and UN two-state discourse. My reference to Hannah Arendt’s influential, if controversial, treatment of the Eichmann trial, was not lacking in forethought. Governments, and the UN as a global network of governments, is not inclined to confront seriously the suffering of others unless vital national interests and geopolitical priorities of its principal members so decree. Here, considering that Israel has become a regional powerhouse, backed unconditionally by the United States, conditionally by the West as a whole, and now opportunistically even by most Arab governments, the geopolitical realities favor an international posture of hands, given deceptive twists by moralizing rhetoric, occasional slaps on the Israeli wrist, and a garland of illusions in the ritual form of pledging a meaningless allegiance to the continuing vitality of the two-state solution. We need to muster clarity of will to declare that affirming the two-state solution under present conditions is proof that the banality of evil lives on in our time.

 

 

 

 

 

 

 

 

Geopolitical Dirty Dreams: Israel’s ‘Victory Caucus’

The word hubris is far too kind in describing Donald Trump’s approach to the Middle East cauldron of conflict, with his response to the Palestinian struggle being more revealing of his absurd braggadocio brand than of malice, although its impact is malicious. Insisting that he has the will and capacity to strike an Israel/Palestine deal while simultaneously intimating that he plans to fulfill his inflammatory campaign promise to move the U.S. Embassy to Jerusalem. Worse, he appoints David Friedman as ambassador, an ardent American supporter of settler extremists whose politics is to the right of Netanyahu on the Israeli spectrum. This bankruptcy lawyer turned diplomat has compared the liberal Zionists of J Street to the Nazi kapos (Jews who collaborated with Nazis in death camps). Here as elsewhere Trump’s errant behavior would prompt the darkest laughter if the blood of many innocents were not daily being spilled on the streets of Jerusalem, West Bank, and Gaza.

 

It seems likely that Trump, assuming against all reason and evidence that his presidency survives and settles down, will likely do what Netanyahu and his son in law tell him to do: leave Israel free to maintain, and as necessary, intensify its policies of oppression toward the Palestinian people as a whole that are cruelly subjugated beneath an overarching structure of apartheid. At the same time the U.S. Government will continue to give credence to the big lie that Israel is the only democracy in the Middle East. Israeli apartheid as an operative system of control, subjugates not only those Palestinians living under occupation but also extends its reach to refugees in neighboring countries, involuntary exiles around the world, and the discriminated minority living in Israel.

 

The main Trump assignment within the United States will likely be to lend full support to the Congressional and state-by-state pushback against the BDS campaign, slandering this nonviolent civil society movement of militant solidarity and human rights by castigating it as ‘the anti-Semitism of our time.’

 

On an international level Trump will be expected by Zionist forces to translate the UN-bashing of Nikki Haley into concrete reality by defunding any organ of the UN (e.g. Human Rights Council, UNESCO) that dares document and censure Israeli wrongdoing under international law. And regionally, Trump seems determined to champion the dangerous Saudi/Israel agenda of anti-Iran war mongering, a posture that threatens to convert the entire region into a war zone.

 

Trump’s clumsy touch was also evident during his much heralded May visit to Riyadh where he gave his blessings to the anti-Qatar, anti-Iran Gulf + Egypt coalitions headed by Saudi Arabia. The occasion offered the Saudis an opportunity to exert collective pressure on their tiny neighbor, insisting that Qatar curtain its sovereignty and endured a misguided hit for supposedly being the country most supportive of terrorism and extremism in the region. To lend American backing to such a hypocritical initiative is perverse and strange for several reasons obvious to almost anyone not totally oblivious to the rather blatant realities of the Middle East: Qatar is the site of the largest American military facility in the entire region, the Al Udeid Air Base, staffed by 11,000 U.S. military personnel, and serving as the counter-terrorist hub for regional military operations. Secondly, the obvious fact that Qatar’s slightly more open domestic political scene, including its sponsorship of Al Jazeera, was far closer to the supposed American political ideal than are the overtly anti-democratic governments ganging up against Qatar. And thirdly, as almost anyone following the rise of Islamic extremism knows, it is Saudi Arabia that has a long record of being the primary funding source, as well as providing much of the ideological inspiration and engaging in anti-democratic and sectarian interventions throughout the region. The Saudi government extends its baneful influence far afield by heavily subsidizing the madrassas in the Muslim countries of Asia, and doing its best to promote fundamentalist versions of Islam everywhere in the world.

 

Extreme as are these geopolitical missteps taken during Trump’s first few months in the White House, they are less calculated and more expressive of dysfunctional spontaneity than anything more malevolent, more bumbling than rumbling (with the notable exception of Iran). There is another more sinister civil society initiative underway that rests its claim to attention on a geopolitical fantasy that deserves notice and commentary. It is the brainchild of Daniel Pipes, the notorious founder of Campus Watch, an NGO doing its very best for many years to intimidate and, if possible, punish faculty members who are critical of Israel or appear friendly to Islam. Pipes is also the dominant figure in a strongly pro-Zionist, Islamophobic think tank in Washington misleadingly named the Middle East Forum (MEF). Much more an organ of hasbara musings on Israel/Palestine and promoter of hostility toward Islam than informed analysis and discussion, MEF is now fully behind an idea so absurd that it may gain political traction in today’s Washington. This MEF initiative is called Israel Victory Caucus in the U.S. Congress and Israeli Knesset.

 

In explaining the Victory Caucus Pipes at the opening of a recent hearing in the U.S. Congress to launch the project, now backed by 20 members of the House of Representatives, made an almost plausible introductory statement. Pipes told the assembled members of Congress that he had been for months racking his brain for what he called an “alternative to endless negotiations which nobody believes in.” Pipes is right to pronounce the Oslo diplomatic track a dead end with no future and a sorry past. His ‘Eureka Moment’ consisted of abandoning this failed diplomacy and replacing it by bringing Israel’s military superiority “to convince the Palestinian they have lost,” thereby awakening them to the true realities of the situation. In effect, this awareness of Israeli victory causing Palestinian defeat was the way to move forward, arguing that long wars can end only when one side wins, the other loses. Pipes personally made a parallel effort in Israel, including at the Knesset, being the lead performer in a conference in Tel Aviv dedicated to the ‘victory’ theme, and holding a highly publicized meeting with Netanyahu intending to promote the Victory Caucus. In effect, since the diplomatic track leads no where, and Israel possesses the capacity to increase Palestinian suffering at any stage, it should use this leverage to compel those representing Palestinian interests to face up to reality as Israel sees it. Part of the background is the self-serving insistence that the reason that diplomacy doesn’t work is because the Palestinians are unwilling to accept the permanent presence of a Jewish state in their midst, and until they do so, the war will go on. From this perspective, the diplomatic track could not get the Palestinians to yield in this manner, and so Israel should shift its efforts from persuasion to coercion, with the implicit false assumption that Israel was too nice in the past.

 

What Israel wants from the official representatives of the Palestinian people is a formal acknowledgement that their effort to prevent the establishment of a Jewish state in Palestine has failed, and that they should formally express their acceptance of this outcome, not only in international languages, but also in Arabic. Victory Caucus also expects the Palestinians to affirm officially a right of self-determination in Palestine that belongs to the Jewish people. Also, the Palestinians are advised to be ‘realistic,’ and drop their dreams of a right of return to be exercised by Palestinian refugees. [for explication of the Victory Caucus approach consult the website of Middle East Forum, especially the many articles and presentations by Daniel Pipes; also helpful is Efraim Inbar, “Victory Requires Patience,” July 19, 2017] Again, there is an implicit assumption that Israel has been realistic over the years despite ignoring the guidelines of international law relevant to ‘belligerent occupation,’ including prohibitions on collective punishment and population transfer/settlements.

 

Pipes is very clear that the implications of victory, what he terms the details, should be left to the Israelis to decide upon. With a turn of phrase that seems an extreme version of wishful thinking to make himself sound reasonable and less partisan, Pipes insists that once this central fact of an Israeli victory is accepted, it will “be more beneficial to the Palestinians” than the present road to nowhere. The fine print may be the most disturbing and consequential aspect of the Victory Caucus arising from its realization that whatever Zionists and their most ardent supporters know to be true is not what most Palestinians believe to be the case.

 

Thus, for the Pipes’ logic what needs to happen, is to make the Palestinians see this particular light, and given the MEF convenient (yet deeply misleading) view of Arab mentality, this awareness can only be brought about by raising the costs to the Palestinians of continuing their struggle. Efraim Inbar frames the present situation as follows: “The Palestinian reluctance to adopt realistic foreign policy goals and the Israeli hesitation to use its military superiority to exact a much higher cost from the Palestinians are the defining features of the Israeli-Palestinian conflict.” Although what would be realistic for the Palestinians is not specified, but from the context of the argument and overall Pipes’s outlook, it would be pretty much an acceptance of the entire Israeli agenda: the settlements, including their infrastructure of roads and the wall, retention of Galilee and Jordan Valley for security, and a unified Jerusalem under Israeli control that serves as its capital.

 

When Inbar premises his policy proposals on overcoming “Israeli hesitation to use its military superiority” to get the Palestinians to accept reality, one can only shudder at what this writer has in mind. Pipes assures his audience that whatever is done along these lines to convince the Palestinians should respect “legal, moral, and political limits” but by explicitly leaving it up to Israel to determine what this might mean, these limits lack all credibility, especially given Israel’s past behavior, which flagrantly and repeatedly ignores these limits in enacting policies that produced massive and acute suffering for the Palestinians over a period of decades. Against such a background I find these lines of MEF advocacy to be irresponsibly provocative in their formulation, and frightening if ever relied upon as the basis of action.

 

What is left out of this Pipes’ proposal seems far more significant than what is included. The justification for the Victory Caucus is based on a supposed posture of Palestinian rejectionism explains far less about the unfolding of the conflict over the course of the last hundred years than would referencing Zionist expansionism, combined with the salami tactics of always disguising more ambitious goals during the process of achieving their proximate objectives. In recent years, particularly, the Palestinian side has badly wanted a deal, signaling even their willingness to accept a bad deal, so as to end the occupation, and establish a state of their own. Any objective approach to this question of why the Oslo diplomacy reached a dead end would attribute the lion’s share of responsibility to the Israeli side with its practice of putting forward ever escalating demands that it knows in advance that the Palestinians must reject, not because they are unrealistic, but because Israel’s demands for ‘peace’ are the permanent subjugation of the Palestinian people.

 

Most disturbing of all is without doubt this image of Israeli hesitation to use the force at its disposal as if implying that Israel have been gentle occupiers and benign oppressors for these past 70 years since the UN proposed partition of Palestine. The evidence is overwhelming that Israel consistently relies on disproportionate excessive force, as well as collective punishment, in response any violent act of Palestinian resistance, and even to nonviolent Palestinian initiatives, for instance, the first intifada (1987), demonstrations against the unlawful wall, and the reaction to the recent restrictions on entry to Al Aqsa were met with violence. One of the most striking conclusions of the Goldstone Report on the Israeli attack on Gaza at the end of 2008 was its referencing of the Dahiya Doctrine, referring to the Israeli rationalization for destroying civilian neighborhoods in south Beirut assumed to be pro-Hezbollah as part of a strategy of disproportionate response to Hezbollah’s acts of violence in the course of the 2006 Lebanon War. Israeli military commanders gave two complementary explanations: the civilian population is part of the enemy infrastructure, thereby abolishing the distinction between civilians and military personnel; it is helpful for actual and potential enemies to perceive Israel as madly overreacting in response to even a minor provocation.

 

With more than a touch of irony, as of this writing, it is the Palestinians who are with greater credibility claiming ‘victory’ given the apparent resolution of the Al Aqsa crisis, which induced Israel to back down by agreeing to remove metal detectors and surveillance camera from two of the entrances to the Noble Sanctuary/Temple Mount esplanade leading to the mosque, and what is equally relevant, Israel appears for now to accept the continuing Wafq role as the only legitimate administrative authority in relation to this sacred Muslim religious site. Whether this is indeed more than a tactical retreat by Israel remains to be seen, and will be determined by how the recurrent battle for the governance of Al Aqsa proceeds in the future.

 

Similarly, whether the Victory Caucus is viewed in the future as a sinister display of Zionist arrogance or a step toward closure in the Israeli end game

in Palestine will depend, not on the positing of grandiose claims, but what happens in the future with respect to Palestinian resistance and the global solidarity movement. Israel’s president, Reuven Rivlin, recently warned Israelis that the BDS campaign poses “a strategic threat’ to Israel. Such a sentiment makes more than a little odd, and absurdly premature, for American and Israeli legislators to step forward to call upon Israel to up the ante by increasing their pressure on the Palestinians so that they are forced to admit in public what they now refuse to say even in private, what MEF wants us all to believe, that Israel has won, Palestine lost.
